Have either the defense or the prosecution called any expert witnesses yet to testify about the issue of possible "rehabilitation"? Or maybe that is for this afternoon.
There has been only one witness testifying so far, and he is from Oxford PD. His testimony was primarily about evidence in the criminal case. Defense attorney started getting into EC's psyche during her cross examination of the witness.

This is so hard to listen to. I remember this day so vividly and listening to the man in the burgandy shirt retell it, gives me chills.oxford Strong.jpgoxford.jpg

This hearing will not be over today. If it doesn't conclude tomorrow, they would resume the hearing next Tuesday.

Upon hearing testimony regarding Ethan's parents and his upbringing, things don't bode well for them when they go to trial. JMO

His parents had been hoping to view the Miller hearing. Was their request denied? I missed the final decision on that.

Ethan's parents are not in the courtroom (their original request), but I haven't ever seen or heard whether or not they were allowed to watch the hearing at their respective jails.

Add this to the jail tablet crap and if he gets paroled at age 45 I feel sorry for his neighbors.

[snipped by me]

I heard this while listening live yesterday but feel like it needs to be called out...

"Loftin pointed to James and Jennifer Crumbley's actions after the shooting and how their actions did not show care or concern toward Ethan. They drained his bank account, and Jennifer Crumbley texted her husband, "Ethan isn't going to get out of this. We need to save ourselves," before they fled to avoid charges. "

WE NEED TO SAVE OURSELVES. I have no words.

This prosecutor's grandstanding is going to get this case tossed on appeal. She knows it and doesn't care. The judge needs to go too.

Reminds me of the Ross Harris case.

What case tossed on appeal? This is about sentencing. Curious what you mean.

It's the Miller hearing. His defense attorneys are correct on what they say should be allowed during this hearing.

If he gets sentenced as an adult, I can see it being overturned because the prosecutor's grandstanding and the judge allowing it, just like the Ross Harris case.

Obviously, the prosecutors won't decline to re-litigate like they did in the Harris case, but doing it this way increases the possibility that the families have to go through all of it again which is vile.

I've loathed this prosecutor from the start and I still do.

There is a student testifying right now and I'm not sure what the purpose of this line of questioning is from the prosecutor. I don't hear anything about anything related to the criteria they should be discussing for the Miller hearing. Yesterday, I could at least follow the logic behind the questioning and focus on Ethan's texts and communications but this definitely seems to be totally unrelated to what they are supposed to be discussing.

I agree, except I don't think the teacher should have been allowed to testify yesterday.

Oh yes, I agree, I was thinking more of the law enforcement witnesses. The only thing I could have seen as related to the Miller criteria would have been if they focused on child development/etc. with the teacher, but the focus on her as a victim definitely didn't have anything to do with what they're supposed to be focused on.

I just watched most of the testimony of the expert witness who is an expert in adolescent brain development. IMO, he was extremely knowledgeable, based his remarks on scientific findings, expressed himself well, and shed a lot of light on the issue of rehabilitation possibility for a juvenile's Miller hearing/sentencing. The defense counsel did a good job of preparing her questions, and I also thought that the prosecutions's cross-examination was very good.

I know we will hear more expert testimony on Tuesday of next week when the court resumes this case, but at this time I think that EC will not be sentenced to life without parole. JMO, but the expert testimony was incredibly powerful, IMO.

Nonetheless, if EC receives a 25-40 year sentence he still may not be able to be rehabilitated and then a parole board can deny him parole throughout his life. As the expert witness testified "the possibility for rehabilitation exists, but it is not a guarantee."
