So, has the husband been ruled out - or is he a POI simply being the husband , possibly an estranged husband....

Please, someone tell me what a civil docket is... wish I knew more about law.

A civil case means it is not a criminal case.

Civil cases are usually about actions between private parties - like if you sue someone - and are covered under a different code of legal statutes, and have entirely different judges, etc. In civil cases the penalties are in the form of money, versus jail time or probation, etc. Divorce is a good example of civil law. Adoption, custody hearings, things like that. In civil law, each side has their own independent lawyers.

Criminal cases are determined by the state or federally, and cover - criminal acts in the form of harm towards persons or property. (Murder, theft, drugs, etc.) In criminal cases, the prosecution side is represented by government attorneys.

There is a much higher standard for burden of proof in criminal cases than in civil cases.

A good example of the difference of burden of proof would be the OJ Simpson case. While he got off on the criminal charges, he was found liable in the civil wrongful death case - by a unanimous jury. They didn't have to decide 'beyond a reasonable doubt', which is another key distinction in level required between the two types of law & cases.

I would say this, he has probably been ruled out, and the reason that I say that, is I can't see both his parents saying that he was there, because if he wasn't they would also see jail time like no other.

For me, he has been ruled out unless some new info surfaces that puts him somewhere other than FL at the time, but other posters still have suspicions about him.

Based on what you've read and listened to, what is your opinion?

Wow Muckrucker I did not know that. I know that small claims is held in County Court. However to file for divorce ( here anyway) you must file in District Court...So I am guessing Civil court can be held at both County and District Court levels. I wonder if they also have a Municipal Court level for Civil hearings....Very interesting...

K-9 rescue team joins search for missing Bragg soldier

FAYETTEVILLE, N.C. — A Fayetteville-based K-9 rescue team is the latest group of volunteers to help in the search for a missing Fort Bragg soldier, who was last seen 11 days ago.

On Thursday, hundreds of volunteers, including the TMC K-9 Search and Rescue Team, will scour the areas around Froggy Bottoms – the Ramsey Street bar where Bordeaux was last seen April 14 – and the apartment she shared with her husband about a half mile away.

No, but hopefully that was already done. But then there was an Army guy that found the muddy boots behind the Tiki Bar, and that was also searched by LE, so who knows.

Yup. Far as I know, municipal (i.e. bylaws and such) would be included under 'local trial courts'. Parking infractions would be argued, decided in local municipal court, whereas a highway traffic violation would be state/district, depending on violation & region.

ETA - hopefully, one of our resident paralegals or legal eagles will pop in an expound upon this for clarity and accuracy.

If you get a traffic violation from a city cop, then its Muni. If you get one from Sheriff or CSP, then it goes before the County Court here.

I really am only somewhat knowledgeable when it comes to criminal courts...and that is not from a Lawyer type standpoint, but from the poor officer stuck on court transport many times, very boring job.

Just a quick breeze through the latest on this thread...it appears that some have shifted back toward the husband as a possible suspect in their minds.

Haven't seen LE do or say anything that would bring me to that conclusion. By all accounts thus far, it appears his being in FL at the time was confirmed by someone else.

NH appears to me to be the only solid POI and the one known for sure who was last seen w/KB.

StrayKat, All I can tell you is the little I know on it. We would get calls at the S.O., it might be something like Jane Doe borrowed my X box and I want it back, can you go and get it. Since it was not stolen, we could not go and retrieve it, we had to advice them it was a civil matter. Like small claims court is Civil. I however don't believe Divorce is a Civil matter, but not positive. I dug this up for you, hope it helps....Where did you see this? If I could look at it might be able to help?

Was mentioned by a fellow sleuther earlier this evening... I don't remember who. They said when they were looking for info on the owners of the bar that they also looked for and found Kelli's name on a civil docket

I wonder what her name would have been on the docket for... divorce? Just wondering...

They were married in Florida, but the civil document I found was in North Carolina.(Cumberland County) I know there is a one year waiting period before you can get divorced in N.C so they may have filed it to protect themselves. It would lay out the terms of their divorce such as the division of assets and list who was responsible for which debts.

  • Kelli's military unit holding a vigil tomorrow night
  • massive response so far for requests for search volunteers
  • Via interview tonight on JVM with Mike and Kelli's brother Matt, it came out that Kelli's Lieutenant & Apartment manager contacted hubby Mike in Florida (at his Dad & step-mom's) Monday morning about 11:30 when Kelli didn't show up for work. They requested permission to enter the apartment to check for Kelli & Mike granted that permission.
  • When they found the apartment empty, Mike called first to check in with Kelli's sister, then called Kelli's Sargent and learned no one had heard from her.
  • After several more hours of worry, he was informed they (military) were going to file a missing persons report, so Mike packed his bags and headed out for NC.
  • Neither Mike nor Matt believes Nick brought Kelli home. Matt (paraphrased) "Any logical person... there's no way she was dropped off. Nobody thinks she was dropped off here. It's just a fabricated story to qualify his (NH) answers"
  • Review of earlier interviews with Kelli's mom brought to light the fact that LE told her (thru relating Nick's story) that when she was spooked, first Kelli didn't want to get out of the car, then she did get out (per story). car
  • More speculation on status of the marriage.
  • VOH reports they were surprized to see a female (Kelli) with NH at Froggy's. Struck them as unusual
  • LE has not shared with the family where/what NH was doing between the time she was last seen and when she was reported missing
  • Husband has never been to Froggy Bottom's, nor does he know Nick. He and Kelli did not frequent bars together. They'd go to Wild Wings for wings and didn't drink while there.
  • Froggy's being issued an eviction notice. Someone wants to shut the place down for unpaid rent & damages
  • Brother Matt stated that they have not found Kelli's cell phone during his JVM interview

I'm sure I've missed a thing or two, but hopefully that captures key highlights and others can help fill in any blanks.

I am new and am not sure how to do all of this....but something jumped out at me and I had to try to post. Do you think that the last 2 text messages might have been sent to her Mom? ("A man is taking me home" and "home safely") Her mom new she was going out drinking....perhaps that is how her mom knew KB was spooked... Might be a stretch...

Two types of court: criminal & civil

Civil is everything that is not covered by criminal statutes or laws. It includes small claims court, family law, divorce, property dispute, real estate, libel/slander, custody, torts, personal injury, labor, contract disputes, etc.
