and the NY case - where he was found guilty.

A federal judge has ordered President-elect Donald Trump and ABC News host George Stephanopoulos to sit for four-hour depositions next week in a libel lawsuit Trump brought against the network earlier this year.

Miami-based U.S. Magistrate Judge Lisette Reid issued the order Friday, signaling that Trump’s status as president-elect is not a reason to put off sworn questioning of him in connection with the suit he filed…


Trump sued ABC after Stephanopoulos said on air that Trump raped writer E. Jean Carroll, who won a civil verdict against Trump for sexual abuse last year. The jury did not back Carroll’s rape claim against Trump, but in a subsequent opinion, the judge presiding over the case emphasized the distinction between the legal definition of rape and its more colloquial understanding.

Last year, Trump was found liable for sexually assaulting and defaming Carroll and was ordered to pay her $5 million. In January, he was found liable on additional defamation claims and ordered to pay Carroll $83.3 million. Trump is appealing both verdicts.

Neither verdict involved a finding of rape as defined under New York law.

The judge in both cases, Lewis Kaplan, has said that the jury’s conclusion was that Carroll had failed to prove that Trump raped her “within the narrow, technical meaning of a particular section of the New York Penal Law.”

Kaplan noted that the definition of rape was “far narrower” than how rape is defined in common modern parlance, in some dictionaries, in some federal and state criminal statutes and elsewhere.

The judge said the verdict did not mean that Carroll “failed to prove that Mr. Trump ‘raped’ her as many people commonly understand the word ‘rape.’ Indeed ... the jury found that Mr. Trump in fact did exactly that.”

While rape is the most commonly known type of sexual assault, under New York Penal Law there are several other types of sexual assault including forcible touching, sexual abuse, criminal sexual act, sexual misconduct, sexual conduct against child, and facilitating a sexual offense with a controlled substance.

Yes indeed, a very expensive fine line--- you would have thought someone like Mr. Stephanopolous (sp) would understand that kind of fine line- expensive lesson learned

I do wonder if this now settled lawsuit is the reason that The View has had Sonny read legal statements after some of her comments? ABC must be feeling the pressure.

I have to say, if my employee, in such a high visibility situation, cost me millions, I would fire that employee-- just sayin'---words have consequences and there is no excuse IMO for using words that could defame someone, especially a potential president, past president, who you have to know has filed hundreds of lawsuits----to be this unaware, well there is no excuse for it.

IMO, if it wasn't Trump, this case would have gone nowhere. For all intents and purposes, it was what most would call rape.

The nuances of NY state law is what's at question because for some ridiculous reason, they don't consider forceful digital penetration to be "rape."

Even the judge stated in official court documents that it's essentially rape by common use of the term.

I'm really surprised ABC settled, but in this political climate, I don't think they want to take the chance that they're a headline everyday. I think firing GS over this will do much more to harm ABC. However, I haven't ruled out the possibility that GS might resign himself. By settling based on a technicality, it harms his credibility. I can see him quitting over that.

I think that the unjust lawfare waged against President Trump has been totally exposed and there will not be any more of these cases in the future because of that.

With this being his last term the motivation for these case's has disappeared. JMO.
