Very curious. Sitting here & 25 min late on our planned return.Trump atty Habba walked out from chambers, alone. Then, AG’s attorneys head in.Recently, Trump complained about a low-ball settlement offer... Settlement bid afoot?They return. We continue. Who knows


If this was a settlement offer, it would be the 2nd time for this case.

In Sep 2022 (prior to trial) Letitia James rejected a settlement offer from trump's lawyers.

I think he's always been a shallow and callous dimwit, but I do think he's making more gaffes these days. And while I can hope it's encroaching dementia, I suspect it's at least partly because he's lost his prior entourage of 'handlers' and bodymen who formerly advised him on appearing at least marginally tactful and empathetic.

He may still draw crowds of "supporters" (which I put in quotes because it's clearly become a cult with no connection to reality and they aren't actually endorsers or admirers of Donald the man and any values or political leadership or plans he represents [beyond bigotry, that is] -- they are now "supporting" a fictional cult leader of their own conjuring) but I don't see him having any longer the support of competent advisors, other political leaders or even the R party -- except, of course, that the Rs don't seem to be able to come up with any other feasible candidate either...

It's such an incredible situation. A President who refuses to accept defeat, when clearly he was defeated, having the support of the GOP. He has engaged in various criminal behaviours, including some that clearly are not good for America, and he calls for the arrest of the judge and prosecutor, and people argue that his prosecution is mostly political. And he is polling well for the election in a year. There is a surreal nature to this situation

11/15/23 Update: Trump & his co-defendants have filed a motion seeking a mistrial on the grounds that the trial has been "tainted" by the appearance of bias on the part of Judge Arthur Engoron & his law. Defendant's Memorandum of Law in Suppot of Motion for a Mistrial. Link:

Judge Arthur Engoron did not issue a ruling on the defense's motion for a mistrial in court, opting to give the NY AG time to determine if the state wants to respond to the request. "I would ask if we could have until tomorrow to determine if we want to put in anything," state attorney Kevin Wallace said after Engoron's asked if the state plans to file a response.

There is no "urgency" to respond to former President Donald Trump's motion for a mistrial in his civil fraud case because of its "total lack of merit," New York Attorney General Letitia James' office wrote on Thursday morning.

In a two-page letter, the attorney general's senior enforcement counsel Kevin Wallace said that "putting aside the total lack of merit to [Trump and his co-defendants'] application for a mistrial – it is preferable to have the Court hear and decide the application on full briefing" in the interest of "judicial economy."

The state wants Manhattan Supreme Court Justice Arthur Engoron to set a deadline for their response on Dec. 8, "given the demonstrable lack of urgency, the impending Thanksgiving holiday, and the fact that the ongoing trial."

Not that I ever expect him to act with decency, but he WANTS to disparage the law clerk and is fighting to do so?? He knows no low too low.

But, in practical terms for the defense, any chance to file an appeal is a chance for delay I suppose. If it makes the defendant look like a brute in the process, well, all the better they seem to like it.

11/16/23 Update: Attorneys for Trump have filed an emergency application for a stay of the limited gag order issued by last month Judge Engoron, asking that an appeals court annul & vacate the gag order and fines imposed against him. A New York appellate court temporarily paused gag orders on Thursday that had barred Trump & his attorneys from swiping at the principal law clerk of the judge presiding over Trump's civil fraud trial. Judge David Friedman of the appellate division's first department ruled from the bench after a brief oral argument. NY AG Letitia James & representatives for Judge Arthur Engoron have until Wednesday, 11/22/23 to file a response to the appellate judge's stay of the limited gag order imposed last month on Trump by Engoron, according to the appellate judge's order. Trump's reply is then due on 11/27/23 before the appellate court decides whether to fully lift the gag order. The civil fraud trial is expected to wrap up in mid-December. The cross examination of the defense's real estate expert, which was expected to last at least two hours, ended abruptly after he appeared to contradict his own findings in the expert report he had compiled.

Steven Laposa testified yesterday that he believed the attorney general's report was "flawed" because it was based on the market value of Trump's assets, rather than their investment value, which could be much higher.

Minutes into his cross-examination, state attorney Louis Solomon requested that Laposa read the second sentence of the notes section of Donald Trump's statement of financial condition.

"Assets are stated at their estimated current values," the note said, referring to the properties' market value.

"First time I've seen this," Laposa responded after reading the note, which supported the attorney general's contention that the valuations were indeed based on market values.

"You wrote a report accusing the attorney general of bias" by using market values, Solomon lectured Laposa, prompting a sustained objection from the defense.
