I agree about RN. I think that was the extent of her involvement. I don't think she was capable of much else. And I believe that once she realized the truth, she came forward with it. She was likely taken advantage of.

FW on the other hand.... Her previous charges still apply. MO, she still broke those laws she was accused of breaking. I think the only reason it was all dismissed without prejudice is because AC was unwilling to show her hand at that time. Had she of gone forward with the case then, she would have had to. <modsnip>

Your post really gives the reasons why FW and her attorney did not waive Speedy Trial. I think Billy regrets it as the wrong move because he tried to revoke his Speedy Trial Waiver 2 X's by filing his own Motions.

He could have gone to trial before Jake turned State's Evidence and before all the Discovery got in also. Ready or not he was entitled to a Speedy Trial.

I always thought fleeing to Alaska during the investigation had to be one of the dumbest moves. And didn't the Wagners say they moved to Alaska because they thought it was the best environment to raise Jake and Hanna's daughter?

My opinion: Yeah, and strangely, once they got there, they couldn't afford to live there. How the hell were they able to (in Ohio) buy a farmhouse and farm, build a barn, have all those rural creature comforts like an 18 WHEELER, ATVs, etc, but once they get to Alaska, seems the money dried up. I know that Alaska is more expensive than the lower 48, but to me - again, MOO - some sort of illicit source of money dried up when they went on the run.

Isn't the moratorium on the executions specifically? I don't think there's a moratorium on the death penalty as a sentence, BICBW.

Unless Jake came up with some new evidence, they may not be able to go after her for both of the old charges.

However, she was named in the indictments of the 4 Wagners under the "criminal enterprise" charge. Depending on how much Jake reveals, there could be more charges.

What was his religion being spoken of? I've read many times that it seems to be something differing from the family's.

Oooo, I missed that part. Didn't realize they named her as part of it. And since AC didn't mention dropping that charge as part of the plea deal wonder if that'll be pursued.

It will be interesting to see what happens. I suppose it depends on how much time and effort (and budget) the state of Ohio wants to spend on pursuing other charges against FW. The Ohio General Assembly has been fighting tooth and nail with DeWine over budgets (they're preparing the biennial budget right now) so its anybody's guess. <Modsnip>

I think the state's cases against both FW and RN proved weak.

First, evidence disputes that FW lied to the grand jury. When the defense was able to produce proof that she purchased the vests AFTER the Rhoden family murdered, the case against her was dismissed, and no charges have ever been refiled. There's a statute of limitations to refile and I believe the state would have done so if they had any evidence. By dismissing and never refiling charges, FW has been free to visit the accused and carry on with her life unencumbered.

On the other hand - Newcomb did in fact lie to the grand jury albeit because her daughter told her to.

Newcomb was initially charged with obstructing justice, perjury and three counts of forgery, all felonies -- all dismissed with a plea agreement for obstructing official business -- a misdemeanor.

Prosecutor Angela Canepa said in Pike County Common Pleas Court that a handwriting expert concluded that Newcomb did not sign the documents herself.
Canepa said Newcomb admitted to falsely telling a grand jury and investigators that she did so only because her daughter — Angela Wagner, — told her to.

WAVERLY — Judge Randy Deering never even looked up from his paperwork when, in one of the state’s most high-profile murder cases in decades, he told the Pike County courtroom: “This case is dismissed.”

She had faced felony charges of obstructing justice and perjury. Prosecutors accused her of lying to a grand jury about two bulletproof vests that were found in her son’s bedroom at her family farm when investigators raided it in May 2017, more than a year after eight members of the Rhoden family were shot to death overnight in four rural Pike County homes. Wagner’s son, daughter-in-law and two grandsons have all pleaded not guilty to eight counts of aggravated murder and related charges, and each could face the death penalty if convicted.

Angela Canepa, an assistant section chief with the state attorney general’s office who is prosecuting the case, said Wednesday there remains work to do in Fredericka Wagner’s investigation and authorities did not want to run afoul of her right to a speedy trial. She and Pike County Prosecutor Rob Junk asked the court to dismiss the charges without prejudice, which means they reserve the right to refile the same charges within the six-year statute of limitations.

Canepa said there is still much evidence to comb through.

Defense Attorney James Owen doesn’t buy that.

“Mrs. Wagner has maintained since her arrest that she is an innocent woman,” he said. “We want to make sure there is no misunderstanding her position.”

Wagner had been out of jail on $100,000 bond. The court bailiff removed her electronic ankle monitor Wednesday. Wagner said she hopes she is now allowed to visit her family in jail without jeopardizing their pending murder cases.

“You ordered a bulletproof vest through Amazon?” Canepa asked.

“Yes, I guess I did. I will give you the records,” Wagner answered.

“I thought I did,” Wagner said.

In March, attorney Owen produced receipts that showed Wagner used PayPal to pay $284.99 for one vest and $379.99 for another off eBay, not Amazon. He said she had simply recalled incorrectly. Those receipts were dated May 7, more than two weeks after the homicides. In addition, Owen said, the manufacture date on one of the vests was listed as April 29, also after the homicides.

So let me begin here, Jake absolutely was not trying to choke back sobs. I watched that clip a hundred times and saw the same thing each time. He literally had to suck his lips in and smash them together to keep from laughing out loud when the judge mentioned Hannah Mae. Even then his ribs were moving as if he was really really laughing.

Watch it again. Same with Hanna G. Those two he hated and got some real pleasure in killing them, but more Hannah R than Hanna G. Even with only the side of his face showing his body was shaking with an effort not to burst out in full on laughter. He enjoyed killing her more than he ever enjoyed anything in his life. JMO

I'm still not accepting that custody of a three-year-old was the primary or sole reason why 8 people were massacred. Although I think the prosecutor had evidence to support this theory -- what else was behind these murders not discussed (because the state lacked evidence to prove)?

DeWine and BCI have never backed down on their Commercial Grows comments. Not once. Coupled that with continued futile attempts to sway people that the Rhoden grows were just a small grow by some non law enforcement without actual knowledge of the case creates a big hmmmm for me. Streisand effect in full force.

The only arrest that I have read about that is a direct result of the Rhoden murder investigation involves trafficking in prescription pills. "Information leading to JR arrest was discovered during the investigation of the April 22 Pike County massacre, but the arrest is unrelated to the homicides, said Jill Del Greco, a spokeswoman for the Ohio attorney general. Officials also arrested Rhoden's neighbor, JM, 63, on a charge of drug possession." Relative of Pike Co. victims arrested on drug trafficking charges

Thanks. I have been divided on this issue of Jake showing remorse. If it proves to be remorse, it was minimal at best IMO. And it does seem to be the same responses as in past hearings. I don't trust him or his family yet. At this point he has accomplished removing the DP specification for all four of his ruthless family. I just hope he didn't fool Canepa as much as he did some of us, including me.

However, part of his plea bargain is that he tell the truth, the whole truth, and nothing but the truth...in all of his communications going forth. Let AC catch him in one Itty bitty lie, and the deal is over. That's nice to remember.

Legal question: How can Jake’s plea agreement have any bearing on whether the others get the death penalty? I’ve never heard of an agreement like this. One defendant negotiated on behalf of others in the same case? Can someone weigh in? TIA

However <modsnip> I'm pretty sure they needed Angie at home watching Boondock Saints and the kids.

Jake shot HG and Frankie and the 3 at Dana's, so only 3 victims left.
So that leaves Billy to go after Chris and George going after Gary, 2 guns were used there.
Billy was fighting with Chris and with his temper and holding a grudge I can't imagine him not going to Chris's.

The only scenario making sense to me - if Angie was a shooter - is shooting Kenny because they wanted her to be in on it as much as them. I mean they didn't need her they just wanted her to kill one person, to have as much "skin in the game" as them.

So really it's down to which one of the 3 shot Kenny? They won't disclose type of bullet or anything else....2 Cents
