A federal judge seems to be going to enforce that the govt allow the 'paroled' migrants to live out their 2 year 'parole' in the US without being deported.


A federal judge said she will block President Donald Trump's administration on Thursday from revoking the temporary legal status of hundreds of thousands of Cubans, Haitians, Nicaraguans and Venezuelans in the United States.

U.S. District Judge Indira Talwani in Boston said the U.S. Department of Homeland Security's decision to cut short a two-year parole granted to the migrants under Trump's Democratic predecessor Joe Biden was based on an incorrect reading of the law.

The US Govt won't even release the names of the people they have sent to El Salvador. Not to their families or anyone else. ICE says they deleted the list because the people were no longer in their custody.

It is against international law. It is considered to be a forced disappearance.

CBS got hold of a leaked government list of names, however. So somebody has the list.

I've realized the Supreme Court decision has no teeth at all.

The US clearly doesn't have jurisdiction over a soverign country like El Salvador. The US Government would have to request or negotiate Mr. Abrego-Garcia's release.

With Trump in charge, I fear there will be no attempt at a formal request for release.

It is abhorrent to think of the deep calculated evil that is planning this. Seizing people of valid status without consequence and sending them to die in a foreign prison.

I’ve been using words like “autocracy” and “authoritarian” to refer to the Trump regime, but THIS MAKES IT OFFICIAL (and yes, I’m yelling). ANY time the Judicial Department is ordered by the president to investigate people JUST because they publicly disagreed with Trump WE ARE IN AN AUTOCRATIC/AUTHORITARIAN SYSTEM.

I was reading an article about this. The Supreme Court (or any US court) cannot make El Salvador return anyone. No jurisdiction.

Though a US law school professor (Nicole Hallett) says the US Govt can request it. That the El Salvador prison is acting like an agent of the US because the US paid them $6M to take the detainees. She also said that ..... "the US has previously facilitated the return of mistakenly deported individuals."

Like you, I think they will probably lie and say they tried this or that and it didn't work.
But I sure hope that for once they do the right thing.

You made blanket negative generalizations about these students and I pointed out, based on my experience, that you were generalizing. We were not talking about Vietnam veterans. We were talking about due process for immigrants.

So, am I correct in assuming that any protest against government policy by anyone is grounds to deny due process? That’s what Trump seems to think (see my post right before your initial post this evening) and that is what we call an authoritarian.

I do not understand the arrangement to send people to this prison- US pays, correct? Is it just one payment "forever?' Are they sentenced for a time period? Or it is their life? (I see that he was originally from El Salvador, so more complicated where he could be and what records there are about him.)

Unfortunately, I don’t think Mr Garcia is ever coming back from El Salvador. The Supreme Court ruling is technically a win but there’s nothing in there that would “force” El Salvador to return him and it’s vague enough that the Trump administration can feign that they are “working on it” without actually doing anything.

And as pessimistic as this sound, I wonder if he is even still alive The White House definitely does not want him to return to the US to be able to share his side of the story with the media. That prison is really not some place that you really get out of. All MOO. And I hope I’m wrong and he does get to come back to his family! But I’m not super optimistic about that happening under this administration.

Yes, in this case the Trump Administration actually has an agreement 'in place' with the holding nation. The USofA is actually paying 6 million dollars for El Salvador to 'detain' these unconvicted persons in their prison system.

That does not equate into El Salvador just refusing to deport any "random someoneone of their own citizens" to the USofA for trial etc etc.

i would think it's more than a bit tough to 'facilitate' the return of a declared terrorist back to the us. particularly a judge-affirmed ms-13 gang member who was ordered out of the us in 2019 by that judge, and one who didn't request asylum during the 8 years before the judge ordered him to leave.
