I know the judge and the prosecutor both said that this killer could not be compelled to give details about his crime, but I have real doubts about that.
Certainly, just sitting there as an individual and citizen this killer does not have to incriminate himself. Plead the 5th and all that.
But this was a plea deal; two sides negotiating.
Defense says, he’ll plead guilty if you take the death penalty away.
Prosecution responds, we’ll accept the plea deal and scratch the death penalty, but this killer will need to give a detailed confession and answer questions.
Defense answers, he doesn’t want to do that.
Prosecution responds, see you in court to make his appointment with the firing squad.
Defense says, it’s about his 5th amendment rights.
Prosecution responds, have him waive that right, like he did his right to appeal.
Defense says, he doesn’t want to.
Prosecution responds, see you in court.
This doesn’t seem hard to me.
