Grrr... this "newest" version of dismiss the DP by Nurmi sure is a puzzler as written.

To say that the lack of secret testiphoney will make it impossible for the prosecution to pursue the DP? Come on! Nurmi is trying to tell JSS that the CoA decision based on the Constitution means that she has to rule the DP out? Some of the most twisted logic I have ever seen.

Much of the same happened last year in the first sentencing phase. All we got was a rather lame allocution by the defendant. The other witnesses (Patty, whoever) were too intimidated by death threats to testify. Geeze! What a bunch of baloney.

Even if done in secret, JM would eviscerate these people and the defense knows it. We know it. JM knows it.

The fact is, the JURY would come to know it as well. We, the judge, the media, the deadly tweeters who supposedly send death threats???, have absolutely no control over the outcome of the jury deliberations. Does the defense really believe that if the public, through the media, hears about the testimony, it will change the outcome of the jury deliberations???

Sorry for the semi-coherent rant. I have to chauffer my husband around tomorrow for appointments and will miss a hunk of testimony. Guess I'll be up all night catching up!

But it's there. And she doesn't want to die. She doesn't want to live the life that comes with being on death row. That part isn't just about control. No one would want that. It's about self preservation. I still remember the look on her face when the hung jury was announced. It wasn't fake like before, it was pretty genuine. The idea that there are people out there who actually voted for her death is probably pretty harrowing.

She does probably view not getting the death penalty as a win, because every time she loses she has to create a new competition in her mind until she gets a "win."

This is IMO. It's a complicated thing. But basically, she doesn't want to die.

Wow I sure fell behind... still haven't finished reading the closed thread but wanted to bring forth some links re the memory card and date questions before I lose them. Basically my question now is who owned the DSC-W7? I tried looking for pics showing JA with any cameras, found a few with the Canon, none that I could id as the Olympus(no idea where that info had originally come from or how accurate it was) but did come across a pic of her with Leslie Udy that looks like either a small silver camera(the DSC-W7 is silver...as are some Olympus models) or a cellphone in her left hand. I recommend going directly to the jpg link as the first one gets quite graphic.

These charts show that in fact the same memory card recovered with TA's camera could have been used in the still unknown holder of the Sony Cyber-shot DSC-W7 digital camera that was apparently responsible for some of TA's flickr pics from Oct '07(no idea how you can tell that, was forum info). The only qualifier is that the DSC-W7 has to use an adaptor.

This is the date manipulation info listed for TA's Sony Cyber-shot DSC-H9, sounds the same as for the DSC-W7(to me anyway).

Excellent research, Val! I'm quite curious about the owner of the Sony DSC too. Oh, on the Flickr pics, if you click on one, below it shows the camera data, click on 'Show EXIF' to see more.

Great find on that pic, can't tell what it is she's holding but it does seem a bit thick for a cell phone. I don't know what the Helios looked like so no real clue if it could have been her phone or a camera.

We went through so much with the camera memory card on the Post Verdict thread, one of the posters (whose name unfortunately escapes me) finally came up with a reason for why the pic of the card looks so thick in the evidence bag, it was in a card case (or something of that nature, I'd have to find the post for the terminology used) but it looked different than the adapter shown in your pic, but very intriguing that a card from the DSC can fit into the camera that Travis had, really good work, Val.

When Juan was listing off the DT witnesses he said, "just the two experts, the witness from California, and the witness who was testifying and then just affidavits." Where does the NZ witness fit in? Were they trying to play it by ear on this witness? Or was he never actually going to testify and the DT just wants to use his name and his alleged knowledge of Travis' pedophilia for appeal purposes only without ever actually having to call him?

The NZ guy will tell the jury TA said that in 2000 and I know beyond a shadow of a doubt having missionaries in my family that this never happened.

I think you're right—he was never going to testify in the first place.

I did think there would be 0 mitigation witnesses. I thought they were counting on JSS never kicking out the media and the public. To me, she seems to be a pretty wise judge.

Apparently Marc and Travis met at a Family Event hosted by Bishop Vernon Parker. This info is from court chatter, were you can read more. It has been said that Marc approached the DF team when he came to the U.S. for a wedding. It has been said that Marc likes the limelight. Vernon Parker, he is a witness for the prosecution, correct?

Well he's changing his story to benefit Jodi, so her influence is either direct or indirect, doesn't really matter which. I certainly wouldn't put it past her to be proactive in the matter.

I always thought it looked like his chin was resting on his chest. JMO.

I also thought it could be that Jodi lifted him quickly and it snapped his head forward and the camera caught it at just the right moment. I honestly don't think 1 minute is too little time for all the things that happened before the throat cutting to have happened. These things happen quickly and once that throat is cut, Travis is out within seconds. I also don't think it's not enough time for all those wounds to have happened in such a frenzy. I can see it happening very quickly actually and I don't think this attack took very long.
