Megan Boswell's defense tried to get the judge to sever the false reporting charges from the murder and abuse charges. ...

Judge Jim Goodwin denied the defense's request to sever the charges. The defense also argued for a change of venue due to the case's notoriety, which was also denied.

Approximately 1,200 potential jurors are expected to be called.

After all these years and several delays, Boswell will finally stand trial. She's been behind bars ever since her arrest in 2020. She's facing a slew of charges — including two counts of felony murder, aggravated child abuse, aggravated child neglect, tampering with evidence, abusing a corpse and several counts of false reporting to authorities.

The case has faced numerous delays, and approximately 1,200 potential jurors will be brought in with the aim of finding an unbiased jury.

... Any jurors selected will be sequestered for the duration of the trial, which is expected to last a month.

Forty potential jurors were screened on Monday, and 17 were picked. Of those, 10 were women and seven were men. Numerous people were excused based on their answers, especially those who revealed they were extremely familiar with the case.

During the screenings, potential jurors were asked about their recent news consumption and if they had any preconceived beliefs about Boswell and the case. Several also seemed confused by the concept of the burden of proof that is on the state in order for Boswell to be convicted.

  • One prospective juror wrote on the questionnaire that Boswell was “probably guilty.” He was excused.
  • Juror No. 3, a white female with an engineering background, acknowledged she had followed news reports about the case but said she could remain objective. The defense moved to strike but the judge denied the request.
  • Juror No. 12 stated he believed Boswell was guilty and did not think his opinion could be changed.
  • Juror No. 39, who learned of the case through SM, admitted she had formed an opinion and was excused.
  • Juror No. 7 stated she believed Evelyn was murdered and that she would require proof from the defendant to believe otherwise.
  • One juror had signed a petition in favor of Evelyn’s Law and said Boswell was “definitely guilty” on her questionnaire. She said her opinion had not changed since December.
  • Juror No. 29 said he couldn’t set his opinion aside. “She shouldn’t have done it. It’s atrocious.” He was excused.

The jury is comprised of eight men and six women of various ages and from different backgrounds. The court entered recess on Tuesday night and will resume at 8:30 a.m. Judge Jim Goodwin said proof will begin at 9 a.m., marking the start of the trial.

When the court convened on Wednesday around 8:45 a.m., prosecutors began by stating they needed to dismiss Count 18 against Boswell, one of the many counts of false reports against her. Judge Jim Goodwin dismissed the charge.

The prosecution then asked that the defense not present any evidence on that count since it would be hearsay without Boswell’s testimony.

According to the presentment of charges against Boswell, Count 18 alleged that Boswell made a false report to Sullivan County detectives and a Tennessee Bureau of Investigation by claiming either she or another person rolled over onto Evelyn while sleeping, resulting in her death.

At trial, Boswell is facing 19 charges, including:

  • First-degree murder
  • 2 counts of felony murder
  • Aggravated child abuse
  • Aggravated child neglect
  • Tampering with evidence
  • 11 counts of false report
  • Abuse of a corpse
  • Failure to report a death under suspicious, unusual or unnatural circumstances
The presentment alleges that one of Boswell’s felony murder charges stems from her killing of Evelyn “in the perpetration of or attempt to perpetrate the felony crime Aggravated Child Abuse,” while the other was allegedly done in the perpetration or attempt of aggravated child neglect.

During jury selection on Tuesday, Boswell’s attorney, Gene Scott told jurors that they had “one chance” to get it right for Boswell.

“I submit to you that Megan Boswell has already had her chance,” Massengill said. “She was gifted with a beautiful child. A healthy, vibrant little girl. Evelyn was perfect. Megan Boswell already had her chance. Today is Evelyn’s chance. Today is our chance to get it right, not Megan’s.”

Gibbs moved to Knoxville in November 2019 with the father of her child. Boswell came to visit Gibbs in the hospital after the birth of her child around Dec. 9. She said it was the first time she saw Boswell without Evelyn.

Gibbs said Boswell had a "weird" look in her while she was trying to tell the story of how her new baby was born. Gibbs said Boswell kept telling her "I love you" over and over again.

10 total witnesses were called on Thursday, and the jury saw several new pieces of evidence. Those included videos of interviews with Boswell conducted by authorities, messages sent by Boswell to other people and drone footage of her father’s property where Evelyn Boswell’s remains were found.

Boswell said in the interview that she was afraid to call anyone and did not want to know what Wood had done with Evelyn. She told Fraley then that Wood had left when it was near dark and returned when it was dark.

She suggested to police that they go search her father Tommy Boswell’s property, but she said she did not know where Evelyn would be there. While being interviewed, she claimed that she had wrapped Evelyn’s body in a blanket because she “didn’t want her to be cold.”

Through a series of text messages presented for the court, Hawkins describes several message exchanges with Boswell where she tells Hawkins Evelyn is in a variety of places including with Ethan Perry, with Ethan Perry's grandparents and with Megan's mother Angela.

After a message exchange on January 29, 2020, Hawkins said "everything was adding up" and things "felt off." She says Boswell stopped posting pictures of Evelyn and would only speak about her if Hawkins brought her up.
