Chris Wilhoit, the Assistant Special Agent in Charge of Criminal Investigations at the Tennessee Bureau of Investigation’s (TBI) Johnson City Field Office as the first witness called on Tuesday.

In Wilhoit’s interview, Boswell told him her mother, Angela Boswell, came to pick up Evelyn to take her camping with her and her boyfriend in Mendota between Dec. 14-16, 2019. According to Boswell, she had asked Angela to watch Evelyn so she could have a break. Boswell told Wilhoit that she packed up a basket of items for Evelyn, and she handed the child off at her former trailer home.

... Durant extracted information from two cell phones and executed social media search warrant proceeds from Boswell’s Instagram and Facebook accounts.

Goodwin sent the jury from the courtroom before Durant’s testimony continued. Scott objected to the submission of some evidence the state hoped to present in Durant’s testimony. Massengill argued against him and provided Goodwin with a legal precedent.

Goodwin noted that Scott was correct in some respects but ultimately overruled his objection.

The first messages were from December 2019 where she tells a friend's Evelyn's "father" (Ethan Perry) took Evelyn and said they were in a custody fight. On Jan. 13, she tells a friend she lost custody of Evelyn to Perry, claiming he gave her the wrong court date and she showed up at the wrong time. Megan told this friend she hadn't told anyone else what was going on.
On Feb. 18, Megan tells someone Perry wouldn't let her pick Evelyn up and they had court the next morning. She sends this person a photo of Evelyn from when she "saw her last weekend."
Durant testified he was able to determine that photo was from November 2019 because Megan had previously sent it to someone else at that time.
Next they start going over messages Megan sent to her boyfriend at the time, Hunter Wood.
On Dec. 27, 2019, Megan told Wood that Ethan has the baby and she didn't want to bring Evelyn home because "they're not a stable pair right now."
On Feb. 19, 2020, Megan messages Wood over and over again saying she has not clue why he's mad at her and that she's been waiting on her mom for a long tim.

Megan also casually mentions, "I'm also pregnant with your child" so he should allow her to sleep in his truck. Wood never answers

Boswell’s attorney, Gene Scott, made a motion for acquittal of charges and went through the charges for Judge Jim Goodwin.

Goodwin was required to address each of the charges that Scott asked for acquittal of as he made his ruling. He said that the way in which Evelyn was found (upside down in a trash can), Boswell’s behavior on social media, the volumes of evidence, Boswell’s different stories about what happened, the professional opinions of the two expert medical examiners were all contributing factors in his decision.

Goodwin ruled that it was for the jury to make a verdict on all of the counts. He denied Scott’s motion for acquittal.

Assistant District Attorney Amber Massengill delivered her closing argument to the jury on behalf of the prosecution. She asked the jurors to turn to the portion of their booklets that covered the definition of the burden of proof that must be met.

As an example, Massengill held up a large pad of paper with the phrase “Co_ _on Sense” and likened it to Wheel of Fortune. She told jurors they did not have to have every single piece of the puzzle in front of them in order to rest easy with their decision.

Massengill also told the jury that the words Scott used were not evidence, saying he threw out ideas to plant in the jury’s mind. She said Scott used ideas like tin foil hats and SIDS to throw off the jury.

Massengill told the jurors that while defense repeatedly mentioned Hunter Wood's name throughout the trial, no witnesses testified to ever seeing Evelyn with him. She referenced text messages presented in court, showing Wood had asked Boswell where Evelyn was and that he wanted the baby home safely.

Special Agent Marla Gray of the Tennessee Bureau of Investigation testified on Tuesday that Boswell’s fingerprints were found on aluminum foil wrapped around Evelyn’s head, as well as on the inside rim of the trash can where her body was discovered.

“There’s not one piece of DNA that shows someone else did this,” Massengill told the jury. "Megan tossed her (Evelyn) away, literally, with the trash.

Scott brought out a roll of aluminum foil and tore off a piece, saying Boswell’s fingerprint could have been left on it from a previous use and also handled by someone else when wrapped around Evelyn’s head.

Scott told the jury that he wagered every one of their fingerprints were on their own trash cans so that did not prove Boswell killed Evelyn.

Referring back to TBI Special Agent Marla Gray’s testimony about DNA analysis, Scott said male DNA, while not identifiable, was found inside some gloves found in the trash can.

Addressing the prosecution’s claim that Boswell wanted a life without Evelyn to be with Wood, Scott noted that she did not neglect her daughter when dating her ex-boyfriend, Caleb.

Scott also mentioned Ethan Perry, arguing there was no evidence proving Boswell knew Perry was not Evelyn’s biological father. He recalled testimony from friends and witnesses who described Boswell as acting strangely and dissociating — potential signs of grief, he suggested.

He argued that the text messages between Boswell and Wood could be interpreted as a cover-up for both of their involvement.

In regards to the fingerprints, Harper said the most likely person to have handled the foil and bag is the person whose prints were found: Megan Boswell. He reminded the jury that no other fingerprints, including Wood’s, were found on any items, nor was any DNA found that could have potentially tied Wood to Evelyn’s death.

“It was an intentional and knowing murder of a child,” Harper said. “Megan Boswell got rid of Evelyn so that Megan could be Megan. And she enjoyed it. You’ve seen the pictures.”

He vehemently reminded the jury that the foil was tightly wrapped and pressed to Evelyn’s head and the amount found proved the intent behind its use.

“All of this could have been avoided, but Megan Boswell only cares about one person, and that’s Megan Boswell,” Harper said. He added that others, including testifying witnesses, would have willingly cared for Evelyn.

To side with the defense, Harper argued, would require jurors to ignore evidence.

“She sits here in this courtroom guilty as she was back then because she never learned the lesson that we all know: you are responsible for the actions of your own life,” Harper said.

The jury could find Boswell guilty of lesser charges than the ones levied against her. If she’s found guilty on any of the three first-degree murder charges, the jury will also be tasked with deciding her sentence in a second trial that would begin immediately after.

Prosecutors previously informed the court that they were seeking a sentence of life in prison without the possibility of parole.
