Day 3 Witnesses:

1) Bailey Hawkins - a friend of Boswell’s for years and also knew Evelyn (continued testimony).

2) Crystal Crawford - an employee at the Econo Lodge in Kingsport.

The state produced a document showing Boswell checked in and out of the hotel three times in 2019 and once in 2020. The hotel stays were on:
  • Oct. 11-12, 2019
  • Dec. 14-15, 2019
  • Dec. 15-16, 2019
  • Jan. 5-6, 2020
3) Katelyn (Jones) Carter - She and Megan were friends when Jones was in college.

4) Gail Kyte - Megan's foster mother.

5) Sue Whitson - Kyte’s sister, babysitted Evelyn.

6) Erica Stacy - Knows Boswell through her son, Caleb, who dated Boswell in spring 2019.

7) Randy Wood - The father of Boswell’s ex-boyfriend Hunter Wood

8) Ethan Perry - Had dated Megan for years and had previously been thought to be the bio father of Evelyn.

9) Carl Perry - Ethan's grandfather.

10) Lieutenant Michelle Gilliam of the Sullivan County Sheriff’s Office (SCSO)

Boswell's former foster family members testify

Two members of Boswell's former foster family were called to the stand by the prosecution.
Gail Kyte was called first. Boswell lived with her from 2018-2019. When Boswell was seven months pregnant she started living with her.

Kyte testified that Boswell called her on Dec. 22, 2019, because she wanted Kyte to meet Wood. At that time, Boswell said Ethan Perry, Evelyn's alleged father, had half custody.

Kyte's sister, Sue Whitson, also testified. She said she babysat Evelyn in late November or early December.

She testified that Evelyn was dirty when Boswell dropped her off to babysit. She said she smelled of urine and had a dirty face and was wearing dirty clothes.


Boswell didn't immediately pay her, Whitson said.

Text messages show Boswell paid her around Dec. 21, 2019.
"She put money in the mailbox and sped out," Whitson said.

Boswell told her she was upset about Perry taking her to court and hadn't seen Evelyn in days.

  • Williams’ interview with Boswell was entered into evidence and played for the jury.
  • Megan she she did not know where Evelyn was at and claimed she had tried to contact EP to no avail.
  • She also said she had gone to Perry’s grandparents’ home but they weren't home.
  • She was unaware that Perry had gone back to a fort in Louisiana.
  • The next witness was Joseph “Joey” Strickler with the DA's office, and previously Captain of Criminal Investigations at the SCSO when Evelyn went missing.
  • He also interviewed Boswell twice on Feb. 20, 2020.
  • The court entered a recess due to a technical issue.

  • Strickler asked her about her mother’s activities.
  • He asked her if she had one shot to get her baby back, where she would go.
  • Megan told him her mother and her boyfriend had indicated they were taking Evelyn to Mendota.
  • Strickler asked about a family trip before Christmas to Pigeon Forge that Evelyn did not go on.
  • She then described again going over to Perry’s with Evelyn and Wood to drop the child off.

  • Gratz was assigned to be the TBI case agent in the investigation into Evelyn’s disappearance.
  • He visited Megan’s former trailer on Sugar Hollow Rd. on Feb. 19 with SCSO investigator Tracy Haraz.
  • They went to meet with Austin Feller, who testified about the state of Megan’s trailer after she moved out.
  • Gratz said a stroller that had been left behind in a shed near the trailer was found.
  • Prosecutors presented the actual stroller in the courtroom and Gratz positively identified it.
  • Gratz interviewed Megan shortly before midnight on Feb. 19.
  • She told Gratz she last saw Evelyn on Dec. 26 when she was with Perry.
  • Gratz informed her that law enforcement had already spoken with Perry and had “cleared the idea” that Evelyn was in barracks with Perry at an Army fort in Louisiana.
  • Megan told Gratz she believed he still had her.

Massengill produced a Jan. 24, 2020 application for residence at Overlook Apartments. Gratz testified that Boswell and Wood had been considering living there, which led to police interest in the location.

The application stated there would be three occupants. When asked by Gratz who the third person would be, Boswell told him she was pregnant, and that baby would live with them. Gratz asked her why Evelyn would not be living with them. Boswell told him that Wood said he would not live with Evelyn.

Megan said she gave Evelyn to Perry on Christmas Eve, dropping her off before going on a trip with Wood and her family.

She returned on Christmas Day to bring presents to Evelyn at Perry's grandparent's house. ...

Strickler asked why she didn't try to get her daughter from him when she saw her. Megan said she held Evelyn for a minute before her daughter started reaching for Perry, and that was why she didn’t take her back. However, Megan also shared she wanted a break.

According to Blanton, Boswell said in that interview that she had not contacted anyone about Evelyn being gone because of Perry’s custody threats. She also told him that she felt alright leaving Evelyn with Perry for the first time because she needed a break as a mother and that Evelyn was “becoming too much to handle,” Blanton testified.

He described her demeanor during the interview as matter-of-fact but noted she did tear up when he explained that she could be charged with a felony for lying to a federal officer.

Former TBI Agent David Gratz continued testimony.

Gratz said the black residue on the trash can was the result of the TBI lab searching for fingerprints. He also noted that pieces of the trash can had also been removed for analysis and said it did not look exactly like it had the night the child was found.

Next, Massengill provided Gratz with a piece of gum that had been stuck to the inside of the trash can when Evelyn’s remains were recovered. Gratz confirmed it was collected as evidence and sent for analysis.

Gratz identified the outfit Evelyn had been wearing when she was found on March 6, 2020, a fleece onesie with penguins on it. He also noted there was some “insect debris” along with the outfit in the bag. The onesie had several stains on it when Gratz held it up to show the jury.

The next item identified was the gray and white blanket wrapped around Evelyn’s body in the trash can.

In the Feb. 21 interview, Gratz and Price attempted to put a timeline together of when Evelyn was last seen alive using items from a memory box found in Boswell’s possession. As it progressed, both Gratz and Price became more adamant that Boswell was not telling them the full truth and questioned how much she cared for her daughter after going so long without seeing her.

“What did you think you should do, just sit back and wait?” Gratz asked her.

“I mean, yeah,” Boswell said.

Investigators mention they have her Facebook messages and they know Evelyn missed her one-year well visit.

One of the investigators says he doesn't think this is going to end well and Megan nods her head in agreement.

By the end of the interview, Boswell's story is that her mom took Evelyn without permission on or around Dec. 10, 2019.

We brought food out to the Sullivan County Sheriff’s Office when the investigation first started in 2020,” she said. “We’ve tried to keep up with the case over the past several years. But now that the trial’s began, we feel that it’s important to show our support for Evelyn because she doesn’t really have much family doing that right now. So we feel called to be her family and her support during this. So we just wanted to do this out of love and to fight for justice for a little girl that deserves it.”
