Case in court for a plea and sentencing hearing. Plea hearing proceeded. Negotiations placed on the record and confirmed by Defense counsel and defendant. Amended Information filed. Copy given to Defense counsel who waived reading. Defendant pled not guilty.
AS TO AMENDED COUNTS 1 AND 2: Defendant changes his plea to GUILTY. Defendant was advised of constitutional rights and maximum penalties, waived all rights,
pled GUILTY and was examined as to the plea. Plea Questionnaire/Waiver of Rights and Addendum received and filed. Parties stipulate to the complaint as a factual basis for the plea. Defendant further advised that if he is not a US citizen deportation is possible. Court found defendant guilty as charged in the Information and ordered entry of Judgment of Conviction. Pursuant to Wisconsin Statutes section 973.176, the Court advised defendant that as a convicted felon he must submit a DNA sample and may never possess a firearm or ammunition. Court advised defendant that his voting rights are suspended, and may not vote in any election until his civil rights are restored.

AS TO
COUNT 1: The Court sentenced defendant to serve a term of IMPRISONMENT in the Wisconsin State Prisons for
13 YEARS. INITIAL CONFINEMENT of NINE YEARS and EXTENDED SUPERVISION of FOUR YEARS, consecutive to Count 2, credit for 419 days.
Defendant IS NOT eligible for the Challenge Incarceration Program and IS NOT eligible for the Substance Abuse Program.
AS TO
COUNT 2: The Court sentenced defendant to serve a term of IMPRISONMENT in the Wisconsin State Prisons for
SIX YEARS. INITIAL CONFINEMENT of THREE YEARS and EXTENDED SUPERVISION of THREE YEARS, consecutive to Count 1, credit for 0 days.
Defendant IS eligible for the Challenge Incarceration Program and IS eligible for the Substance Abuse Program.
CONDITIONS OF EXTENDED SUPERVISION:
- Complete a parenting class.
- Complete a mental health assessment and follow up with any recommended treatment.
- Complete an AODA assessment and follow up with any recommended treatment.
- Complete an anger management program.
- Complete a cognitive intervention program.
- No use or possession of firearms or dangerous weapons.
- No violent contact with victim.
- No use of corporal punishment of any child in the defendant's care.
- Court set restitution at $3,000.00 payable to the DOJ Crime Victim Compensation Program. Restitution shall be collected by the DOC from the defendant's prison funds while the defendant is in custody. Any remaining balance after release from custody must be paid during the term of extended supervision. Failure to pay may result in a civil judgment.
- Pay DNA surcharge by 11/01/2043. Failure to pay will result in a civil judgment.
- Court waived ALL OTHER MANDATORY AND NON-MANDATORY costs, fees, and surcharges due to indigency.
Defendant advised that he may not use or possess body armor.
Defendant advised of appellate rights.
