Yep. That's why it took so long yesterday and why the judge had to give the modified Allen charge. If she seems in any way to be pushing the jury to reach a verdict, it could be appealed on the grounds that since only the jury can find death, she's pushing for the DP, because hung = life.

One thing I've learned in this retrial is that my state (Florida) does not require a unanimous vote for the DP. If the jury has been unanimous in a finding of guilt for capital murder, only 7 need to vote for DP in the penalty phase...
