R A Hulme J imposed a sentence of imprisonment for 1 year 3 months. The sentence was backdated to the date of the offender’s arrest on 10 June 2015. He received the benefit of
a 25% reduction in sentence for the utilitarian value of his early plea of guilty.
A need arose to exclude Marcus as the principal offender given that he is the twin brother of Vincent....
On 5 August Marcus contacted police and disclosed that he had failed to tell the authorities in the course of their investigations, even after being specifically asked, that he had received two of Ms Scott’s rings and her driver’s licence by mail from Vincent. He sold the jewellery on 9 May and burnt the drivers licence around that time...
The acts of the offender which constitute the offence were his receipt of the two rings and driver’s licence; his failure to reveal this to police when asked; and his subsequent disposal of the rings by selling them and destruction of the driver’s licence.
The Crown conceded that these acts are fairly limited in comparison with other offences of this type... they had little if any impact upon the investigation as they occurred after the arrest of the principal offender.
In the light of all of the circumstances, the offence was assessed as falling towards the lower end of the range of objective seriousness.The Crown accepted that assessment...
