Murder, child abuse trial for Huntsman, Curiel set for February 2017

Tami Huntsman and Gonzalo Curiel waived their right to a preliminary hearing Thursday in their murder, torture and child abuse cases and their trial date was set for Feb. 6, 2017, Deputy District Attorney Steve Somers said.

Judge Pamela Butler previously set a May 23 preliminary hearing date. The pair will now likely not be back in court until Aug. 17. Somers said he hopes the Monterey County District Attorney’s Office will have made a decision by August on whether it will seek the death penalty against Huntsman, who faces special circumstance allegations, including murder with torture and multiple murders, which make her eligible for the death penalty. Curiel does not face the death penalty because he was a minor at the time of the crimes.

While District Attorney Dean Flippo has said he believes the deaths occurred in Monterey County, the abuse of the children did not start in Salinas.



ETA: I read the other article on the children and see that if first began at their home in Southern California. Such a horrible short life for the two that were murdered. Hopefully the surviving sister's life will get much better and she will get the love that she deserves.

This family moved around alot. Sometimes begin evicted and sometimes crashing in the homes of other family and friends. So abuse probably happened in several counties and cities over time during those moves. If I am remembering rightly.

A trial date has been set for February 6, and Somers wants the case to move forward to trial “with all deliberate speed.”

“And the main reason for that is we have children witnesses. We have three children who are going to testify as witnesses and they need to move on with their lives,” Somers said.

One of those witnesses is likely to be a 9-year old girl who was found to be severely abused. Her younger brother and sister were the murder victims.

Judge Pamela Butler removed attorney Kay Duffy-Taylor from the child murder case of Salinas resident Tami Huntsman on Friday.

Duffy-Taylor told Butler she came into the case as the second chair, not the lead counsel. Butler responded by saying there was no guarantee there would ever be two attorneys representing Huntsman.

Before asking Huntsman if she agreed to let Duffy-Taylor go as her lawyer, Butler said she had grave concerns with how the defense had proceeded on Huntsman’s behalf so far, noting numerous inaccuracies and untruths in filings by Duffy-Taylor.

The parties also agreed on Friday it would make sense to wait until after the results of the November election, as there are two ballot measures that have a direct bearing on the case.

Proposition 62 would outlaw the death penalty in California. Huntsman, 40, is facing the death penalty.

Another measure, Proposition 57, would affect Curiel, who was a minor when he allegedly committed the crimes. Prop. 57 would change existing rules that allow prosecutors to decide whether to try juveniles as adults.

New defense in Salinas child murder case asks for more time

A new attorney appointed to represent Tami Huntsman in the child murder and torture case against her has requested about two months to review the case files. (. . .)

This morning, he asked for more time to review the file and said he anticipated being able to complete the review in January.

The matter will return to court on Jan. 11 for setting of the jury trial and further proceedings.

Huntsman faces the death penalty while Curiel, who was a minor at the time of the alleged crimes, does not.

Salinas >> The lawyer for child murder suspect Tami Huntsman said in court Wednesday he hopes to be prepared to agree on a new trial date when the case returns to court in January.

“There’s still a lot of material we need to look through and we still don’t have Keenan counsel,” said Scott Erdbacher, who was appointed as Huntsman’s attorney last month.

The prosecution announced in August it would seek the death penalty against Huntsman. Because Curiel was a minor at the time of the crimes, he faces a life sentence instead of the death penalty. Defendants facing the death penalty get an additional lawyer called Keenan counsel, but Erdbacher is currently Huntsman’s only attorney on the case.

Huntsman and Curiel will be back in court at 8:30 a.m. Jan. 11.

Dec. 11 marked the one-year anniversary of the rescue of an abused young girl in East Quincy, which in turn led to the discovery of her dead siblings in a Redding storage unit.

A child welfare check Dec. 11, 2015, led to the discovery of a young girl locked in a vehicle. The girl weighed about 40 pounds, had broken bones in her shoulder, broken fingers, a dislocated jaw and teeth that were missing or loose.

During an interview last week, Steve Somers, the deputy district attorney from Monterey County who is prosecuting the case, shared some of how the little girl is doing.

“She’s had a number of surgeries to repair her injuries and she’s doing well physically,” Somers said. “And she seems to be in pretty good spirits.”
