I think they are just covering their bases. IF the jury renders a Guilty verdict, they immediately move into the penalty phase. So, they have to be ready to go....

That's ok ...... inmate Anthony can change her demeanor in a NYC second. JB smiled a couple of times when he got the approval of his experts too. Doesn't mean she getting out this charge and on her merry way rv'ing it down interstate 4 to Tampa either.

At this point in time, almost two years later, inmate Anthony knows she can't change attorneys. She knows, but for all of JBs proffering today, she does not have a chance. The mitigation specialist discussions basically says it all, without making a specific statement of how they are proceeding. JB made critical errors today. CM knew it, we knew it. Not rocket science.

Next weeks hearing will be interesting.

I wish I could see Mondays hearing, I have a location shoot and I can't take my computer. Even tho I missed half of todays hearing, I found it on WFTV so I'll be late but not a dollar short! LOL I will be able to see Tues, the DP motions should be interesting to hear the arguments, UNLESS I get called back to the set.

I agree about Baez's arguing today, I saw that Cheney was trying to make up for it, and it didn't work.

You gotta wonder, what Casey is thinking when listening to her attorney get shot down over and over, is it 'gee I should have picked another attorney' OR is it 'I wonder if the commissary is out of pork rinds'. Honestly makes you wonder LOL

Yes me too! I noticed that Jose took some swipes at the SAO's a couple of times and was waiting and watching with abated breathe. But he kept it all in check even with the baiting and he was really trying to bait him all the way.

I know. I remember a time back when Ashton was so mad and it showed, he was going to blow a head gasket, since then he's held it all into check. Thats good, it's not good if he blows up in front of Judge Perry.

interesting about the mitigation expert, J Barrett has spent time in Ohio interviewing relatives, grandparents, a paternal uncle, she has spent time with Casey twice a month helping her to open up regarding sensitive issues... etc

Would that be the molestation charges made against her father, and brother? From what has been said, by many, KC didn't have a problem opening up about this matter. She told many of her male suitors about her being molested by family members. What exactly is KC haven't a problem dealing with? She pretty much is a chatty Cathy from what we have seen, and heard.

I believe one big loss for the defense today, was when JB asking for funding other forensic experts Judge Perry stated that he had just approved funding for Dr. Henry Lee, and that thus one forensic expert was all they needed. But, since the judge in Phil Spector's murder trial ruled that Lee removed something from the scene where actress Lana Clarkson was shot and withheld it from the prosecution, the SA will be free to bring up that fact during his cross examination. Since he will be he only defense forensic expert, and his testimony will easily be called in question …

Couldn't agree more. Dr. Lee has been called into question about many cases, and I'm sure the state is more than welcoming to discrediting Dr. Lee's findings on the stand.

IMHO Judge Perry has an outstanding reputation. His first appearance confirmed why he has an outstanding reputation, and todays hearing solidified that confirmation. He is an outstanding judge. He is fair, and has a no nonsense approach, and definitely likes to keep things moving along (NEXT!), (I’m ready to rule on this). I like this judge, and I now actually believe, if this goes to trial, it will go to trial by the middle of next year.

Yep, this Judge keeps moving the stuff along without cutting corners. I suspect he is equally appreciated by both the defense and prosecuting attorneys( JB probably excluded since this is probably the last high profile case he will ever get LOL). No respectable lawyer likes drawn out cases.

..once it became a DP case, ( and then wasn't, and then was again ), it's simply prudent of the defense to hire a mitigation expert ( happens to be a friend of, at least she comes from de Paul , as does andrea lyon ).

..IF found guilty, the mitigation expert is a key factor in the sentencing phase, and far too many people ( family, extended family, school teachers/coaches etc etc etc ) to interview then-------therefore, it's being done now. it's a huge undertaking, with people to interview all over the city/state/country.

..the defense isn't anticipating a verdict----as you said----just covering the bases.

Has he actually said this? If so, why in God's name is he allowing KC to sit in jail these years. Show the proof so she can go home and LE can get on with catching that baby's murderer. Also if he has proof, why isn't KC screaming out for someone to force JB's hand so they can find her precious baby's murderer? JB is full of it!

That's just crappola that some defense attorneys spew in high profile cases. Think scott peterson's attorney stating that he would present evidence showing that his client is 100% innocent and that someone else killed Laci. No such evidence was ever presented. Just like it won't be in this case.
Jb knows his client is guilty and he knows she will likely be found guilty. He's playing the game but he knows that a mitigation expert will be necessary.
My question is, why do these attorneys think these tactics work? Do they work? Does it help a defendant when the attorney makes outrageous statements they can never back up? Anyone know the answer?

I was just trying to say that even if Judge Perry thinks that she is guilty he will not allow his personal opinion to interfere with his rule of the trial. Does that make sense. I guess there was just a flurry of posts and it got me going...

Just like in the N.Diaz case JB was working when he started kc's. JB made many statements about how he would present the proof of ND's innocence at trial and everyone would be shocked when they heard the truth. ND was found guilty and, after JB presented NOTHING to prove his innocence at trial, ND appealed on the grounds of ineffective assitance of counsel.

Today, before the hearing started, Baez went over to speak to Ashton. Ashton was saying something to Baez and Baez said "can you speak a little louder, I can't hear you". What he meant was that Ashton was not speaking quietly enough. Baez is such a rude fellow. His comment is as unprofessional as you can get.
