2011.01.05 Hearing TES Volunteer Computer Subpoena

The one thing that I did notice was when Judge Perry pointed out to Mason that this other judge was leaving, Mason was not experiencing "hearing problems" one little bit.

He whipped himself around and was remarking before he finished that turn about.
There was probably a good crack that resulted out of his neck with that whip-o-matic turn.


Regarding todays hearing, I missed it and see that some are talking about posting it on youtube.

Has that been done yet, and if so, can someone repost the link, or, please PM it to me? "

Wah :anguish: I was too busy at work today to sneak in the hearing (even worked thru lunch)...wonder why no media has posted it yet??

Muzikman has a type account that takes the longer files - I think he will be posting a link soon for the hearing part. Commentary later.

************Update: If musikman's is overloaded from all the views write me innerofficemail and I will upload it again in smaller chunks. I will save the dvr of it for 48 hours - hope that is long enough! LOL -- as in giggles.

I agree! JB is bluffing big time on his poker hand and is not ready to be called on it, so he is playing for as much time as he possibly can.

JB has no Aces in his hand, only a bunch of Jokers.

I may be way off here, but I thought HHJP was making a joke to CM about Eaton's leaving. He said something to the effect of "what did you do to him?" which I took to mean that HHJP was teasing CM that a prominent DP judge who was observing had (perhaps) left in (perhaps) disgust. If CM actually invited a judge from another circuit to observe and give him pointers, or if he invited him to intimidate HHJP, it obviously didn't have the intended effect.

I wouldn't think even CM would be capricious enough to risk the wrath of the head of the 9th Circuit by yet again trying to have a judge recused. CM and JB are barely afloat on the quagmire of quicksand they've already created and don't look like they've brought life preservers.

I agree Cecybeans - HHJP was obviously amused he was able to pull CM's leg about Judge Eaton leaving. Chances are very strong in my mind that HHJP and Judge Eaton are very well known to each other, and I have heard rumors that HHJP and CM hit the odd golf ball around on the same green. It is entirely possible these three have a similar social group and to me HHJP sounds like a surprisingly light hearted joking sort of person when not in his black robes.

Perhaps the loss of our beloved Judge Strickland at the hands of the defense, combined with our frustration at some of these motions is making us to be unnecessarily paranoid. To me it all looked quite innocent. CM tries to make a lot of :poke: at HHJP so we will think he is one of the good ole boys, and I think HHJP was feeling impish and saw a moment to slide a quick one over on CM. It worked. :laugh:

So can someone explain what they think Judge Eaton was doing there? Like what would the defense be scheming by having him there, if indeed that's what happened?

I'm trying to catch up with this thread, but I'm going to take a guess on this subject. Judge Eaton has an incredible resume' including serving on the Florida Bar Criminal Procedure Rules Committee from 1994 - 2001. He's been instrumental in writing policy and procedure.

Obviously CM invited Judge Eaton to sit in on Monday's hearing for a reason. It may be that CM wants an assessment of HHBP's rulings as JB and CM plan to challange HHBP's court orders. They needed someone who's written policy and procedure there to determine if HHBP has made any procedural errors.
