IF JA does not oppose the motion to vacate and If (although I seriously doubt it) HHJP does grant this motion, will the defense still have to file the reports of their expert witnesses? Because the court vacated the sanction motion, did it also vacate its order about the expert's reports having to be written and turned over within 20 days?

What future impact? This is a man who ran bikini shops and did odd jobs because it took him years to pass the bar for "ethical" reasons (deadbeat dad) and basically had a rather lethargic career mostly handling DUI cases until this fell into his lap.

After which he managed to pull every lowdown, dirty trick available including fighting a gag order to flounce around on Geraldo and to give sleazy press conferences and file "motions" full of unsubstantiated innuendo about witnesses like RK. Not to mention spending two years and a quarter million dollars or more that he and his client used publicity to raise, with almost no discernible work product, so that the state had to pick up the tab for the bulk of what should have clearly been done in 2008. All the while whining and making a travesty out of filing a proper motion and speaking decently or respectfully in court. He had one of the highest rated judges and couldn't wait to try to get him to recuse himself on an inane technicality. He created a situation with two PI's that are so unprofessional their actions may border on the criminal (JL and DC both are in hot water). He is the poster boy of unprofessional behavior in and out of court and has earned himself many well-deserved nicknames on the "world wide web". The fact he has a client that he should have tried to plea out but instead wasted time and resources manufacturing Spaghetti SODDI scenarios so sordid they set a new low by targeting the many dedicated volunteers who searched for the victim has sent a message to the entire world that he wouldn't know how to behave ethically or to manage a career decently if he was given a map. He flushed that detritus himself despite help from many seasoned professionals.

Of all the weak things this defense has said, the fact that CM is acting like JB has any kind of reputation to even save is the most laughable of them all. He may play a lawyer on TV but his actions resemble something off the old Gong Show. And what about ANYTHING the defense has done has shown an iota of "good faith" to the state? Ever.

Cecybeans, this is a powerful and extremely on point post, which I was reading and giving the grave attention and respect it deserves.

Except for the giggle which inadvertently slipped out when you produced this description while in "full rant".....:floorlaugh:

Exactly!! Rules are rules and yet ... they have not even fully complied with the Court order yet ... it is ironical that they are operating as Attorney's to try the evidence in a criminal case that seeks to enforce the law and yet ... are proposing that it does not apply (in their case).

And this all helps ICA's defense ... how?

CASH IT MR. ASHTON and don't fall for this poor pitiful young 40 something BS -- his own behavior has already done his 'career' more harm that the sanctions. That was actually the best thing for his career -- if he can get his head out of his ego long enough to change his ways.

This whole dramatic request is just a ridiculous farce. Ashton doesn't even have any control over whether the check is cashed or not. . . The letter's real message was not about cashing the check!! (Please note that it is made out to "The State of Florida.") How sad that we have to try to decide if this letter is a harbinger of some new grand defense scheme or just the by-product of an aging mind.

Where is Caylee in all of this?
 
This is more of CM's good old boy puffed up double speak. He's stepping up at the last moment to save his buddy Baez from the nasty sanction...the letter is condescending and gives the impression he expects JA to roll over and not oppose him. I think it was CM who gave JB enough rope to hang himself and pretty sure he was JB's greatest cheerleader and encouraged him all the way.
Now he sits back and pulls the my young and inexperienced co-counsel is at fault and for the sake of the case so far, there better not be any repercussions. A thinly veiled threat no doubt, he is playing everyone and I hope HHJP takes that into account because I know he sees CM for what he is.


I also want to say Baez isn't young, 40 while not old is certainly not youthful, he is inexperienced because he couldn't get licensed for years because they just didn't want him practicing law..and finally, I keep reading CM is a hot shot but I have seen nothing to confirm that from the past or from his present debacle in the Casey Anthony case.

Demonstrate leadership.

_IF_ the Defense had now fully complied with the Court's order on the discovery _THEN_ you could consider a break on the sanction and fine.

The WHOLE point of the sanction and fine was that JB had not complied with the Court's order on discovery and did not consider it necessary to seek an extension.

So ... the Defense's priority is to try to retract the sanction and fine ... putting the card before the horse. The priority should be to FULLY satisfy the discovery requirements before this motion should ever be filed and/or considered. If it was retracted then the Defense is off-the-hook and continue the games.

Fully comply with the Court's order on discovery and then ... maybe ... file a motion to reverse. Sheeesh! Priorities. The SA filed the sanction motion because they were not getting compliance. You don't seek relief BEFORE you comply.

ITA ... what is wrong with them ?? It doesn't take a legal expert to understand what the sanctions were about ... jeeze

And hey, in the length of time you took to write a letter to Ashton, Mason, you could have waltzed over to the clerk's office and filed the discovery your sidekick was sanctioned for in the first place ... you know, separately from the motion for reconsideration ??? jeeze :waitasec:

I can't help but notice what is missing from this letter. There's no "I'm sorry," no "I regret my actions.....," and no "throwing myself on the mercy of the court."

All there is? "My buddy's kinda slow, so cut him a break, huh, or he'll never get a date for the prom?"

From what I've seen of CM in action, I'm unimpressed ... he seems to bully and command attention and respect but I'm wondering how well he really knows the law ... seems he's full of dirty tricks for getting over on people though ...
And of course, he's NOT to be trusted ...
And how long has Mason been on the case? Long enough to have advised and schooled "young" inexperienced little Jose ... so I'm just not buying it and I'm sure Ashton isn't either

It reminds me of when I was in elementary school. There was this weird, bed-wetting, loser kid that lived down the block and all the other kids hated him and didn't want to play with him. He was super annoying and just socially inept, even at that young age. His mom used to beg our parents to make us play with him, and give us all sorts of candy, etc if we'd go there and tolerate him. I wonder how that kid would've felt knowing that we were only nice to him because his mommy went behind his back and begged.

I am seriously starting to think there's a sound proof room that was built just for this case for the SA. They go in there, read anything from the defense, and laugh their butts off. Once they've recovered, then they can go into a normal room and get down to business. I don't see how else they get through all of this BUNK!!!

I am with you guys, too. Hello, like there is anything of Jose's career to be saved? Youth and inexperience in the same sentence as Baez? That sounds really wrong to me. Of course, I guess with being so "elderly" like Mason is, I guess Baez does look like a young man, LOL. But still, begging them not to cash because Baez is young and stupid? Give me a break!!!! That check is so cashed already. Be expecting a call from the bank tomorrow, boys...

And is it me or does Baez's signature look like a big, puffy M? What is up with that? Is he hoping the state will think Mason signed it instead?

... likewise, no promise to be more responsive, more collaborative, more cooperative to enable a professional and well executed trial. We are still going to make your job 100 times harder than it needs to be but ... just cut us a break.
 
IMHO - this is CM interpretation that JA is considering it because he mentioned it.
I think it would be a huge mistake if JA did not oppose the motion for reconsideration and oppose dismissing the sanctions as the latest motion was full of lies and convenient twarts. <---- new word, look for it soon in a dictionary near you. There will be a photo of the team.

Well, that's classic Mason for ya ... "remember we spoke about it?" ... and making it sound in the letter like Ashton might agree to it is just Mason's arrogance showing through ... I'm pretty sure Ashton is not going to "take it back" ... lord knows he's had opportunity to ask for Jose to be sanctioned ... and yet waited for a time when it was impacting a very important part of the process ... RECIPROCAL DISCOVERY ...

Seriously, I'm surprised the state hadn't asked that Jose be sanctioned a long time ago ...

Wow it really never ends with the defense huh? Don't cash the check? I hope Ashton went to Amscot to cash it the second he got it!
 
for this to play out - and I would love to see it happen:

I think Mr. Ashton should stand up and read CM's letter in open court and then spend the next 5 minutes talking about how he agrees with CM that JB's inexperience in matters such as this, and his ignorance of rule of discovery (due to his inexperience) that caused hiim to willfully violate the Judge's ruling. JB would have to sit there, with the cameras on him and listen to this and he could not do a thing about it. Mr. Ashton could then magnanimously agree not to cash the check and not contest the order to vacate the sanctions, and he sits down.

HHJP then denies the motion to vacate the sanctions with no further discussion and adjourns for the day. Oh wouldn't that be nice?

When I first read this one I was infuriated. How dare CM do this. I mean "please don't cash the check?" Ummm it's not a fee or a fine, it was ordered reimbursement for taxpayer court costs. That money goes back to the taxpayers, not JA. Something CM is well aware of. "Please don't oppose the motion as an act of good faith, so it doesn't negatively impact poor widdle Jose's career". Ummm wut? Have the discovery orders been fully and completely complied with? Have the prosecutors received all of the expert reports that they have requested over and over and over? if not don;t you think a "good faith gesture" might be a tad premature?

But then I keep thinking about this more and more. It's obvious that CM is playing some extremely dirty pool here. I'm just at a loss to figure out exactly who his target is? I mean yeah he may be playing schoolyard games with JA. But to what end? And yet I can't help noticing that all of this. The motion to reconsider. This incredibly obnoxious letter, all of it is coming from CM exclusively. Notice we have not really heard from JB lately. In fact all we have heard from him was he signed and delivered the required check. So the question becomes, just how much is JB involved in fighting all of this? Is this motion and this letter simply a play by CM to portray his co-council as the incompetent boob that we all pretty much suspect he is, in order to force some judicial action against him? Because no matter how I try and spin it I can't see how they will eek anything of benefit out of the SA's or the Judge with this approach. It seems almost guaranteed to wind them all up and send them rabidly chewing after JB? Doesn't it? So is this whole thing some sort of scheme by CM to drive JB out of the picture quickly and rather brutally?
