2011.01.06 Baez Slapped with Formal Sanction

I honestly don't know. I'm not even aware of who Lamar Lawson is. Each State Attorney's office delegates differently. You make a very valid point and you may be spot on. I just don't know.

FYI:

Lawson Lamar is the State Attorney in the Ninth Judicial Circuit of Florida.

But then I keep thinking about this more and more. It's obvious that CM is playing some extremely dirty pool here. I'm just at a loss to figure out exactly who his target is? I mean yeah he may be playing schoolyard games with JA. But to what end? And yet I can't help noticing that all of this. The motion to reconsider. This incredibly obnoxious letter, all of it is coming from CM exclusively. Notice we have not really heard from JB lately. In fact all we have heard from him was he signed and delivered the required check. So the question becomes, just how much is JB involved in fighting all of this? Is this motion and this letter simply a play by CM to portray his co-council as the incompetent boob that we all pretty much suspect he is, in order to force some judicial action against him? Because no matter how I try and spin it I can't see how they will eek anything of benefit out of the SA's or the Judge with this approach. It seems almost guaranteed to wind them all up and send them rabidly chewing after JB? Doesn't it? So is this whole thing some sort of scheme by CM to drive JB out of the picture quickly and rather brutally?

This is really what is driving me batty - WHY??? What game is CM really playing? I admit, CM has a reason for doing things this way, but darned if I can figure out exactly what motivates him. I'll say I don't believe it is to protect JB's...er, reputation. Too late for that. So what is it?

Trying to figure out why these defense attorneys do what they do, wears me flat out mentally.

Wowser, I had to work from 8am til 10pm tonight & just now saw the CM letter!
I tried to thank all of the posts, but probably skipped some as I'm about to drop, so sorry if I missed some - they were all good & thought provoking.

One question - I am so tired I'm drawing a complete blank - who is Lawon and why does he have any say in CM's request? <-- nevermind, I see the answer upthread -was reading too fast for my own good...

Also, I saw a couple of posts about Baez's sunglasses, lol. I noticed he started wearing these gigantic things about the time he was really, really messing up (well, more than usual) lately...anyone else think he's HIDING behind them?

Gotta catch up on a couple of other threads and then make myself get to bed before midnight. Long day again tomorrow & I won't be able to watch the hearing (

I have been saying for weeks that I personally think plea negotiations have been ongoing...in fact, I am almost convinced of it.

Wonder if Baez was dragging his feet during negotiations (as is his habit) so JA turned up the heat by filing the motion for sanctions...."uhoh Baez...time to....or get off the pot"

Wonder if this letter from CM is not followup to conversation with JA that he would agree to NOT fight Reconsideration Motion so that sanctions would not be on record when case concluded?

Dear Jeff,

Not withstanding the fact that I have filed a Motion for Reconsideration and that we have talked about you considering agreeing to the withdrawing of the contempt, I am enclosing herewith Mr Baez' check made payable to the State of Florida in the amount of $583.73.

I request that if you, in fact are indeed considering not opposing my Motion for Reconsideration and Vacating of the Contempt, that you hold this check pending the final resolution.

As you recall when we talked, I think there is a good faith reason not to oppose the reconsideration, given the potential future impact of the contempt citation on Mr. Baez, his youth and relative experience in these matters. I believe it would be the right thing to do, but that decision is certainly yours and, I guess, Lawson's.

This may have been mentioned already as I am behind a couple of pages, but did anyone notice that CM refers to JB as MR. Baez.... and he calls Lamar Lawson just plain old LAWSON????

I think it is showtime and CM is indicating to JA that he has won.

If the Defense comply with HHJP's order for Reciprocal Discovery then the cause is lost ... everyone will see that the Defense have nothing and most experts are not testifying.

CM alluded to this in his controversial motion ... why? Why did he mix the sanctions debacle with some snippets on expert testimony?

CM was signalling that they are indeed backed into a corner and need to save face. CM is signalling to HHJP that they are toast and to JA ... you win.

As a result CM wants the sanction reversed and the check not cashed because the Defense need to talk deal with the SA.

Time is up!! As George Constanza said in Seinfeld, this is a signal JA, this is a signal! We need to talk.
