OK, number one....this is something he did early on!!
I posted it for us; because, like Mr. Ashton told the judge we need to measure how egregious Baez's overall lack of respect and refusal to recognize the laws and rules from the very beginning of the case.
He has pulled some doozies.......but certain things are just amazing to me that he has gotten by with. This ranks right up there. What the problem is , if you listen to what he answers the reporter, there are only two possibilities
a) he lied
b) he honestly does not know or understand the rules, at all
NEITHER are acceptable. Until if as and when he does know and can abide by the rules .....well don't make me say it.:furious:
I am so thankful for Mr. Hornsby, he is a walking Florida law library. When I have a question I combine the words with his name, and two seconds later, just like magic, there he is on my screen quoting the rule to refer to. I don't expect Jose Baez to know everything, but I damn straight expect him to look it up when he doesn't!!!! If a reporter has the information at his or her fingertips, book and page....so does he.
IMO, the rebuke from the judge has been a long time coming. Gram..if you are looking down on me....I'll say what you taught me to when I have NOTHING ladylike to respond....."Hmmmmm, that is interesting!"
This video clip is from August of 2009, Richard Hornsby; Florida defense expert, tells that if you have anything that may of evidenciary value, you are NOT allowed to alter it, change it or conceal it in any way. You have to put the prosecution on notice that you have it, so they can object to it. That is your duty.
The reporter asked him about the ethics.....
that this was one hundred percent ethical would be the last thing that would come to my mind, Mr. Hornsby responded to Baez having said "The defense has acted one hundred percent ethically."
"Ethics are decided by the Florida bar, NOT the attorney himself", Richard Hornsby explained.
I was originally relieved when Andrea and later Cheney joined the team, believing that maybe now Jose Baez will be shown the way, but it just hasn't worked. All I know is that folks are writing the appeal drafts as we sit here this morning.
I bet Anne Finnell would be floored if she knew who she was really dealing with. I think I will make her a disk or two to send to her office. The truths of what has went on in the case are pretty far removed from how she was, in her words "Persuaded to join the team".
I agree with all of you that have concerns that it is painfully obvious that Mr. Mason is well past his prime and is not up to defending this case. Thank you to the nurses we have here, kaRN, for your medical opinions and those of you who have elderly parents who recognize the tell tale signs. Will someone capable and healthy, mentally, emotionally intelligent and physically capable on the defense team please step up?
