2011.01.06 Baez Slapped with Formal Sanction

I've pondered this issue, because the CM of the past that I have seen videos of is heads and shoulder above the CM that we see on the Casey defense team. I am constantly shocked by how clueless he seems on things... how he seems to feed more into Baez's job of bumbling along, than being this well honed lawyer that should know to snap Baez into professional place. It is like the 2 are playing keystone cops of lawyering, and it is not funny anymore... it's painful and angering to watch.

CM has now taken on several other high profile cases. I wonder if his hearing/comprehension problems extend to these courtrooms also or are his problems unique to Caylee's case.:waitasec:

Yes, yes he did take items that belonged to Caylee from the Anthony home in 2008
He did eventually hand the items over to the FBI

Outside the Orange County Courthouse Baez was on the defensive a single document among more than 1,000 released on Thursday. It is a laundry list of items his spokeswoman said they took from the Anthony home in September, such as books, baby toys, puzzle pieces and Spiderman toothbrush.

According to a defense team spokeswoman, Anthony's lead attorney, Jose Baez, voluntarily contacted the FBI the following day and turned over all of the items he had in his possession in case law enforcement needed them.

"I think the defense did the ethical thing, and this should be proof of it," Baez said.

Baez removes items in September 2008 , does not inform the Prosecution or local LE, then...months later..voluntarily hands it over to the FBI....and says it was the ethical thing to do and his actions prove it....:waitasec: months later?

Could that not be construed or considered as Concealment or possible obstruction?
Baez must have had some reason(s) to believe the items were of some use or value..if not why bother taking it in the first place.

I didn't trust Baez before and trust him even less now...if he did do this and not inform the state, he's obstructing justice, isn't he? He can be jailed...He just does his own thing, he interpets the law arsebackwards...He's one attorney I'd never hire...JMHO

OK, number one....this is something he did early on!!
I posted it for us; because, like Mr. Ashton told the judge we need to measure how egregious Baez's overall lack of respect and refusal to recognize the laws and rules from the very beginning of the case.

He has pulled some doozies.......but certain things are just amazing to me that he has gotten by with. This ranks right up there. What the problem is , if you listen to what he answers the reporter, there are only two possibilities

a) he lied
b) he honestly does not know or understand the rules, at all


NEITHER are acceptable. Until if as and when he does know and can abide by the rules .....well don't make me say it.:furious:

I am so thankful for Mr. Hornsby, he is a walking Florida law library. When I have a question I combine the words with his name, and two seconds later, just like magic, there he is on my screen quoting the rule to refer to. I don't expect Jose Baez to know everything, but I damn straight expect him to look it up when he doesn't!!!! If a reporter has the information at his or her fingertips, book and page....so does he.

IMO, the rebuke from the judge has been a long time coming. Gram..if you are looking down on me....I'll say what you taught me to when I have NOTHING ladylike to respond....."Hmmmmm, that is interesting!"


This video clip is from August of 2009, Richard Hornsby; Florida defense expert, tells that if you have anything that may of evidenciary value, you are NOT allowed to alter it, change it or conceal it in any way. You have to put the prosecution on notice that you have it, so they can object to it. That is your duty.
The reporter asked him about the ethics.....
that this was one hundred percent ethical would be the last thing that would come to my mind, Mr. Hornsby responded to Baez having said "The defense has acted one hundred percent ethically."

"Ethics are decided by the Florida bar, NOT the attorney himself", Richard Hornsby explained.

I was originally relieved when Andrea and later Cheney joined the team, believing that maybe now Jose Baez will be shown the way, but it just hasn't worked. All I know is that folks are writing the appeal drafts as we sit here this morning.

I bet Anne Finnell would be floored if she knew who she was really dealing with. I think I will make her a disk or two to send to her office. The truths of what has went on in the case are pretty far removed from how she was, in her words "Persuaded to join the team".

I agree with all of you that have concerns that it is painfully obvious that Mr. Mason is well past his prime and is not up to defending this case. Thank you to the nurses we have here, kaRN, for your medical opinions and those of you who have elderly parents who recognize the tell tale signs. Will someone capable and healthy, mentally, emotionally intelligent and physically capable on the defense team please step up?

I do believe when this trial is over with, Baez may not be practing law for very long after that. It appears he hasn't learned a thing since he was held back for those 8 years. I appears he's broken many rules and I don't understand why everyone is looking the other way. Bringing contraband into this prisoner is one of those broken rules.

Can he continue to out and out lie about evidence or will there be a stop to it! JMHO

My money is on a Baez "file" being compiled for future action(s).

Interesting. He does appear to be stumbling and bumbling lost in that court room. He is not like this when leaving and looking for microphones. This seems to be a case of selective surroundings dementia. Or, Act II Scene One.

It will be interesting if we could see him in action in these other cases. I have sometimes wondered if his "bumbling" is an act just for this case. If he indeed is suffering some sort of dementia, he really should step out of all these cases. It isn't fair to the clients or the courts. :twocents:
 
CM is not demented and far from it. As a defense attorney you do what works to get what you need. The judge knows what he is up to. When your client is clearly guilty it calls for drastic measures. jmo

Yea, but at what COST TO YOUR CAREER??

I've seen a few defense attorneys blunder a case, but never a TEAM of them representing a single client. It's mindboggling, I tell ya.

CM has nothing to lose, he's retiring. JB has nothing to lose he's a defense attorney who will go on record as sticking his neck way out for his client regardless of what the cost is to him personally. If you've broken the law you're not interested in an attorney who "goes by the book", you want a risk taker who is willing to do just about anything to get you off or a lighter sentence. You would want someone who is willing to "fly by the seat of their pants". Although JB has not always used the best judgment look at what he has had to work with. They're defense attorneys with a difficult client. Need I say more. lol jmo

P.S. - I've known a few attorneys who have done far worse than JB and gotten into trouble for it but are still practicing law. They have to do something really, really bad to get tossed.

I didn't know this either. According to the report he took toys and a toothbrush for dna testing. Since this was before Caylee was found, this leads me to believe he was assuming DC was going to find the body in his expedition.

Wasn't this around the time JB was also soliciting Jesse Grund's DNA? :waitasec:

So now I wonder just what WERE the defense attorneys laughing and joking about at the sidebar? I thought it was most likely that they were off the hook. But now, was it all just a big show for the peanut gallery (us?).

You know, if you get a parking ticket and you tell the judge you "didn't know" you were in a red zone we all know what the judge would say: IGNORANCE OF THE LAW IS NO EXCUSE. PAY THE FINE.

Mason came on board because Jose "I'll do all the work" Baez convinced him to lend his name and reputation to the case. Mason did not realize at that point that he was aligning himself with a totally incompetent nincompoop. He expected to lounge around at the defense table, wave at the cameras, drop a few sound bites and bon mots at press conferences, and collect the admiration of the legal community and the good citizens of Florida, plus cash in on a couple Brownie points.

What he has found, however, is that he had aligned himself with a "lawyer" who struggles to rise to the level of a neophyte nincompoop, who refuses to obey the orders of the court, who conducts himself like a celebrity, and who is basically ignorant of the law. Baez can't buy a clue as to the inner workings of the court or finesse points in dealing with the prosecution. Mason now finds himself - reluctantly - cleaning up Baez's messes, and being laughed at alongside Baez. He's being blamed for nincompoopness-by-association.

It is no longer fun for Mason. He doesn't want to be there, and it shows in his demeanor and his legal arguments as sloppiness. If he can figure a way to gracefully bow out, he will. But as long as he's stuck we will continue to see this petulant, pouting, I'm-an-old-geezer-acting character.

When this case is over and done with, I think JB is going to have a lot more to worry about than a sanction (or two) by HHMP. :yes:

It would be great if one of our members who's local were to sit in the courtroom in one of the other cases just once to see how CM presents himself in that case compared to the Anthony case.
