2011.01.06 Baez Slapped with Formal Sanction

Yes ... they either do it now or do it later. How much face do they want to lose. Each day is only going to get worse.

Time to plea ... or plea just before the verdict ... if they can survive that long?

As much as I would love, no WANT to really see ALL of them squirm in their seats, George and Cindy chomp their gum madly, Casey twitch her ears and fiddle with her hair, scribble angry little notes and shake her empty head; along with Baez bounce and click his pen, they don't have the fortitude to go to trial and wait for the jury to walk out ~

I want to know what really happened to Caylee.

But, I do NOT want to see the defense belittle and disregard this tiny, innocent child anymore than she already has been at ALL of their hands ~

Let her rest in peace ~

The Anthony's, and all involved, attorneys and otherwise, will eventually get their's in the end.

Caylee's life was short, but, maybe their's will be long. And, maybe not.
But, be assured, it will be miserable.
In the end, they all will be accountable, and it won't be from a jury of their peers.
 
Is this possibly a matter of CM not wanting a sanction on co-counsel on a case that CM is involved with? A pride factor for CM. Nothing to do with CM's concern for JB or his reputation or FL Bar record or anything like that. All about CM and HIS reputation!

Mason is probably just sick of hearing Baez cry all week. :whiteflag:

I'm starting to get an uneasy feeling about all of this. If we've learned anything, it's that things are not always what they seem. I'd also like to know what's really up...or am I just suffering from an acute case of paranoia?

Pocket deal or JB & CM are suffering more of those ideations of grandeur.

If they are talking plea it better be DP or at least LWOP and 1st degree murder. I really don't want a plea in this case. Caylee deserves justice and for it to be seen. Logically, financially, etc -- I can see why this might be happening but I am still back at emotionally and I am not ready to see this happen. How dare they cost the state all this money to stop a payday short of a candy bar.

It reminds me of when I was in elementary school. There was this weird, bed-wetting, loser kid that lived down the block and all the other kids hated him and didn't want to play with him. He was super annoying and just socially inept, even at that young age. His mom used to beg our parents to make us play with him, and give us all sorts of candy, etc if we'd go there and tolerate him. I wonder how that kid would've felt knowing that we were only nice to him because his mommy went behind his back and begged.

This may have been mentioned already as I am behind a couple of pages, but did anyone notice that CM refers to JB as MR. Baez.... and he calls Lamar Lawson just plain old LAWSON????

Oh that lack of respect is even worse than you think, Snaz, Lawson is his first name. Mr. Lawson Lamar deserves much respect for his long career fighting crime in Central Florida. He was the second in command of the State Attorney's office back in the late 70's and early 80's under then State Attorney Robert Eagan. Then he was elected Sheriff of Orange County and after many successful years as Sheriff, he was elected State Attorney. Very well-respected in this area and definitely deserves a lot more respect than CM is giving him. Just my :twocents:
 
I agree with you but I think these talks may have already been taking place prior to the flurry of motions to throw out pretty much all evidence. I personally felt that flurry was done in an effort to push KC into realizing that the courts were not going to disallow much. I think Baez and Mason fully expected HHJP to deny the motions..

Couple of points to ponder....

Why did JA finally take the initiative to file for sanctions when Baez has not been timely in the past?

Perhaps because SA was under the impression they were negotiating and Baez was footdragging again so they turned up the heat.

Why did HHJP address the sanction motion first but then put off ruling on any of the other motions?

Because he is very aware that negotiations were taking place? (see link below)

Exactly what WAS Baez insinuating when he kept patting his pocket while looking JA in the eye at the last hearing?

Because he was trying to get message to JA, based on what KC was writing, that KC was now "ripe" for considering a plea after hearing HHJP play hardball?

Why did HHJP suddenly call Mason to a sidebar, WITHOUT SA, only to return and suddenly conclude the hearing?

Because he wanted to ask Mason whether his client now saw the seriousness of the evidence against her?

WHY HAS BAEZ BEEN SITTING WITH HIS TAIL TUCKED BETWEEN HIS LEGS SAYING AND DOING NOTHING?

Because Mason told him to sit down, shut up, and let him handle this fiasco from now on if he wants any semblence of a career left?

And lastly, so why DID Mason take on another death penalty case today?

Because he is anticipating more free time in the future?

I think this Reciprocal Discovery motion is the straw that breaks the Defense's back ... in that the SODDI Kronking is over ... the TES searcher thing is unravelling ... the experts have little of merit to help ICA ... etc.

The shocker trial by ambush is ... there is nothing! They are down to excluding evidence, attacking credibility, questioning methods and procedures ... pesky little things that are not going to save ICA in the grand scheme.

Also, CM is fronting $$$ for this ... since JB has nothing and ... DP cases cost a fortune. It is all those expenses that the JAC will not reimburse that is killing them. Trivial stuff.

I think CM pulled the plug, not willing to fund this charade much longer, thus the whining about the SA and the JAC and funds. They'd love to take this to the Trial of the Century BUT they are cutoff both in their expenses as well as expert testimony.

They are pulling the plug on ICA because it is no longer in their interests to continue through a slog these next few months ... only to lose. Cut your losses and move on to some clients they can both make money on. ICA is a lose-lose for them both.
 
Exactly. His big wish was that JA would be the nice guy he is and then the taxpayers would be screaming how JA wasted tax payer money on foolish motions and they(CM &JB) would both appear on TruTV and JVM after Fridays hearing to smear the state.

This really does make a lot of sense if the defense team weren't all bound by their arrogance and super-size egos.

But let's say it's true. Why do you think they're being so nasty if they want this to plea out. They're kind of at the mercy of the SA and not the other way around, seems to me.

I'm not saying they have to grovel (although it wouldn't hurt, given who their client is) but why go the opposite direction in their demeanor?

Are they really surprised that the TES searcher thing and the Kronk thing are (or will be) a big bunch of nothing? A bust?

They signed on for reciprocal discovery a long time ago. What did they think would happen? How did they think this would go? I am mystified.

And I agree with you... MR. Lamar deserves much more respect than CM has given him... And more than Cindy gave him, too!!! (Still not sure why CA would come up with that hairbrained idea that LL had some kind of personal agenda by charging her evil spawn with murder and going for the death penalty!)
 
Very Interesting ~ And, this could be why Baez has been relatively "silent", not his usual overbearing self.

He has been media shy.

They know that the money is gone - that the state is gonna shut down their cash flow at any minute, and they either don't want to, or can't afford to pay for a horse with a broken leg.

Mason is the only one with any money, and he isn't going to put good money out after bad.

Today {?} it was announced that he has taken on another child killer case.

They all are tired and "over this" case, and want out as gracefully as they can go ~

Yes, Lamar Lawson is the one behind Ashton calling the shots - and, I think that whoever said a plea has been in the making, or, at least approached by team Baez and Cheney is spot on.

We've seen how Casey looks in court, and, its obvious, that Cindy has taken a real downward spiral the last few times that we've seen her.

All very interesting facts and I appreciate you've done a lot of work on this - but I'm going to have to sleep on this.

I'm just not feeling the "love" here.

Mason sure was doing some schmoozing in that letter to JA! lol Since the check is made out to the "State of Florida", I am hoping JA doesn't have any other choice but to cash it and I'm also speculating it will be returned for NSF! lol

I think JA should read Cecybeans fabulous post, verbatim, in court tomorrow to HHJP. Remind HHJP what JB has done since he first took this case.

All this talk of a plea deal makes me nervous and also a little sick to my stomach. We've come this far folks, let's pray it goes to trial so we can actually SEE justice for Caylee!

If the Defense comply with HHJP's order for Reciprocal Discovery then the cause is lost ... everyone will see that the Defense have nothing and most experts are not testifying.

As a result CM wants the sanction reversed and the check not cashed because the Defense need to talk deal with the SA.

Wow. Excellent observations. I'm glad some of you can think straight after riding this spinning merry-go-round that keeps picking up speed.

In re. the bold: I buy that 100%. Above all else, I do believe CM wants to save face and I further believe their experts have absolutely nothing that will help them.

In re. the bold: I can give that a 65% shot. Maybe a little better... I'm not convinced though. We are talking about some very stubborn people that would need to go along with this idea: Casey, JB, and Cindy. Yes, I know that only Casey would have to agree, but I don't think JB or Cindy would favor a plea, even if they could get the SA to agree to terms. And they are the 2 people that have the most influence over Casey. I think Casey and Cindy really, really believe they can strike a jury who will find reasonable doubt. They've never once before succumbed to pressure no matter how bad the evidence and public perception. No matter who tried to convince them otherwise. I haven't seen anything to make me think that has changed. As far as JB, I dunno. Maybe. I'm sure he is tired of the public bashing and realizes that even his fellow defense attorneys in the Orlando legal community have turned away from even trying to defend him. He's tired and broke. However, I still thinks he craves his Perry Mason moment. Whether he still really believes he can pull it off, is another thing.

However, my biggest hurdle with believing this is the defense's plan is that I don't trust CM even a teeny, tiny little bit. Call me paranoid. I just do not. On the other hand, I believe him to be selfish enough to go this route to avoid such a public humiliation as that trial will prove to be for the defense. To bolster your hypothesis though, it is a good explanation for why the discovery still has not been turned over, even after sanctions were imposed.

All that said, I'm not so sure this late in the game that the SA would even consider it. A lot of money has already been spent, time invested and let's face it - I never call any case a "slam dunk", but this is about as close as you can get, imo. I'm not sure what the State has to gain at this late date. All the tough work has been done. And believe me, they may be attorneys, but they are human, too. They are emotionally invested.

Cyberborg...................this makes a whole lot of sense! It's clear for all to see that the defense has no defense, and even the long list of expert witnesses is fast dwindling. The defense has been toast for a long time now. I can see both JB and CM wanting this case to be done and over. Maybe that's why CM agreed to take the new murder case.
