2011.01.25 Defense Requests More Time to Submit Expert Reports

If Ms belich is a defense witness, then perhaps she wouldn't be allowed in the courtroom until she testifies. If she were last on the defense's list of witnesses called or was cancelled at the end of the defense case, it would be very difficult for her to report on Mr Baez's daily antics. Perhaps the defense doesen't want Kathi B sitting in court watching them work?

It appears from the SA's motion, they want to hear the good reasons for adding witnesses past the deadline.

I-4 is clear. No Accidents. But it is slow moving as you get closer to downtown...but then again the deadline was 35mins ago..

I'm guessing the SA isn't putting up with the nonsense anymore and is opening up with both barrels. from here on out expect them to move to strike ANYTHING that is outside the deadlines or crosses the line. They have been very accommodating and forgiving for almost 3 years now. No more. I think JB is gonna need some new undies.

My guess and I am moving over to the witness thread is this is about Maya Derkovic and the expose Kathi did - the interview taped and posted we all watched a while back when we were discussing how truthful we thought Maya was.

Would these two correspond to Dr's Logan and Rodriguez's areas of expertise and anticipated testimony? And if so then yeah it would be a pretty clear sign that the SA has no intention now of deposing them, and as a result they will have nothing to offer at the hearings. No experts = no Frye hearing? Yes/no?

Doesn't Orlando have couriers or hasn't Baez ever heard of them? Don't they just have to be hand delivered by not by a lawyer since for one of them they were planning on sending someone's legal assistant?

It's 5:19pm and so far NOTHING(at least not on WESH) about the Defense filing Expert Wtiness Reports by the 4pm Deadline..

Nada from WESH...only talked about 2 of the "new" witnesses..the inmate friends and the 2 new response motions from the Prosecution.

IMO NO...but it hasn't been reported that they filed the reports by the 4pm deadline..I am sure WESH would have reported it if they got any info of a filing

In the past, the defense simply 'gave' some reports to the SA without actually (and properly) filing them with the court. I think it was Bock and someone, but I can't recall exactly. Maybe that's what happened again today? Would they be so [unusual] as to do that again or have they just outright given nothing?

I stand by my earlier assertion that JB et al have no intention of calling these experts and just want Perry to be the bad guy by disallowing their testimony.

HAL’S NOTE: They did not. The state attorney’s office says everything that was due by today is in, my colleague Anthony Colarossi reports.

You would think they would have AT LEAST filed a notice of compliance. We're going to see the reports anyway. Someone will file a request to the SA to see them. And the SA will be required by law to hand them over.
