2011.01.25 Defense Requests More Time to Submit Expert Reports

  • #241
Wonder what Judge Perry learned from his phone call that caused him to allow such a lengthy extension?

Things that make you go, "Hmmmm....."

Baez never gave them the official go-ahead to do the testing.
Baez never checked to see that the JAC paid the lab.
The lab was extra busy, but not too busy to test the bath salts.

Hmmmmmm.....

I too would like to know...did this stand up to a Frye Hearing? Is touch DNA an acceptable form of DNA testing? With the Frye hearings on for those dates, March 23-25, how can this get in in time if the state has objections??? Although, I truly doubt anything will come of it...JMHO

Supplemental Motion to Compel Forensic Discovery: LKB requests and responses - I bring this up because 1)the defense seemed more professional and courteous then and 2) the sniffer machine is mentioned and 3) Ms.Lowe's second deposition is considered - I didn't read the first one, yet, has anyone?
http://www.wftv.com/pdf/23621537/detail.html page 22 - defense asks for information about sniffer machines - Oak Ridge Lab says no sniffer machine was used Gas Chromatograph Mass Spectrometer was used.
Page 45 : Ms Lowe has been asked to examine the contents of the Anthony's vacuum cleaners.

I keep checking the news thread expecting to find a motion from JB for Reconsideration of Order Denying Motion for More Time.

How do you catch a Unique Opportunity?

You 'neak up on it at a conference.

In all seriousness, though, I honestly think the defense WANTS Perry to prohibit their experts from testifying, because the experts are either a)not on board, or b)totally agree with the state's experts' findings. JB keeps dropping the ball on this so that Perry will make the decision for him. As long as it's Perry doing the thwarting, they have an appeal issue, can whine in public about casey not getting a fair trial WHEN she's convicted, and don't have to actually prove that they have nothing, kwim?

And I believe that is exactly why HHJP is contacting these experts on his own. He is aware of the game and is playing so Caylee wins!!!!

I agree, I think they want the judge to look like the bad guy here as well, but the judge has placed that ball squarely in the defense's court.
JB can whine all he wants to and you are right, he will take every opportunity to do so, but he has been given extension after extension, warning after warning and each time he has come back with "We do not anticipate any problems." And yet...
He really has a lot of nerve throwing out the word "fair" to this judge, who has bent over backwards to facilitate the defense.
I think the way HHJBP kept saying "I don't understand why you can't simply pick up a phone and call these people," tells me he is onto this latest ruse.
These few weeks have been very interesting!

All I can say is these experts that implicate themselves in high profile cases rarely do it for altruistic reasons alone.

I would love to hear the reasons why these particular experts have signed on to this case. Was it to self-promote, to help out, out of boredom, looking for a new and interesting challenge, or to get to the truth?

Whatever the reasons, I believe they new what they were signing on to from the beginning! If WE could all see what a nignog Baez was from the start, wouldn't you think that very experienced and reputable experts (who have worked with the best lawyers in the business) couldn't see through Baez from the start.

Perhaps they were willing to work with the defense while LKB was still involved, but now that she is out, they really can't work with JB...He just doesn't understand what they are saying.

They knew that they were on the witness list for this case. They knew that they had responsibilities in regards to their research and findings. They know the ropes of being an expert witness. They could do this in their sleep. So why is there a problem with the reports? I would suggest that there isn't and that JB is telling more stories and claiming disorganization as an excuse to delay discovery...Why...to be petty and childish!
Well we all knew why CM signed on. For *fun*. Hows that going for ya CM?
At the time I read that, I felt a red hot rage course through me & I am not prone to feeling rage. But that came across as sick in my book. Of course MOO and not affiliated with WS opinions.

I am not sure that he can file that. Technically his motion for more time was granted "This one last time", it just wasn't for as much time as he would have liked. But can he appeal or ask for reconsideration of his own favorable ruling?

you're right, faefrost. I didn't word it correctly, I just meant that I expect to see him filing something requesting still more time so that he can have one last chance to ambush these experts at the conference.

Am I wrong in thinking that no professional expert or lab is going to be particularly thrilled by this sort of presentation to the courts concerning themselves and their work? I mean does it simply reflect poorly on not just the lawyers but also to some degree the lab itself when they start getting phone calls from the presiding judge wondering where the heck the DNA tests that were supposed to be done in November are? And what do you mean March?

In much the same way I am sure that Kathy Reich is a skilled consummate professional. The very implication that she is away enjoying herself on a Tahitian vacation while she has open or incomplete case work for JB has got to be horrifyingly offensive to her. As is the implication that she would blow off or ignore a client, or even worse choose to do a slower or half 🤬🤬🤬'ed job for an indigent client. I can't see her reacting favorably to anything from JB or CM at this point. Does anyone think that she would have scheduled such a trip if she had had any contact from the defense or inkling that her services were still needed? I am guessing that the last she heard from them was 2 years ago.

I think after the phone call from the judge, and all of the implications from JB that Dr. Logan will want to use JB as part of a demonstration on forensically examining a victim of heavy trauma.

It will be interesting if JB does manage to herd all of these experts into a back room at the hotel. It wouldn't surprise me if they opt to beat the holy h377 out of him, duct tape him and drop him down the hotel trash chute. "What happens at AAFS stays at AAFS" :trout:

This post should have a warning:great::floorlaugh::great:

Hey all! First, the trial is right around the corner. I just have to keep telling myself that.:fence: Second, I thought the tweets to KR were funny but I felt sorry for her too. Yet another victim of Baez and company.
