Finally!!! HHJP is talking time limits! Should have done this 2 weeks ago after he saw how long and drawn out the DT would be taking. We'd be long done with Frye hearings and HHJP probably would have already given his orders too.

Yes, exactly, which is why I am thinking the fact that they cannot find articles and experts is a problem the prosecution. I am not seeing that this guy is not an expert as a smackdown for the prosecution. It just seems like a big waste of time but may be demonstrating that there is no scientific opinion/general acceptance of this stuff.

It is a waste of time. The jury at trial will decided weather Dr. Vass and if the science prooves anything. This is new science just born, it doesn't mean the science is wrong, just new.

Speaking of which, and I may get into trouble here, but as a hard working (well, except for hearing days!), single mom of 3po (me, not JW), I wonder what exactly does JW do to support herself so that she can hang out at hearings all day?? Sign me up for that job. I mean really, anyone have an answer cause I'm curious.

More on line here, I do feel for DS and I do feel for any of the DT experts, this one too. They've been asked to come in and make a square shape fit into a round one. Ain't gonna work.

I wonder if the judge is going to give equal time. He's going to need to put a limit on the DT or they will go until 5:00 with the SA not having a chance to even speak.

I don't know how the judge can fairly apply this rule.

IMO it's not really new. The testing device and the way it measures has been around a long long time. It's simply a fact that there are not body farms and a multitude of institutions and professionals studying decomposition.

What I would like to know, and maybe joypath can answer this accurately, is HOW can anyone dispute methodolgy without actually performing the same testing themselves.

methodology = how one performs a "test"


like add 1 cup of sugar to 1 cup of H2O and heat to boiling, simmer X minutes = "simple syrup" for cooking

The issue in this case is: X as in the # of minutes will distort the "sweetness" or efficacy of the simple syrup. BUT the distortion is somewhat subjective based on the user/taster.....and that's the FRYE issue NOT the cooking

Now the discussion should be on the interpretation of the data!
