YES...and was shown the remains at the funeral home BEFORE she agreed to come on and before she signed any non-disclosure.

ICA looks like she is about to stand up, scream and just admit that she did it. I think this questioning and testimony is causing her much frushtration. She is board and can't fathom weeks and weeks of this. Ha Ha! Like so many of us she would like a really nice, soothing, large cocktail with a little colorful umbrella for stirring. Too bad...she can't have one but...we sure can!!

DSimms: there were three articles, i believe in your affidavit you prepared, reference to articles give your opinion: how long a unknown plant has existed if the person never looks at the plant and only looks at it in a picture.

Witness: no, I have never come across that.

(my note: )so DSimms has this expert to say she read a lot of articles and there was nothing in them that says the prosecution can have an expert that looked at the root in a picture and say he knows anything about it.

They are saying that is Frye because they feel the person who will say they are an expert could not have that conclusion because there is no technique(there's the frye!)that would determine that kind of evidence or be reliable as any kind of evidence that can be found by "just looking at the picture."

IMHO: they are saying the SA witness will give testimony about the hair based on him/her only seeing it in a picture. Why not say that, instead of bringing your own "experts" to say that is not something you can do? Or is not science.

What has happened here I believe is Kronk destroyed evidence when he found the body. No matter what someone did when they did not follow the roots back to the plant that was actually growing through the bag.

There is no way that root can be used as evidence of time the body was there because root of different plants grow at different rates and soil and sun and water would effect that too.
