JB: what is an unverified alert? when evaluating a dog you must look at the handler. the only way we can evaluate a dog is by double blind testing. the only reliable way and method which is highly questionalble based on the facts and you must rely on the integrity of the handler.

dect. melich all testify there was only one car, this has been admitted into evidence, each one drew up for the court there was only one car that was analyzed. in deputy forgies report he only testifies to one car.

Judge's error rate? OMG how tactless can this man be?
HHJP looks like he is listening just out of politeness and protocol at this point, but he knows more science and certainly more law than JB..

Actually, it was JA who brought up a judges error rate. In explaining how an error rate pertains to methodology vs a person, JA said that would be like determining a Judge's error rate by how many times he overrules the prosecution. JA IMO is a funny guy.

OK isn't this supposed to be an argument on whether or not the actual "tests" are usable/admissible. Not the results, right?

JB - Would bet the house that per Forgey's grand jury testimony there was only one car. His honor can look at that in-camera.

JB - Det Forgey credibility attacked on several grounds -

Several detectives said only one car - Forgey said only one car in report but in testimony said a blue car and JB says he would 'bet the house' in Grand jury testimony would only be one car in it.

Says Det Forgey never mentions any false positives in any report

JB: would bet the farm that the grand jury testimony only reports one car. he is what is odd about deputy forgey...he went the second day and never documented his unverified alert where he hit in the back yard. what is that? that calls into question all the records. how reliable are those non blind double testing records.

positive/negatives= error rates. Mr. Baez is very big on this. Now attacking credibility of dog handlers. Sheesh.
