I know that both the state and defense are allowed to dismiss a juror without citing any particular reason, and some dismissals for cause. Does anyone know how many dismissals each side has?

Ok so now he's FOR the DP?

Can you convict the attorneys with the defendant? Just asking...
:giggle:

But seriously...
:waiting:

AF: a person had been found guilty and you are deciding between lwop or dp, this is no excuses no defenses pre meditated murder...that is not an automatic death sentince...can you follow that. death is not always appropriate.

yes.

AF: the law has to prove aggravating circumstances, beyond a reasonable doubt. would you hold the state to that burden?

yes.

AF: if you found no agg circumstances are found, then the dp would never be appropriate. Does that make sense?

(I HATE that she asks, "does that make sense?" )

AF: mitagating circumstances are those circumatances that would make a juror think that LWOP would be best and beyond a reasonable doubt does not have to be proven. Does that make sense?

yes.

AF: if a mitigating circumstance would you concider it whether life was better over dp.

yes

AF: a person's charactor or background that might make LWOP the right sentince. okay.

okay.

AF: you have to go with four, it is a weighing process about what you think is important. okay?

okay

AF: everything about you, your common sense...bring to bear...

yes

AF: What I am getting to here...(oh, thank you!) ????? Police man....

a LE was killed and DP was right.

AF: (speaks like she is asleep. I am sorry. her voice is meant to take you into a lull. it just is, and I can't stand it. I give me a time out NOW)

AND: I do not like this POT juror.

I thought they weren't allowed to bring up case specific things??

I keep checking back to see where we're at and I can't believe how the end of jury selection seems so far away. I feel for HJBP because I know how badly he wants this case to move along in a timely fashion.
I also just wanted to take a second and thank all of the amazing posters for tirelessly narrating what is going on. I have a 6 month old and another one on the way and it is impossible for me to watch everything. You are all so wonderful! Thank you!!

AF just asked specifically about detah of child and death penalty being appropriate - surprised no objection

  • #1,429
Wow! AF - "In this case, a child has been killed"

Asking if he could not be swayed by specifics and follow the law in making his decision.

  • #1,430
She just said a child has been "killed"

AF: Considering the fact that a child *HAS BEEN KILLED*......

Well, I was referring to my brother & his wife that were murdered, but I wonder if HHJP will attend, if it comes to that?

Sorry, I thought you meant for this case. Hard to keep up sometimes. I'm not sure about JP. I know sometimes lawyers attend but I think JB will move on after the trial.

When jb questioned about lying on jurior #1.....Isn't it illegal to lie in court???? I thought of that while mowing...why it be okay to lie in court???? Isn't that contempt??????

She gets softer and softer, okay? And she slows down in each word...and gets even softer at the end of each sentence.

OKAY?

I believe they get 10 "strikes" per side. I'm not sure if they strike someone now, if it counts as one. I think the strikes won't come in until the next round.

I literally started getting a migraine earlier....it is still coming on....I tried to blame it on barometric pressure as I get migraines during certain weather events....but after visiting the weather channel....

The weather here is clear and so it must be attributed to the absolute nonsense and mental exhaustion of trying to listen to JB string together a coherent thought process.

After waiting three years for this trial, I am not sure I can listen to JB or CM or DS all day, day after day...... may need to rely on forum threads.

Here we are at AF and the mitigating circumstances
