Opening statement of Baez said Caylee accidently drowned in the family pool on June 16, 2008 and now Mason said there is no evidence of that happening. Can we all say back peddling.

No evidence entered into the record. I believe he implied the defense may have that later. More reason for the judge to deny this motion, and say, "let's see that evidence then."

But opening statements are not evidence, are they? The state didn't present any evidence saying she drowned accidentally and the defense hasn't brought anything in the way of evidence yet, so he's right, really.
