It would be an appeal issue. HHJP knew months ago this is what JB was trying to get away with. That's why he made the court order. He knew this would happen.

If the State asks this guy something NOT in his report, he can opine on the spot because he is an expert witness, yet the defense can't ask him to opine unless the opinion is already in the expert's files??? Motion for mistrial.

I really think it's him who the sequestration violation is about. His TV interviews have been outrageous. I've been working my fingers to the bone transcribing them lol.

I'm confused. I thought the video was to show the tape "could have" covered the nose and mouth, not that it actually was positioned that way. This is the issue this doctor is supposed to rebut.

Exactly right. And the witness who presented the video said so himself on the stand. The video represented how the duct tape MIGHT have moved during decomp. But Dr. R probably isn't watching all this testimony, so he's probably not aware of that. Again, not his fault if he misspeaks...JB is asking the questions here, and he only contacted Dr. R 2 days ago?

I'm so pleased that JB is embarrassed, but that the judge is protecting CA. We do not want JB's malpractice to infect this trial. I loved JB's body language when he walked back to the defense table. He was stomping like a teenager!!!
