granted ‘use’ immunity? yes

statute of limitations past? yes

proper procedure would have been to proffer this and we would have dealt with this outside the jury

I am always impressed that the Judge and Lawyers (SA) can remember all these cases and site the numbers etc from memory.

HHJP pointing out the 5th amendment was invoked only because the witness recorded a conversation without permission; didn't have anything to do with the testimony about the searches. The proper procedure would be to proffer this outside the presence of the jury. It would be up to the state to decide if they wanted to go into details about what use immunity they gave the witness.

If he weren't trying to pull such a dirty trick, if CM had a top hat and cane, I'd expect him to break out in a rendition of "Puttin' on the Ritz"

LDB stated that she and CM discussed this prior to the witness' testimony and CM was not supposed to put him in a position to invoke (if I heard correctly) All respect I had for CM is out the window now. Sigh....

Dumb question but couldn't the SAs have offered JJ immunity from prosecution in exchange for his testimony and so he wouldn't have to plead the 5th?

LOL @ Perry thinking the witness was on cross with CM and LBD correcting him...Even the judge doesn't realize these are Defense own witnesses they are badgering.

Seriously, TES and Tim Miller does nothing but perform these searches out of the goodness of their hearts and look what this DT is doing to them? This is awful. I believe this is why alot of people in this country "Don't want to get involved" So sad

Sadly, as the saying goes, "No good deed goes unpunished".

Wow! CM is furious - hates that his actions were even questioned! LDB standing strong on her objection.

CM saying he did not intend to illicite the 5th ammendment rights of the witness, but had to because witness was changing his testimony.

LDB arguing that CM agreed he would NOT bring the taping incident up.

50/50 here, imo.

Well really he didnt bring up the taping,he brought up the threat of felony charges by the SA's office. Not specific charges.
