I think she was collecting monthly income from some of her properties. Her cash flow was much higher than his. So he did not have to pay her much child support because of that disparity.

I don't understand this. They were not divorced. Why would they be all her properties and her rental income?

I think one sticking point for her regarding the child suppport was that allegedly, and from what I understand, was that Simon was not going to contribute towards the private school fees.

I have absolutely not forgotten this. I think it probably won't come up. Very easy to just say it was the children
(personally, even if it was one of the kids I have some questions, but they're not relevant to the case)
It probably was her kids yes, and I know it's not relevant to the case. It's pretty disturbing though...

Police seize her phone and it is wiped remotely twice afterwards.

I hope the jury is paying attention!

It seems she wiped it the 3rd time while they were searching her premises. The police enacted their search warrant and seized her phone on the 5th. (as per a previous link of mine) She must have done it before they took her phone, it was done "locally".

Pretty brazen behaviour. imo

Then wiped it the fourth time remotely, when it was in the possession of the police.

This is nutty. Stage 4 Ovarian Cancer ? Quite a dramatic play on her part.

And looking up brain cancer. Don't wish for what you don't want.

Was it reported that the patient said stomach issues became a problem on the night of the lunch (Sat)? Then on the following day, there were no obvious stomach issues for the gas station stop and drive to the cancelled pilot lesson. Yet, on the Monday morning, after the patient returns to the hospital from an absence, the nurse is able to record five events on a “bowel chart” for her patient. Quite unusual.

"Ms Cespon says she asked about her recent history, and says Erin told her she began to feel ill on the night of July 29, after the lunch."

It probably was her kids yes, and I know it's not relevant to the case. It's pretty disturbing though...

I think I read from somewhere that the death wall was mainly containing references to "Lord of the Rngs", I think.

Patterson ‘emotional, crying’ after medics said kids would need hospital assessment​

Registered nurse Mairim Cespon, who oversaw Patterson’s care at Leongatha Hospital on 31 July, 2023, has taken the stand.

The court heard Cespon saw Patterson in her peripheral vision, while she was tending to Heather Wilkinson, when the mother-of-two first arrived at the hospital.

When Patterson later returned to the hospital, Cespon said she settled her into a cubicle and Dr Chris Webster came into chat to Patterson.

In the presence of Cespon, Dr Webster mentioned to Patterson that her children needed to be medically reviewed because they ate part of the meal.

“At that point, Erin became emotional, she was crying,” Cespon said.

“She was asking if it was really necessary for them to be assessed because they didn’t have symptoms. She said she didn’t want them to be panicked or stressed.”

Cespon said Dr Webster told Patterson:”You don’t want to wait for them to get worst”.

Patterson bowel chart shown to court​

The court has been shown a bowel chart written while Patterson was at Leongatha Hospital on 31 July, 2023.

The five entries on the chart included the following details:

10am - amount “M” - consistency “L”

10:04am - amount “M” - consistency “L”

10:06am - amount “S” - consistency “L”

10:25 - amount “M” - consistency “L”

11:50am - amount “S” - consistency “L”


The court heard that “M” meant medium, “S” small, and “L” liquid.

The court heard Cespon also made further notes about Patterson’s hospital stay, including an entry at 10:10am that Patterson “went to toilet x 3, still watery, white and yellow in colour but patient said it is a stool”.

The notes also indicated that Patterson has spoken to police to obtain the leftovers from her home and that she had given a pain score of “7/10”.

Cespon explained that the pain score is subjective and Patterson explained it was a “cramp-like pain and that when she opens her bowels it settles a bit, but everytime she feels like going to the toilet it goes back up.

Cespon said Patterson told her she had felt sick on the evening of 29 July, then had diarrhoea all day on Sunday 30 July.

“She was distressed and emotional including the thought of her kids (having to go to hospital),” Cespon said.

“She was saying she feels unwell, that she has this pain, that she has been having these loose bowel motions, (and) she was emotional about feeling unwell.”

The Asian mushroom investigation​

Troy Schonknecht, a public health officer for Monash City Council, has taken the stand.

The court has heard Schonecht was tasked with launching an investigation into mushrooms sold in Asian grocers in the Oakleigh area.

Schonecht said he was told by police they were interested in dried mushrooms in clear, plain packaging and the likely purchase date was in April, 2023.

The mushrooms of interest were described as “sliced” and like “shitake”. mushrooms.

He said he then used the council’s database to narrow down Asian grocers or similar in the area, before visiting each one in person.

The court was then shown a report compiled by Schonecht, which identified five businesses in Oakleigh, four in Clayton, and four in Mount Waverley that were selling dried mushrooms.

Public health officer’s report findings shown to court​

The court has been shown Troy Schonecht’s findings in relation to his Asian grocer mushroom investigation.

In the report’s concluding statement, the questions posed by the investigation and his answers were as follows:

1. Has there been any changes in supplier since April?

All premises visited and that were identified as selling fresh (initially) or dried mushrooms had not changed their supplier since April or in 2023.

I asked further if they had anyone attend the premises trying to (wholesale) sell them mushrooms for the intention of on-selling and they all responded that they had not had anyone trying to sell mushrooms.

2. Are there any products that do not have proper labels? If any that may be collected/dehydrated locally?

Only (one store) Golden Grocery was repackaging product and applying their own label. It was identified during the investigation the product was too large and were whole dried mushrooms as opposed to the sliced dried mushroom. Any non-compliances identified have been referred to the Area Officer to follow up with proprietor. No products were identified to be local or manufactured in Australia. All dried products were imported.

3. Are any suppliers’ local producers?

All dried mushroom products investigated were imported and importer/supplier details identified.

Asian grocer mushrooms pulled from shelves amid investigation​

The defence have commenced cross-examination of public health officer Troy Schonecht.

Schonecht was shown a series of mushrooms sold at Golden Grocery, which were in clear plain packaging.

The court previously heard Golden Grocery was the only store identified to be repackaging mushrooms, which the store attributed to the manufacturer sending large packages which were broken into smaller portion to meet customer demand.

The defence put it to Schonecht that the packaging identified at Golden Grocery matched the description initially provided by Patterson.

He confirmed that was correct.

Under questioning, he also confirmed the shitake mushrooms from Golden Grocery were removed from sale for a period of time because of they had similarities to the description they had received from Patterson.

We saw video of her on Sunday and she did not appear to be that delimitated.

I think because she inherited all of the properties from mother and grandmother and some money, but she and Simon were separated. So those properties were mostly in her name. I don't think they had a final distribution of properties yet. Which might go to motive? IIRC

I think the properties are more involved than this. I haven't quite sorted it out yet, but I think it goes something like this.

Her grandmother lived in South Africa, and there was a battle over her will. Erin received $2M from that.
Her mother had a property in Eden which was sold upon her death, and presumably the money was divided between Erin and her sister.
Simon and Erin bought their 1st property in Perth, when he worked there.
The Perth property was sold when they moved back to Victoria.
A house was bought in Korumburra.
A rear unit was bought in Vic (in maybe a suburb/town starting with G, I forget where but I remember the photos - maybe they were 'for sale' photos and they are back in the threads somewhere)
Erin had her house built on Gibson Street, Leongatha.

Then in 2021, Erin told Simon she wanted his name off 2 properties (Gibson Street and Lyons Street), and put on one property (Nason Street).

So now we've seen her texts showing the animosity she had been brewing against her inlaws was almost as bad as what she felt toward Simon. Still flabbergasting that she chose to invite them to a lunch of death cap mushrooms, but at least now we see how she really felt about them and sort of see her motive.

But what about the other couple? They were just Simon's aunt and uncle, godly people, saints almost! And from what we've seen so far, she had never had any sort of negative interaction with them at all. There has never been any mention of them being involved in "adjudicating" their separation. She couldn't possibly have had anything at all against these good people.

I guess it has to be she just wanted to hurt Simon as much as possible, but that explanation still doesn't work very well for me. I wonder what her thinking was there. I wonder how long before she invited them did she decide to invite them. Maybe it was spur of the moment just when she saw them at church and she didn't even think through what inviting them meant at all.

Not quite, as the grandmother inheritance was way back in about 2006 for about $2M.

Also the separation in 2015 was not official from what I understand as was the cause of a dispute when Simon declared them separated on one of his tax returns some years later (When was that?) which impacted child support arrangements.

Semantics though. In Victoria you are considered separated (for divorce purposes) if you have lived apart for at least 12 months.

Simon's accountant was right to put separated on his tax return in 2022.

My guess is she just wanted to punish them for hurting her, not taking her side.

I suspect she had been doing this type of thing for a long time - subtly contaminating the food and drinks of people she disliked to feel powerful over them. Except this time it wasn’t subtle at all.

The texts are a useful insight for motive, but I’m also struck by how banal they are really. I’m sure thousands of people say similarly bitter things about their family every day, with zero intention to ever harm or murder them. Family disputes are common, and she sounds rational and sane. It’s unsettling that there were so few ‘tells’ of what she would (allegedly) go on to do.

Clearly on July 30 at the BP she appeared perfectly well , not using the bathroom, purchasing food and happy for a 3 hour round trip to take her son to flying lessons

The fact she had two large inheritances it does make you wonder why she couldn’t just get on with her life. I know money doesn’t buy you happiness but it certainly can buy you security.

I think I heard she did give large chunks of her inheritance away (loans?). Was this just a power trip too or did it show she once had a generous side to her?

I have wondering that as well since the beginning.

It’s really mind boggling she drew them into this. Cannot see the motive and she made her crime more risky by harming more people who also came from a different household (if only Don and Gail had become sick with food poising symptoms, the lunch at Erin’s house wouldn’t have been flagged immediately as they would have shared all their meals).

I’ve been waiting for this.

“Mr Fox-Henry told the jury he found a Google Chrome history which revealed a search for www.inaturalist.org/observations and 'some numbers' just after 7.23pm on May 28, 2022.
The court heard the URL page was titled: 'Death cap mushroom from Melbourne Vic Australia' and included information the sighting was made by an Inaturalist user at Bricker Reserve, Moorabbin at 2.36pm on May 18.

The jury previously heard iNaturalist is an app that was used by experts to identify and upload the location of death caps at Outtrim and Loch.


The officer said an iNaturalist search also occurred on Bing at 7.20pm on May 28, 2022, which he said was the time the 'URL was generated on that device'.

Mr Fox-Henry said he also found another search term for iNaturalist via Bing on the Edge browser at 7.21pm on May 28, 2022.
The internet search for death caps was discovered at 7.23pm less than two minutes after the last search was discovered for iNaturalist, the jury heard.

If she had any chance of convincing a single juror that it might just be a case of mushroom mistaken identity, this ends it IMO. The prosecution have done an excellent job.

I'm keen to hear why Gail's phone records are being used. I'm thinking there may be some texts exchanged or some Google searches, not necessarily phone calls that will come into play.
Maybe the messages that Simon alluded to, that in the end stressed Gail out so much that she stopped reading the messages.

I know!! Money doesn't buy happiness but it does give freedom. She had so many choices and options given her wealth. She could have taken the children on lots of travels, paid for a good therapist and moved on with her life. The children also weren't toddlers, it was on the horizon that the family and Simon wouldn't be as involved in their lives anymore within the next decade.
Why oh why did she choose this path??
