‘They were getting sicker’: When Don and Gail got transferred to a city hospital​

After a slight delay caused by a power outage in Morwell, the trial has restarted in courtroom number 4 in Morwell.

Defence barrister Colin Mandy, SC, has resumed his questioning of Erin Patterson by asking her about her knowledge of her in-laws, Don and Gail Patterson’s health and hospital stay.

Patterson said Simon had told her Don and Gail Patterson were at Korumburra Hospital on Sunday, July 30, 2023, the day after the lunch.

“It was Monday morning. I think it was the conversation with Matthew where he told me he was at Dandenong Hospital with Don. I think that’s the first time I knew that,” she said.

“I learnt on Tuesday afternoon that they had been moved to the Austin.”

Patterson said it was clear to her that there had been a progression of symptoms to require a move from a country hospital to a city hospital to another city hospital.

“It seemed likely to me that they were getting sicker,” she said.

Those were lies too, Erin says.

"I had disposed of it a few days earlier in the context of thinking that maybe mushrooms that I'd foraged, or the meal I'd prepared, was responsible for making people sick," she says.

"And then on the Saturday, Detective Eppingstall told me that Gail and Heather had passed away, and, was this stupid kneejerk reaction to just dig deeper and keep lying.

"I was just scared, but I shouldn't have done it."

Patterson’s defence lawyer, Colin Mandy SC, is questioning his client.

He asks about her understanding of how unwell her lunch guests were after the beef wellington meal.

Patterson confirms her evidence that the day after the lunch - 30 July 2023 - Simon told her his parents, Don and Gail, were at Korumburra hospital.

She says on Monday morning - two days after the lunch - Simon’s brother told her Don was at Dandenong hospital. She says:

"I think that’s the first time I knew that.
Patterson says on Tuesday afternoon she was told her relatives had been transferred to the Austin hospital.

She says it was “clear” to her there had been a “progression of symptoms” due to the hospital transfers.

From that it seemed likely to me they were getting sicker.

I doubt that she wanted to look after Simon, after she said that she wanted to change her phone number, as she had concerns about him...
I think in the beginning she might have thought this would bring them closer, as he'd need to lean on someone in his grief.

But why she thought he'd want to lean into the person that served them their last meal, I don't get that.

Remember on Monday morning she called him at 7 am, asked him to drive her to the hospital----he said essentially Get Lost.

It must have hit him hard that she served them their last meal, and triggered his own memories of his mystery illness.

A tax invoice was shown to the court. It is the receipt for Erin Patterson’s dehydrator.

Ms Patterson said the company that she purchased it from required her name and address and admitted she purchased it, likely with a card.

The accused told police after the lunch that she had never dehydrated food, did not own a dehydrator, and did not forage for mushrooms.

Ms Patterson said “it was” a lie.

“I had disposed of it (the dehydrator) a few days earlier in the context of thinking mushrooms I’d foraged for the meal I had made was responsible for making people sick,” she told the court.

“It was a stupid knee-jerk reaction to dig deeper and keep lying.

“I was just scared.”

Why wasn't she frantically calling the hospital and family to get updates? The blame game seems strong in this one. "Nobody told me" - they were desperately worried about their loved ones, perhaps? Maybe Erin could have been proactive and followed up? :(

It's a possibility oIf course, but I think she would have done the research into the effects of ingesting Death Caps.

Mr Mandy returns to the police search on August 5 when she provided them her phone.
Erin says she wasn’t allowed to use her phone other than to send a text to another mum related to her daughter’s ballet.
She said detectives told her they wanted to interview her, and Erin says she was allowed to search online for a lawyer and make a call.
Mr Mandy now shows her a tax invoice for the Sunbeam Dehydrator.
Erin says she likely paid for it with her credit card because it was more than $200.
She says she took photos of the dehydrator on the day she bought it, sharing them with Facebook friends.

Erin Patterson, wearing a simple paisley shirt with black pants, is in the witness box for a fourth consecutive day of providing evidence.

Erin Patterson’s defence lawyer Colin Mandy, SC, is asking about a police search on August 5, 2023.

On that day, while police were searching her residence, Patterson specified that her mobile phone was customarily placed on a table within her sight or on an ottoman.

She stated that approximately one hour into the search, she requested and was granted permission to communicate with another “ballet mum” concerning her daughter’s ballet schedule.

At one point, Detective Leading Senior Constable Stephen Eppingstall told Patterson he’d like to take her to Wonthaggi for an interview.

She was told she would ring a lawyer or Google for a lawyer if she didn’t have one.

He left the room so she could do that.

He asks her a series of questions, starting with her account regarding the lunch, and Erin responds with yes or no answers.

Erin says all six beef Wellingtons she cooked were the same and there was just one batch of mushrooms cooked up.

She says that each of the five beef Wellingtons that were plated up were also the same.

She says she didn't lie about buying mushrooms from an Asian grocer in the Oakleigh area in April, 2023.

She says she didn't lie about those mushrooms being used in the meal.

She says she didn't lie about being sick after the lunch.

Erin says she was reluctant to have the children admitted at hospital, but changed her mind once it was explained to her.

She is asked whether she has ever intentionally picked death cap mushrooms or included them in a meal, and she says no.
