Asked about how Patterson described her relationship with Simon, Cripps says she described Simon as “controlling” and “emotionally abusive”:



Cripps is asked what Patterson said about the lunch on 29 July 2023:



Cripps says Patterson said she wanted to discuss a medical issue at the lunch.

Cripps says Patterson told her she found the beef wellington recipe in a RecipeTin[Eats] cookbook.

She says Patterson said she “wanted to do something new and special”.

She says Patterson said she bought pre-sliced mushrooms from Woolworths and dried mushrooms from an Asian grocer.

Cripps recalls Patterson telling her that mushrooms from an Asian grocer would “add a nice flavour to the beef wellington”.

Patterson said the children had eaten the leftovers of the lunch but she had scraped off the mushrooms for them, she says.

Controlling and emotionally abusive. Geez. Quite serious allegations no? IMO

Cripps says she did not. She says Patterson was on her phone when she asked the question.



Right, wheels probably turning in her mind trying to come up with the story. Sounds like she didn't even mutter anything in response ... did nobody teach this woman basic manners?

Also re: her claims about Simon. Those are big claims to make. I'm guessing that's the reason why Simon didn't get the kids at the time. If proven untrue, and I don't know at this point in time, is that not defamation?

Ms Stafford runs through the chronology of Ms Cripps' account of events, and has her confirm several points.

The child support application, the Patterson's childrens' dislike of mushrooms but acceptance of pastry and the exact timing of Erin's reported diarrhoea are again recapped.

Stafford asks Cripps about her conversation with Simon Patterson at Monash medical centre on 1 August 2023.

Cripps agrees that Simon told her Patterson was aware his relatives were unwell after the lunch but not how ill they were.

Defence presses on when Erin found out about illness of other victims​

Ms Cripps tells the court that Erin first found out that Simon's parents were first unwell on the Monday following the lunch.

Two conversations between Erin and Simon Patterson on the Sunday and Monday following the lunch are raised by the defence.

Ms Stafford suggests to Ms Cripps that Simon did not tell Erin how sick his parents, aunt and uncle were on the Sunday.

"You can suggest it, but I'm certain that it happened," Ms Cripps says.

"It's possible but I'm certain that I remember that correctly."

More testimony about the lunch​

Ms Cripps' earlier testimony that Erin told her she had not eaten her entire meal is raised.

"Can I suggest that here and now you're not very clear about what Erin said?" Ms Stafford says.

"About how much she ate? That's correct," Ms Cripps replies.
After being pressed by the defence, Ms Cripps agrees that Erin communicated she had eaten "some" of the lunch.

Ms Stafford rereads Ms Cripps' testimony that Erin told her that each lunch guest helped themselves to the lunch.

Cripps' visit to Erin Patterson's home​

The defence raises the visit Ms Cripps made to Erin Patterson's home.

Ms Cripps confirms that Erin had become upset when discussing that she would lose her support network.

She again confirms that when asked directly whether she picked the mushrooms for the lunch, Erin did not answer the question.

We jump forward to a phone conversation Ms Cripps had with Erin on August 4.

"You asked Erin if she had heard any updates regarding how people were ... and Erin told you that she hadn't been told anything and she was finding this distressing," Ms Stafford suggests.

"Yes," Ms Cripps.

At this time, Ms Cripps says she was aware that Heather Wilkinson had died, but did not inform Erin due to welfare concerns, and says "it wasn't my place to".

Erin 'dished up all the plates': Witness

Ms Cripps said Erin told her she had invited the lunch guests over because “she had something she wanted to discuss with them”.
“It was a medical issue, I believe,” she told the jury.
She said Erin wanted to cook a “new and special” meal for them from a cookbook.
The court heard Erin told Ms Cripps she had bought pre-sliced mushrooms from Woolworths and mushrooms from an Asian grocer.
“She said that she read that the (mushrooms from the Asian grocer) would add a nice flavour to the beef wellington,” Ms Cripps said.
When asked by Crown prosecutor Sarah Lenthall how much Erin ate of her beef wellington, she replied: “Half.”
“I don’t believe she ate it all,” she added.
Ms Cripps said Erin told her she had “dished up all the plates”, before the lunch guests chose their own plates and she took the one that was left over.
She told the court Erin said she started to feel unwell that evening when she had to drop her son’s friend home.
The court heard she then took her son to the supermarket, but stayed in the car because she thought she may have an accident.
Ms Cripps said Erin said she hoped sitting down in the car would provide a “cork”.
Later, Justice Christopher Beale asked the witness whether “cork” was the exact word used by the accused.
“Yes,” Ms Cripps replied.

Erin mentioned changing her phone number to child protection worker​

Ms Cripps confirms that during this visit, Erin had mentioned she was scared about "security and privacy" and was considering changing her phone number.

That concludes questions from the defence.

The prosecution is back up to cross-examine the witness.

They try to bring the conversation back to how much Erin ate at the lunch, but there is an objection from the defence.

The jury and witness are led out as they discuss it.

BBM. Okay this confirms my theory- she color-coded the plates so that she'd know which ones were the poisoned portions. Gray=poisoned, deathly pallor. Colorful=non-poisoned, full of life.

So, she was talking about changing her phone number for privacy and security before it was even a police investigation and before the media were bothering her....but after child welfare, Dept Health, etc had been scrutinising her.

Doing a factory reset on the same day she drove there, maybe to wipe out her GPS movements? Didn't realise paying on eftpos and CCTV would be problematic with that plan?

Erin’s defence lawyer, Sophie Stafford, is cross-examining Cripps.

Stafford says Cripps is “not very clear” on what Patterson said about how much she ate at the lunch in July 2023. Cripps agrees.

Stafford says:

Is it your recollection that firstly she didn’t eat her entire portion?
Cripps says:

Yes.


She indicated she didn’t eat it all.
Cripps agrees Patterson said she ate “some” of the beef wellington lunch.

Under cross-examination, Cripps says Patterson told her she put two plates aside from the lunch for her children to eat.

Stafford questions Cripps on her timeline about when Patterson knew the parents of her estranged husband, Simon, were unwell after the lunch.

Stafford says Cripps has provided evidence about Patterson recalling two conversations with Simon to her on the Sunday and Monday after the lunch.

Regarding the conversation on Sunday, Stafford tells Cripps that Patterson “did not tell you that Simon had told her that the others were unwell at that time”.

Cripps replies:

You can suggest it but I’m certain.
