Given Samantha Azzopardi’s own very significant history of lying and fraud, resulting in a psychiatrist in her own trial/sentencing diagnosing her with pseudoligica fantastica, nothing she says about anything can be believed. The news media must be getting desperate, finding little scraps of anything to report on until the suppression orders get lifted (we all know how desperate they are to report on all that juicy stuff) it is highly reckless to give Azzopardi avenues to attention like this, not good for her mental health at all.

[bbm]

that's a new term for me! that would be a good name for a band!

Not only is Xanthe Mallett a forensic anthropologist, she is also an Associate Professor and the Coordinator of the Bachelor of Criminology programs in the School of Humanities and Social Science. She would be more qualified than most to have an opinion on personality types - opinion and diagnosis are very different things.
I actually heard a more recent interview that she did on Erin’s case and she was far more circumspect, so she perhaps has self-corrected.

I dare say the police would have well and truly looked into this

can they get access without a warrant? here they would need a warrant and show the court probable cause that there is evidence of a crime on the phone (I think)

Doubtful - unless friends willingly gave up their phones to police. They would need a warrant, IMO.

I don't think they can look at the contents of Ali's phone without probable cause and a warrant.

Can the police take your phone as evidence?

Under the Evidence Act 2008, Victoria Police are allowed to seize certain items if there are reasonable grounds to believe that:

  • An offence has occurred
  • The items seized constitute material evidence to prove the commission of the serious offence
  • The person in possession of the item being seized is implicated in the crime
In addition to the clauses setting out when police may lawfully seize your property, the Evidence Act 2008 also dictates that police are not permitted to retain the seized articles for longer than is reasonably necessary to complete their investigations, or to create a copy of it.

With mobile phone footage becoming an increasingly common type of evidence in criminal investigations, this means that phones represent a large (and growing) portion of seized items.

If you’re only the witness to a crime and not a suspect, police will only hold onto your phone long enough to create a copy of the data on it before handing it back. In many cases, it can be a matter of minutes as police make a copy of photos or videos on-the-spot.

It’s a different story when it comes to individuals who are suspected of a criminal offence, however.

If it’s believed that there is material (that’s to say, important) evidence on your phone or that your phone itself is a potential piece of evidence, police may retain your phone for longer:

  • If the phone was stolen, it is unlikely to be returned
  • If the phone itself is a piece of evidence rather than just the data on it, it may be retained for the duration of the investigation
  • If police are only interested in what’s on the phone, it is likely to be returned after the relevant data is copied

Does anyone know if it's pay by card only at the tip, or can you pay cash, I wonder?

EP has paid by cash.

I hope LE checked for any possible crimes around the prior dates.

So according to line 1 (4 October) she's taken a 240 litre bin there in the same vehicle. Not sure how she managed that in that small car. Ordinarily you'd use a trailer. Maybe lay it across the back seat.

Are those all EP's transactions? There isn't one there for after the lunch on 29th July 2023 when she apparently got rid of cardboard and a bin bag. The 1st five transactions are a different rego number.

Yes, I noticed that.

Maybe she had 2 cars?

Apparently that tip trip was not allowed into evidence. Which is very puzzling! It seems like good evidence for establishing her timeline for that day.

Maybe one is the rego of a small box trailer

Ellery obviously didn't look at it...
No because I don’t open Tik Tok links 🔗 due to the high probability of being doxed.

Is that list (in your previous post) part of the evidence? I haven't seen it before.
Did the court show previous visits - with a different rego number - for some reason? I was not aware that happened (if it did).
