What's the most bald faced lie EP told the court in your opinion?
That she felt sick enough on the 31st to ask Simon to take her to the hospital but then feels well enough to leave the hospital AMA so that she can return home to feed the animals and pack her daughter’s dance bag after being told she was at risk for Amanitoxic poisoning and liver failure not 10 minutes later.

And that she was more worried or stressed about frightening her kids by getting them tested for Amanitoxic poisoning than she was about the actual possibility that they could have ingested poisonous death cap mushrooms.

Dr Gerostamoulos testified that the leftovers were co-mingled. Not clean samples.

The court heard that leftovers were collected from two different places in Erin Patterson's home, but were put into one bag.
Dr Gerostamoulos said it was not an ideal way to receive the samples.

This was one confusing aspect of the trial I wish we had got more clarity on post trial.

Where would the other BW remains have been collected from other than the remains that we know about from the bin? I don't think it would be left in the fridge with easy access by the children.

The police officer was directed to the bin by EP. I wonder if this was the poisonous portion or the non-poisonous one. Maybe the non- poisonous one as EP would not want to be assisting in expediting the identification of the toxin and it's source, as she did not want her victims to be saved.

The black object could have gone into her bag or pocket, who knows.

If this is the object she had in her hand walking into the store, it wouldn't make sense to do that.

Note I did not list a computer.
Just a computer or laptop internal SSD (hard drive)
I guess you have never procured or installed an internal SSD (hard drive) yourself to see how small they have become over the years (like I have years ago). Or opened up a computer or laptop with one in.

My mistake, I misread! I thought you were saying a laptop /computer, not an SSD!

It wouldn’t make sense to put one’s belongings into one’s bag?

In the US, iiuc, they get to make a statement. Unvetted.

Done express remorse, done double down on their "innocence", still others victim blame.

If it's the same in Australia, I hope EP chooses instead to eat her tongue than flap it.

JMO
Going back to this issue of whether EP could make a statement at sentencing, I don't believe it is the same in Australia (or England and Wales) but can't find a definitive statement. Defence lawyers speak on behalf of the convicted person, in mitigation or to convey their remorse.

I can't recall anyone convicted of murder in England and Wales ever being allowed free rein to speak and it seems a grotesque idea. Perhaps Australian posters can help here?

(Megnut, I am assuming 'done' in your post is a typo for 'some' ?)

One would probably put it in one's bag whilst in the car, to be hands free to (not) have enough time to wash one's hands after one's bush poo and subsequent clean-up, before touching food items in a public store with one's filthy hands.

One woman, one callous murderer.

One who most likely dumped evidence in a toilet bin. One who most likely dumped evidence while her son was at Subway. One who most likely dumped evidence at the tip after her unsuspecting lunch guests had left. One who definitely dumped the dehydrator, then lied about owning one.

Going to that servo was her 3rd opportunity to dispose of evidence. The tip, the Subway "cork" trip, the flying lesson. All within about 24 hours of the lunch.

My guess is, she threw something away there.

MOO

IIRC

All of the Wellington remains were in the bin, and, unusually, they were the only things on the bin. They were in a Woolworths bag. The “whole” leftover Wellington was missing its meat, but the Wellingtons in evidence included some samples in broken bits so I don’t think it could really be said which ones were what. The missing meat is what Erin said she fed her children (mushrooms scraped off) but I think she’s lying.

Erin bought more fillet steak than necessary and I don’t know whether any of that was in the fridge/freezer uncooked. I think that’s what she cooked for the children the next day, so probably none of that was left.

The gravy and left over fruit platter were in the fridge. I don’t think there was any orange cake left. Erin said she ate it, but Erin’s son and friend arrived home around the time of dessert as well.

ETA : the Wellington leftovers were in the outside bin as well, which I think is unusual, 5 days before bin day. They weren’t found in a full indoor kitchen-bin type rubbish bag, just in a supermarket bag, with nothing else in it 🤷‍♀️

True. The item she was going to dispose of might have been in her handbag. When she came out of the Ladies, you could only see her car keys in her right hand.

It could be a phone, IMO.
Yes. Her main phone, and one that if not in her hand ,might have been in a trouser pocket or her shoulder bag, in different places at different times during her movements inside the BP.

The Office of Public Prosecutions, Victoria, put out a publication. What it says about the pre-sentence hearing includes this ...

(it doesn't say anything about Erin being able to speak, so presumably her legal team and any character witnesses present all of their so-called mitigating factors.)

"If the accused person pleads guilty or is found guilty at trial, there will be a plea hearing. At this stage, the accused person is called the offender.

Victims, witnesses and family members can attend the plea hearing.

If victims, witnesses or family members are concerned about being in the presence of the offender, they can talk to the OPP solicitor or social worker. It may be possible to watch the plea hearing via a video link from a room away from the court.

At the plea hearing the prosecution and defence present information that they want the judge to consider when deciding on the sentence.

The prosecutor will read a summary of the offending and tell the judge about any relevant legal principles.

The defence will also present information to the judge. The defence may call people to give character evidence or psychological or medical evidence about the offender. In some cases, this can be difficult for victims and family members to hear.

Victims can tell the court in their own words about the impact of the crime on them. They can do this by making a Victim Impact Statement (VIS).

Victims have a choice about how their VIS is presented to the court:
  • A victim can read their VIS aloud at the plea hearing.
  • The prosecutor can read the VIS aloud at the plea hearing.
  • The prosecutor can hand the VIS to the judge without reading it aloud.
The offender will be sentenced after the plea hearing

The sentencing hearing may take place on the same day as the plea hearing, or on a later date decided by the judge."

If it was not something that was utilised within the store like a wallet/purse or mobile phone etc, why would she have it out of her bag in the first place?

Was Erin possibly vaping?
Or disposing of a vape (maybe her sons?) in the BP?

Note I did not list a computer.
Just a computer or laptop internal SSD (hard drive)
I guess you have never procured or installed an internal SSD (hard drive) yourself to see how small they have become over the years (like I have years ago). Or opened up a computer or laptop with one in.

The newer M.2 SSD's have a narrower form factor and so the external version in a casing could be a possibility of what she is holding.

Note that the internal M.2 SSD might be too flat looking as it is essentially a small narrow circuit board.

I've got an old internal SSD I mounted inside an old desktop computer, that is not the size/shape of a small narrow circuit board. Why assume that she only would have had a newer M.2 internal SSD?

"The defence may call people to give character evidence ..."

The irony here is that the few people who might have spoken kindly of EP are now six feet under, thanks to her.

... or maybe a backup drive, if one is slim enough.

Yes. I'd imagine there's not too many lining up to give EP a character reference.
