Dumped dehydrator found at tip​

Erin Patterson's dumping of her dehydrator is recapped.

"On the morning of August 2, 2023, you disposed of your dehydrator at a local tip, the Koonwarra Transfer Station," he says.

"On August 4, 2023, investigators recovered your dehydrator from the tip.

"Forensic examination revealed that the dehydrator contained traces of death cap mushrooms."

Patterson showed no pity, Beale says​

Justice Beale says Erin Patterson's decision to not tell medical staff anything, even as her relatives lay dying, indicated she was set on killing them.

He says she showed no pity during the aftermath of the lunch, and was intent on seeing the murders through.

"The prosecution submitted that I should infer from your pitiless behaviour that the intention to kill was ongoing, and that this constitutes an additional aggravating circumstance," he says.

"I accept that submission."

He says the use of toxic mushrooms to kill, which induces violent illness, is an aggravating factor.

Justice Beale says Ian Wilkinson, who survived, still suffers to this day.

"Your lunch guests each suffered severe gastrointestinal illness on the Sunday and Monday prior to being sedated and mechanically ventilated," he says.

"The suffering was protracted and Ian Wilkinson suffers ongoing health issues. This aggravates your offending.

"The prosecution submitted that you must have anticipated that your victims would suffer in the way that they did. I am satisfied of that beyond reasonable doubt."

Judge speaks of sliding doors moments​

Judge Christopher Beale has turned to the what-ifs that now plague the Patterson and Wilkinson families.

Instead of informing those treating the Pattersons and Wilkinson’s that you had used foraged mushrooms, which you could have done without having to admit that you had deliberately poisoned their meals, you repeatedly denied foraging, insisting that the mushrooms, the beef Wellingtons, were sourced solely from Woolworths and an actual grocery.

We will never know whether revealing the use of forage mushrooms was made a difference, but the administration of the drug silicon, which is a specific antidote for death mushroom poisoning, was not commenced on the 30th of July, 23 because at that stage, the evidence regarding the type of toxin was inconclusive.

"Your offending involved an enormous betrayal of trust. Your victims were all your relatives by marriage. More than that, they had all been good to you and your children over many years, as you acknowledged in your testimony," he says.

"Not only did you cut short three lives and cause lasting damage to Ian Wilkinson's health, thereby devastating extended Patterson and Wilkinson families, you inflicted untold suffering on your own children, whom you robbed of their beloved grandparents."
Justice Beale says that the intense media scrutiny around the case has also deeply affected the victims and her own children.

He says this is due to Erin Patterson's actions.
