The attorney for one of the men charged with murder in the death of Ahmaud Arbery plans to file a motion saying that his defendant is not facing a jury of his peers.

Kevin Gough represents William 'Roddie' Bryan, the man accused of filming the pursuit and killing.

“It would appear that white males born in the South over 40 years old without a college degree... which he might also be known as Bubba or Joe Sixpack... seem to be significantly underrepresented," said Gough during jury selection Friday.

#AhmaudArbery - Sounds like judge is planning opening statements for Thursday. He said even if they get a jury by Wednesday morning there are outstanding technical issues, motions, etc... they need to handle before openings.

This would be quite convenient.

This brings up a curious point. Isn’t “your peers” a circle of actual friends, neighbors, coworkers?

11/1/21 Monday, Jury Selection Day 10: The jury pool in the Arbery shooting case drops by 1. Judge Walmsley reconsidered Friday's qualification of Juror #5; he's not sure they'll wrap in time for her to pick up her child by 5:30pm daily. "I don’t see any way we could be fair to that juror & her schedule”. Kevin Gough represents Bryan, the man accused of filming the pursuit & killing plans to file a motion saying that his defendant is not facing a jury of his peers. Now have 60/64 potential jurors qualified to move to the final round. Just need 4 more tomorrow. Judge is planning opening statements for Thursday, 11/4/21. @MissVWaters

Juror 434 reiterates she can set aside her opinion, listen to evidence if she's picked for trial. R Bryan's atty asks, Which church she attends; education; do blue lives matter? She doesn’t know what he means, so he explains there is a flag with a thin blue line
Roddie Bryan's attorney asks Juror #434 if she cares about veterans. She said yes.
He asks if she cares about Charlie Hebdo. She is confused.
Gough determines he may have seen the wrong Facebook profile.

Juror 439, B/M, sole caregiver for toddler. Can't afford to miss work, & has to pick up tot by 4PM daily, latest. He's the one approached by "Justice for #AhmaudArbery" demonstrators outside. Bob Rubin asks him about that. They are his aunt and his cousin. He's struck.

In the #AhmaudArbery shooting case, they're pausing to see how many jurors can be qualified. May not have to voir dire the rest. So far, they've qualified Jurors 434, 440, 444, and 450. That's 64/64. Now arguing motions on others not struck for cause

Roddie Bryan attorney Kevin Gough raises concern about Juror #219, whom he's found has "a number of #AhmaudArbery dance video tributes on an undisclosed TikTok account." He says they've looked hard for not just logical, but emotional, connections to the case players
Kevin Gough says it was "pure dumb luck" they found it; wants to bring #219 back. Jason McMichael joins, says juror had an "emotional connection to Mr. #AhmaudArbery." "Very expressive ballet dancing w/lots of hearts & flowers...odd-looking but an emotional expression"

Gough: I've never been in a case like this & couldn't have thought it possible but believes they need more than 4 alternates especially if they end up striking some they're discussing now. Judge says he won't strike for "arbitrary" reasons probably touched on before

Greg McMichael attorney Laura Hogue wants to bring back a "freaked out" juror who contacted the court clerk about having had a friend & a coworker approach her about being in the jury pool after they recognized her description in news report.

Judge Walmsley says he'll talk with her. Says "freaked out" can be taken a number of ways; clarifies the woman contacted the court clerk, who gave the judge a note passing along message.

Prosecutor Linda Dunikoski says State realized over weekend there was a juror they meant to make a strike motion on themselves. Judge Walmsley tells all the lawyers, basically, the solution to ALL of this is in their peremptory strikes

@MissVWaters

HAPPENING NOW:Roddie Bryan atty Kevin Gough says they're considering whether developments during jury selection will lead them to move to sever his case from the McMichaels'. They'll decide overnight, but if it happens he didn't want Court caught off guard

jury makeup already an issue, 11 white jurors and 1 black juror doesn't sit well with me, all the other balck jurors have been dismissed so I don't know what the judge can do regarding the states Batson challenge,

  • #630
maybe they will have to bring back some of the stricken jurors to see if they can be seated, but I can't imagine the defence being in agreement with that, this is going to be a long trial with 3 defence teams, so every witness is questioned at least 4 times,

  • #631
@MissVWaters

State essentially alleges the defense is striking Black jurors based on things not even asked about in voir dire. Defense says State's reply is unresponsive. Emotions are running high. 1 juror didn't reveal discipline on a previous job; defense says he's dishonest

L. Hogue says most African-American jurors were struck for strong opinions; those in question here said they could put strong opinions in a box "So it's up to us to use our peremptory strikes. Would you want that juror judging you? The answer is a resounding 'No.'"

Kevin Gough: I asked a juror whether he knew me. 2 dozen people w/his same last name had dealings with his office when he's saying he doesn't know me. I don't believe him! That's as race-neutral as it gets, they pretend they don't know me
"I feel like we just jumped the shark," says Judge Walmsley in response. "We started out talking abouot race-neutral reasons to strike 143 and we seem to have gone on a tangent about the believability of jurors in voir dire."

court in recess, they are reviewing 8 of the black jurors struck by the defence,

  • #634
the trial is already making me rage, just the comments from the defence attorneys is enough to make me shout profanity at my laptop, I hope this judge finally gets some steel in his spine and starts making all attorneys behave in his court,

Haven't said much but am checking on juror selection process daily. Thanks to all who have worked hard to post about this process and our potential jurists. I am looking forward to watching this trial. Following the case since day 1 and I am ready to see justice done.

@DanaeBucci

The judge has denied the motion to reseat some of the eight black potential jurors struck by the defense. The jury will remain 11 white people, one black person. The defense struck 11/12 potential black jurors.

Judge is back. The Court finds it does appear there's intentional discrimination in the panel. He says the racial overtones in the case have been a challenge; hard to escape those discussions w/the panel...a convo that'll likely continue for a long time.
This case then has extensive questioning then peremptory strikes. He mentions Justice Marshall's opinion in Batson that that decision wouldn't end the racial discrimination that peremptory strikes inject into the process.

Judge says Counsel has explained their strikes and it doesn't change the initial finding and doesn't "feel like" that's how it worked but he's not going to rule they're being disingenuous so he's denying the State's motion.

  • #637
Judge has ruled their has been intentional descrimination in jury strikes by the defence and is now having to work out what to do about it

for me bringing back jurors already stricken is not the answer, as I think that these jurors who are all black would have worked out why they were struck and that would lead to some questions to their impartiality, but if judge doesn't bring any of them back would that mean jury selection has to start over

I see judge even though accepting their were issues with strikes against black jurors not being selected has agreed to seat the jury they have which is 11 white 1 black, with I presume other white jurors as alternates as all the remaining black jurors were struck
