A suspect in the Georgia shooting death of unarmed black jogger Ahmaud Arbery says it’s “manifestly unjust” that he’s being held without bail while cops accused in the deaths of George Floyd, Breonna Taylor, and Rayshard Brooks are all walking free.

William “Roddie” Bryan argues in court papers that he is unfairly being held while the suspects in the high-profile, racially-charged police shooting cases have all been granted bonds while awaiting trial, TMZ reported Monday.

According to authorities, Bryan — who has been jailed since his arrest on May 21 — used his pickup truck to try to trap Arbery and even struck him with the vehicle to stop him from fleeing.

But his lawyer claims Bryan poses much less of a threat to flee and no danger to the community and should be granted bail while awaiting trial.

Bryan was last denied bail in a hearing in July.

GLYNN COUNTY, Ga. – The three South Georgia men accused of felony murder in the shooting death of Ahmaud Arbery, a 25-year-old black man, will go back before a judge next Thursday to ask to be released from jail.

The men, Travis McMichael, 34, his father Gregory McMichael, 64 and their neighbor, William “Roddie” Bryan, were charged in May with murder and aggravated assault two days after a graphic video of the shooting of Arbery became public, two months after he was killed.

Court documents on Thursday showed, along with bail, defense attorneys for the McMichaels will request the judges throw out the malice murder and false imprisonment charges in the indictment.

Prosecutors in the case could also bring up on Thursday’s hearing their notice to bring in evidence of alleged racial videos, text messages and social media posts by the McMichaels and Bryan.

7/17/20 Update: Judge Walmsley says they will start with Gregory & Travis McMichael & then move to Roddie Bryan. Both attorneys waived the formal reading of charges & Travis & Greg McMichael plead not guilty to all 9 counts. Judge has denied the motion to strike Cobb Co. DA Joyette Holmes from the Arbery murder case. Discovery: Defendant has until 7/31/20 to opt into reciprocal discovery; both parties shall serve all discovery materials upon opposing counsel no later than 8/28/20. If defendant procures new counsel, it shall be the duty of the original attorney for defendant to provide all discovery to new attorney. All particularized motions & notices shall be filed on or before 9/30/20. All responsive pleadings shall be filed on or before 10/28/20. No future hearing date set yet.
8/6/20 Update: Separate motions were filed for reasonable bond for Travis & Greg, also want the charges of malice murder (count 1) & criminal attempt to commit a felony (count 9) dropped. Greg McMichael asked court to set a hearing within 20 days.

They seek to admit into evidence an “Identity Dixie Facebook post” & “Racial Johnny Rebel Facebook post” against Greg McMichael. One reason to allow the evidence: “proof of motive.” In a separate court filing, prosecutors also asked Superior Court Judge Timothy Walmsley to prohibit the defense from introducing bad character evidence about Arbery at trial. This includes his past convictions, prior encounters with law enforcement & his mental health history. Such evidence, the motion said, is “irrelevant & inadmissible as to the issues in this case, including the issues of self-defense.”

7/17/20 Update: Bryan's attorney has filed a series of motions, including one he filed just this morning, contesting the basis of the charges against Bryan. Bryan's attorney is objecting to the Arbery family's civil attorney wearing a George Floyd mask in court. To clarify, he's not actively arguing any case today. The state is. Judge Walmsley overruled the objection. Exchange between the judge & Bryan's attorney. Bryan filmed the Arbery shooting. Bryan's attorney made a motion to require spectators to remove masks or shirts that depict Ahmaud Arbery/George Floyd/BLM etc. Motion is overruled. Attorney waived formal reading of the indictment & Bryan entered a not guilty plea. The motion on inflammatory statements. There appears to be an agreement reached. ADA says case files won't be turned over to lawyers for Arbery's family, which apparently was the main concern. Gough is abandoning that motion. The court is discussing a bond hearing for just Bryan in response to his lawyer's motion. The judge gave the state & defense a 10-min recess to discuss the parameters of the bond hearing. The issue -- Bryan's attorney wants to submit new evidence. His attorney just called Bryans 26-year-old son Preston up to the stand. Son says he doesn't believe his dad is a flight risk. Prosecutor Evans read statement from Arbery's father. Ahmaud's mom read victim impact statement: "He wants this court to allow him to go home," said Jones. "My son actually ran around him. My son actually ran for his life, but William Bryan did not allow my son to go home." And urged the judge not to release Bryan on bond. The judge will reconvene after lunch at 2pm. He wants to look over the evidence again before making a determination on bond. Judge has denied the motion to strike Cobb Co. DA Joyette Holmes from the Arbery murder case. Judge Timothy Walmsley denied bond. Judge Walmsley cited Bryan's potential flight risk, lack of employment and ongoing investigations as reasons for denying the bail request. 7/18/20: Completely separate from Ahmaud’s case: On Wednesday, July 15, 2020, the Glynn County Police Department requested that the GBI initiate a sex crimes investigation based on allegations made against William “Roddie” Bryan, Jr. The investigation is active and ongoing. After further discussions with the Glynn County Police Department, it was determined that the Camden County Sheriff’s Office has jurisdiction in this case. The official request for the GBI investigation came from Camden County SO. The fact sheet of the investigation, which listed the type of case against Bryan as "child abuse/molestation." It also said the incident took place in Camden County and that the victim was a White female.
8/6/20 Update: Bryan's attorney filed a motion Thursday looking to adopt the claims made by the McMichael's attorneys to also get those two charges dropped- of malice murder (count 1) & criminal attempt to commit a felony (count 9).
9/11/20 Update: Bryan filed Demand for Trial-Statutory Speedy Trial Demand. 10/5/20 Update: Prosecutors want to introduce unspecified racist messages extracted from Bryan’s cellphone. At a bond hearing in July, lead prosecutor Jesse Evans said Bryan repeatedly used the n-word in texts that contain “a ton of filth.” In a separate court filing, prosecutors also asked Superior Court Judge Timothy Walmsley to prohibit the defense from introducing bad character evidence about Arbery at trial. This includes his past convictions, prior encounters with law enforcement & his mental health history, they said. Such evidence, the motion said, is “irrelevant & inadmissible as to the issues in this case, including the issues of self-defense.”

The state prosecutor says the witness responded to Travis's text message saying the "****" needed some Newports and a 40. The defense says this was "some joke" between the two.

-ADA Evans plays jail phone call of Greg McMichael & wife, telling her to tell their daughter Lindsay to get rid of her social media. He also mentioned that she has much more on her phone than she put online.
-Judge Walmsley says he found in regards to Travis McMichael, serious concerns about bias among the witnesses. (He said something was absolutely "indefensible" but the judge is so hard to hear!) Also: Greg McMichael "placed the law in his own hands"
-Defense atty for Greg McMichael: This case, despite all we heard, is about whether Greg McMichael was entitled to protect his community and do a “good deed.”
-ADA Evans says both McMichaels tried to influence a witness in the case, telling someone not to talk to police.

-As the video of Greg and Travis McMichael and Roddie Bryan gets to the portion where Ahmaud Arbery is cornered at gunpoint, a high-pitched squeal is heard in the courtroom and then loud crying as the fatal shooting plays out on the screen
-Judge Walmsley says the video shows him the McMichaels are a danger to the community: "There's a significant danger in all those actions...then, the DA was called from scene." Says he won't get into the social media aspect; may touch on it in written order.
-Wanda Cooper-Jones confirms today in court was the first time she's seen the video of the shooting. Those were her wails we heard. On the denial of bond she says "Today was a good day."

Thanks for the update, SDS71. It is so fitting that McMichael called his old boss on the day of the shooting. If that is not enough to tell us that an old boy's network was in place, I am not sure what is. Glad that they are staying put.

My heart goes out to Mr. Arbery's mom. I would die a thousand deaths if I saw my baby hunted and killed in the way he was. Strength and peace to her.

His bone fragments left behind? My goodness, I would think that LEO would want those fragments. It is just disgusting that the scene was not canvassed better. IT must be wrenching to hear this as a mother.

Then prosecutor Jesse Evans asked L (witness) about a text message Travis McMichael had sent him last year that used a slur for Black people when referring to a “crackhead ... with gold teeth."

L(witness) at first said he didn't recall receiving the message. Then after reviewing a transcript of the exchange, he answered: “He was referring to a raccoon, I believe.”

Evans also cited a photo L(witness) posted to Facebook last year to which Travis McMichael replied: “Sayonara,” along with an offensive term for Asians followed by an expletive. L(witness) said he didn't recall that, either.

Well, those texts were sent before Travis killed AA, so don't have any direct bearing on whether or not Travis felt remorse. (Which no, I don't believe for a minute he did or does now).

That friend of his he exchanged the texts with & who testified for him did himself & Travis no favors at all. It was clear what Travis meant in the text, and insulting to the intelligence for the friend to say either of them were talking about a racoon. Even worse, the dude was smirking as he lied. He still thinks the texts were funny.

no time to read and catch up. Just realized as I was winding down my work day that I had forgotten there was a hearing on this. I'm listening to both days of the hearing just now. And catching little bits of info as I go relevant/related to things we discussed here months ago.

One of them. GM's wife/TM's mother testified that Travis (by inference) did not immediately call LE on Feb 11, the night he supposedly was driving by English's property & saw AA sneaking behind bushes, headed towards the house.

Instead, according to his mother, TA (drove or ran) to her/his/dad's/sister's house to get his cell phone. And a gun. And then went back to in front of E's house, where he called 911, out of breath, saying nothing about first going to get a gun.

Not to mention how that timeline matches up (it doesn't) with running or driving to get phone & gun, while AA supposedly would meanwhile only have moved from a side bush to behind the porta potty on the front lawn. After seeing a truck pull up & park right out front, feet away, and a guy jumping out & sprinting down the street. Or pulling up, stopping, then revving down the street & back. Nah.

From the bond hearings.

1. State showed a different/new short snippet of Roddy's video of hunting down AA. Of AA directly in front of him, running away from him, then turning around towards Roddy.

2. There is video of GM's interview on Feb 23 by LE, and bodycam video of LE speaking to TM at the scene.

3. Defense tried to introduce AA mental health records, the judge didn't allow.

4. State has evidence taken from SShores' FB page that TM urged residents as early as July 2019 to "arm up" in response to alleged break-ins in the neighborhood.
In another post, in Nov 2019, TM said of (the intruders) that " they were starting to play with fire."

5. GM's wife testified about her daughter posting photo of AA's dead body in the road. She said she was "horrified," and that her daughter had made a "mistake in judgement." IMO what seemed to upset her most was how much she said her daughter had suffered from the public response to the fact she had posted it.

6. State evidence from TM's SM includes Johnny Rebel videos & a racist violent video sent to TM who replied with lol's & forwarded them on; a post about never having a gun unless you intend to use it; and an exchange with a neighbor in which the neighbor complained about aggressive dogs & TM replied you have to defend yourself against aggressive dogs & shoot them, same with humans.

b. On GM's SM: a meme supporting the confederacy, written by a recognized "hate group," GM then changed his name on SM to the name of that hate group. GM, on FB status, " discussed neo-confederate views," including what would have happened at Woodstock if it had been attended by Blacks versus Whites." And 2 posts the State characterized as vigilantism/violent.

On the judge's reasoning for denial of bond:

For TM: the judge commented on a disturbing consistency of testimony provided by TM's character witnesses. He seemed to be suggesting those witnesses had either been coached or had discussed/shared their testimony with each other prior to the bond hearing.

He also took an extremely dim view of the testimony (and witness) who smirked while telling the court the obviously racist texts exchanges weren't what they seemed, and just jokes. The judge called that characterization "indefensible."

The questionable credibility of TM's character witnesses (all of them) were the only grounds the judge provided for denying TM bond, though he indicated he would lay out additional grounds in his written order.

For GM: the judge said plainly that he believed GM had taken the law into his own hands, and had, as the State asserted, deliberately tried to influence the investigation. His doing so, said the judge, had played a large role in slowing down the investigation/delaying justice. He knocked down one of the defense's claims about GM not being a flight risk (because he hadn't fled in the first months after AA was killed), saying GM didn't have any reason to fear being arrested, given that "influence."

There was some discussion about due dates near the end of the bond hearing. The judge granted an extension for filing pre-trial motions to all 3 defense teams. That date is now December 31, 2020.

But. The State indicated it hadn't turned over all potential discovery yet because of problems they were having accessing content on TM & GM's electronic devices. More evidence to be found? Anyway, those problems alone may push back the Dec 31 date for moving closer to trial.

Also floating about TBD. Looks like the defense (at least 2 of 3) are trying to get Larry English to do a deposition and he isn't committing, citing concerns about Covid. They asserted that E's health was bad enough that not doing the depo in short order might mean not getting a depo from him ever. The State didn't see any reason (yet) to compel English to do so, and neither did the judge (for now).

One of the most damning pieces of evidence about GM's mindset, imo:

In a jailhouse call, GM says he isn't sleeping well, keeps waking up during the night. That it must be because of what happened.

The caller says, with a laugh, speaking of AA's killing:

"Yah, no good deed goes unpunished, huh?"

GA responds: "yah, that's it right there."
