Al Sharpton to attend trial at request of Ahmaud Arbery family

“We see the Arbery case as a 21st-century lynching and we want justice,” said Sharpton.

The family of Ahmaud Arbery has requested that civil rights leader Rev. Al Sharpton make an appearance at the murder trial once it gets underway.

Sharpton, who called Arbery’s death a “21st-century lynching,” spoke about supporting the Arbery family when delivering a sermon in Savannah on Sunday to celebrate the 150th anniversary of the St. Paul C.M.E. Church. At a news briefing following the morning service, Sharpton gathered with Arbery’s mother, father, and family attorney Lee Merritt.

“We want justice,” said Sharpton about the killing of Ahmaud Arbery, WTOC reports.

“The local activists in Brunswick, we’re there to support them not supplant them. They’ve been diligent,” Sharpton said. “We aren’t taking over because they have kept the fire burning even when the national media wasn’t there. But we see the Arbery case as a 21st-century lynching and we want justice.”

Another late start to jury selection process in Ahmaud Arbery slaying trial

Nineteen potential jurors will be questioned on Wednesday.

So far, 36 potential jurors have been qualified to advance since jury selection began on Oct. 18. That’s slightly over half the 64 that are needed in a jury pool from with the final jury will be chosen.

On Wednesday morning, there was discussion about getting a clear record for the defense.

A pivotal defense argument of the three white men on trial in Georgia for killing Ahmaud Arbery, a Black jogger, is that they were trying to make a citizen's arrest under a Civil War-era law that was later repealed amid an uproar over the shooting. The state's statute was originally passed to enable the capture of escaped slaves.

When the fatal encounter occurred on Feb. 23, 2020, it was legal in Georgia for people to arrest someone where they had "reasonable and probable grounds of suspicion" that the person had just committed a felony. Outcry over the killing led to lawmakers revoking the statute in May.

Legal observers say prosecutors will seek to convince the jury that there was no felony over which to arrest Arbery, 25, and that the three men lacked the "reasonable and probable suspicion" required under the old citizen's arrest law. The trial is in the second week of jury selection.

Most U.S. states have codified some form of a law allowing citizen's arrests.
Chris Slobogin, a law professor at Tennessee's Vanderbilt University, said citizen's arrest laws put dangerous powers in untrained hands.

"Things can get out of control quickly," he said.

But they didn't meet the criteria to even do the citizen's arrest.

They did not see him commit any crime/felony. They just assumed guilt. Assumed he stole something. He didn't even have anything in his hands.

To make a citizen's arrest they would have to see him stealing something and they did not. All they saw was him jogging down the street. Period.

What is the citizen's arrest law at the heart of the trial over Ahmaud Arbery's death?

The three defendants will be tried under the old version of Georgia's citizen arrest laws, since those applied at the time of Arbery's death.

The accused men - Travis McMichael, his father Gregory McMichael, and William Bryan - said they thought Arbery might have been responsible for burglaries in the area and so they tried to detain him.

According to Cornell University criminal law expert Joseph Margulies,
the jury will have to consider whether the men "reasonably suspected" that Arbery had committed a felony and was trying to escape.

Even though Arbery didn't commit any felony crimes, the jury simply has to conclude whether they reasonably believed that he did.

Margulies says he expects the McMichaels to say: "It's not simply that Mr. Arbery was a young Black man who jogged by, it's that we had a number of reports of burglaries in the area."

Police never connected Arbery to any.

What other laws will be scrutinized in this trial?

In addition to the now-repealed citizen's arrest law, Margulies says Georgia's open carry and "stand your ground" laws will also factor into the case.

Open carry laws allow Georgians to openly carry firearms if they have a permit for them.

And "stand your ground" laws allow them to use deadly force if they "reasonably believed that they were at risk of serious bodily injury or death," according to Margulies.

"So that's where it all will turn."
