‘My Opinion Is Ahmaud Was Murdered’: Attorneys Struggling to Find Impartial Jurors In ‘Extremely Long’ Selection Process That Has Moved Into Second Week

Jury selection is taking longer than usual, legal experts said. More than 100 prospective jurors have been questioned in the case.

According to reports, many of those screened for the jury have already formed opinions, know at least one person in the case, or are afraid to be involved.

Defense attorneys say that by the end of the week they believe they’ll reach the 64 potential jurors needed. Greg McMichael to the right, Travis McMichael to the left.

Pate added that potential jurors are so familiar with the case because Arbery and the defendants lived in a small community of 16,000 people.

At least two dozen potential jurors have displayed negative feelings against the men on trial, CNN reported. According to reports, one person interviewed for the jury pool allegedly gave Arbery’s family a thumbs up.

One man who made it to the jury pool after questioning, a railroad worker, reminded the court that Arbery was unarmed when he was killed. He saw the video but told the court that he does not use a computer or social media.

“It was three persons who attacked one and no gun,” the railroad worker said. Still, he appeared impartial about the case’s outcome. He told the court: “There’s things that happened that we didn’t see and we don’t know.”

A small town problem in Arbery trial jury selection: 'Everyone knows everyone'

One difficulty of prosecuting a major case in a small town is becoming clear: EVERYONE KNOWS EVERYONE.

Knowing someone does not necessarily disqualify them from a jury, but it can be a big strike against them.

One potential juror sometimes enjoyed a Southern-style oyster roast and game of cards with the victim's father. Another said her stepfather goes fly-fishing with two of the defendants.

Others said they had seen the victim jogging around town or lifting weights in a neighbor's driveway. A woman told the court her husband and father-in-law know William "Roddie" Bryan.

Another potential juror said he knew Gregory McMichael. "He's a friend of my father's and he's been over to our house multiple times," the man told the court, one of at least 20 potential jurors by Reuters' count who have said they met or know either Arbery or the defendants.

Some potential jurors with especially close ties to a party have been dismissed. One was a woman who said she was third cousins with Arbery and grew up in the same house as his father, Marcus Arbery.

Another was a young man who recently moved to Brunswick and became close friends with Arbery after they met at a bar on one of the beach-lined islands nearby a few months before the shooting.

A retired mechanic said he had met Travis McMichael because they were both in the same hunting club. The man also said he had known Bryan for about 20 years through Bryan's work repairing small engines.

He said he was not close friends with either but pleaded, unsuccessfully, to be excused, saying it was too difficult for him to be impartial.

One middle-aged man said he was friendly with Arbery's mother and that Arbery's father, who runs a landscaping business, had mowed his lawn about six months ago. Both parents have often been present for jury selection, the mother sometimes in tears.

#AhmaudArbery - 52/64 jurors are now qualified. It's doubtful they'll hit 64 on Monday. Maybe Tuesday? Then peremptory strikes and openings on Wednesday? We'll see!
@LawCrimeNetwork

Okay - each of these articles have different amount of jurors qualified. Is it 52 or 55 for Friday?
And I must have read something wrong and didn't post my stuff yesterday, Friday for jury selection. I thought Thursday was the last day - and read they would continue on Monday... oh well.

TIA if someone can tell me if it is 52 or 55 qualified.

Court is dark Fridays. Thursday was the last court day this week. They will continue jury selection, no matter how long it takes, until pool of 64 is selected.
From the 64, a panel of 12 will be selected.

I'm in Jacksonville which is the closest large town (about 70 miles away) and everything I see local says 55.

How Ahmaud Arbery’s Accused Murderers Could Still Get Off

But the delay in justice in Arbery’s death somehow kept getting more brazen. Two district attorneys rescued themselves from the case—one has even been charged criminally for their response to the episode—even as they and other law-enforcement officials faced credible accusations of corruption in an area marred by a long legacy of police and official misconduct.

Meanwhile, several controversial Civil War-era statues appeared to, at least in part, open the door for legal justification of the gruesome killing many have described as a “lynching.”

From a legal standpoint, this trial is not as open and shut as some people might believe,” J. Tom Morgan, a former DeKalb County district attorney, told The Daily Beast. “I can see why every district attorney in this area did not want to touch this.”

Experts consulted by The Daily Beast pointed to a messy jury selection process as the latest looming obstacle for the already-complicated case.

So far, numerous jurors have admitted to Judge Timothy Walmsley they already have strong opinions of the case, personally know the defendants, or are terrified about the possibility of rendering a verdict that might have social and legal consequences on the community.

“I think it would be naive to think there couldn’t be real-world repercussions,” one female resident reportedly said this past week.

The sluggish pace has made it difficult for the court to even come up with the 64 residents needed to complete the initial round of jury selection.

Morgan noted that if the slow pace of just the first round of jury selection continues, Walmsley might be forced to conclude that the McMichaels and Bryan can’t get a fair trial in Glynn County.

“All eyes are on this case and they are on this case for many reasons,” Ronald Carlson, a professor in the University of Georgia School of Law, told The Daily Beast. “This case has had many problems from the start, and further delay in the case would only be met with outcry.”

Reading about this counties public servants is enough to spook a guy on Halloween night. I’m scared of where this case is headed with that kind of mentality and biases so prevalent in the area.

@BuckEsq

On Friday Judge Walmsley qualified 55* jurors. The asterisks was there because juror 5, who appears to be a single mother with no child care options after 5:30pm, was qualified as a juror.

Judge Walmsley came back this morning saying they could not guarantee the court would be out every day before 5:30 and that wouldn’t be fair to that juror and her schedule. So from 55, to 54, we still need 10 jurors. Only 17 prospective jurors came in for questioning today

@MissVWaters

The jury pool in the #AhmaudArbery shooting case drops by 1. Judge Walmsley reconsidered Friday's qualification of Juror #5; he's not sure they'll wrap in time for her to pick up her child by 5:30 daily. "I don’t see any way we could be fair to that juror & her schedule”
