Oh.my.god just finished watching the defences closing.

Sheffields imaginary dialogues and blatant appeals to emotion are the worst telenovela I have ever had the misfortune of watching.

I am so freaking angry: Travis went to buy gas at 4 am one morning and saw someone ducking in and out of shadows so--- it must have been AA, right? OMG I cannot tell you
the depth of my hatred (yes hatred) for this attorney: he is evil IMO. He knows that is BS - he knows that is a crock but he will say anything to get the jury to believe AA was up to no good- so forget what the prosecutor tells you about citizens arrest- his attempt is to get to the jurors on a visceral level- he wants them to experience fear- and if they do experience and understand that fear, they will acquit these defendants. The worst of all possibilities is that it could work!

It's already getting thick in here. MOO The unspoken subtext is to protect his family from those scary brazen thieving black people. As if to suggest AA was threatening the very fabric of American family on February 23rd.

Yeah, that's why they picked burglary on Feb 11th. It's a felony. And he's trying to catch him due to that, because the citizen's arrestvlaw says you can chase while "fleeing."

It's the defense i fear they will buy.

The prosecution will hopefully argue how long you can chase/flee.
My question about that is that the defense had to focus on the property being a residence in order to fit into the Georgia definitions of a felony charge versus a misdemeanor. But can an uncompleted house under construction (without even doors at that time) that was nowhere close to eligible for a legal certificate of occupancy be considered a residence under the Georgia statutes?

That's true. You're right. That's what RB's attorney was talking about last Friday and objecting to the prosecution calling it a construction site (so late in the game). Someone might soon argue that it was inhabitable. If so, will the jury buy it? Can it be appeal grounds?

Ok, I'll go back and listen to the judge's ruling on Friday. I thought the judge ruled that immediate pursuit of a felony (but not a misdemeanor) is allowed but that it did not obviate the first part of statute (which requires immediate knowledge of the underlying crime). I guess I'm wrong. I'll listen again. JMO.

Is she trying to recreate a time, technology wise, when that sort of blatant dog whistling was acceptable?

That flip chart looks tacky and unprofessional and a wee bit of me wants it to fall on her head.
