It's ironic that she said the prosecution needs to meet a high burden of proof because isn't that what the defense has to do also to prove self-defense?

Replying to my own post. Based on this I think my understanding is correct:

The reason why the defense complained his ruling would gut their case is because it would make their probable cause case/justification moot.

  • Unlawful entry to a place
  • Where valuables were stored
  • Without authority
  • and no other apparent motive to be there
  • Nothing has to be stolen
Then she conflates it with the theft on the boat that supposedly occurred at the house (0r maybe elsewhere. who knows because no one saw anything). Which is it? Burglary or robbery, ma'am?
