"Cook County Judge Steven Watkins said during a Tuesday court hearing that he did not agree with attorneys representing media organizations including The Associated Press that there is an emergency that requires him to make an immediate ruling.

The judge set a schedule for motions and arguments that he said would result in his written opinion in late May."

I hope the judge who initially sealed them is also being investigated along with Foxx

Yeah, I wondered that a few days ago "aloud" (i.e., on thread). Does Attorney Foxx not know the rules and process for unsealing a file? (Would we be surprised to learn this?) . Did a reporter do a colloquial summation of her actual words and get it wrong? Does "the process" always take weeks? So many questions...

The only answer why I phrased it with some doubt as to whether or not she knew the process, was because I thought I remembered some newspaper link recently posted here on the topic, which said that unsealing court records cannot be the work of a moment... and that I don't recall thinking it seemed like the person saying that, had an axe to grind. Media attorneys seek to unseal Jussie Smollett's court file days after prosecutors dropped all charges

Under Illinois law, defendants whose charges are dropped can in certain circumstances have their records sealed immediately. But such a sealing is not mandatory — and was not meant to apply in a high-profile case such as Smollett’s, the media attorneys argued in paperwork filed Monday.

“Sealing records cannot serve its intended purpose here, since, unlike the typical case contemplated by the Act, the public at large is already well aware of the charges brought against Mr. Smollett,” the filing said.

The filing went on to note that the quick sealing left considerable confusion, particularly about what exactly was supposed to have been sealed.

Foxx told multiple reporters last week that she believed only parts of Smollett’s court records should have been kept from public view and that she believed the actual court file would be unsealed.

A spokeswoman for her office walked that back the next day, saying the entire case file was sealed by court order.

Fresh off her victory to become Chicago’s next mayor, Lori Lightfoot on Wednesday again said the public deserves a better explanation of how the Cook County State’s Attorney’s Office resolved the Jussie Smollett case. Lightfoot went on to say that the public had seen “a very compelling case” that Smollett “staged a hoax.”

“He’s got to be held accountable,” said Lightfoot, the first openly gay person and the first black woman to be elected mayor in the city, in an interview on MSNBC.

The state’s attorney’s office, headed by Kim Fox, “has to give a much more fulsome explanation. We cannot create the perception that if you’re rich or famous or both that you got one set of justice and for everybody else, it’s something much harsher. That won’t do, and we need to make sure that we have a criminal justice system that has integrity.”

“The state’s attorney’s office has to provide more information about the rationale for the decision to drop the charges,” Lightfoot continued.

Turning to the alleged hate crime itself, the former federal prosecutor pointed to the publicly-available evidence: “I saw…a very compelling case, with videotapes, witness statements, and other information that looked like he had staged a hoax. North Suburban Association of Chiefs of Police had sent Foxx a “no-confidence” letter and the group would be participating in a press conference with the Chicago Fraternal Order of Police to announce their concerns this afternoon. Groups representing the south and west suburban police chiefs have also drawn up similar letters and will attend the press conference, according to reports. A Chicago FOP spokesperson Wednesday denied that a “no confidence” posture would be the topic of this afternoon’s press event.
