Is Terri's arrest imminent?

  • #181
Can someone explain why we feel it is appropriate to discuss rumors? If you can't link you cannot discuss. Fix your posts please. By even posting it here you are spreading rumors even further.

Post lands at random.

I just want to make sure I understand because I'm new here. Is speculation considered spreading rumors or is it only if you say "I've heard this" without a link to back it up?

In this case, it's a fine line, and has as much to do with wording as content.
MOO.

Forgive as I haven't read the whole thread - thought this was interesting

Bruce McCain, former Multnomah Co. Sheriff Capt. . . . "believes Terri had “some sort of premeditated plan” regarding Kyron and said police need to refocus and reconstruct “every hour and minute she spent on that fateful June 4 to find out exactly where the holes are in her original story.”

Willamette Week just posted a story about how Terri misinformed everyone about how she became part of the household. She was already living with Kaine when Kyron went to live with his dad.
“We were never friends,” Young said. “I didn’t meet her until after she moved in with Kaine."

Didn't know where to post this so here it is:http://blogs.wweek.com/news/2010/07...te-clarifying-stepmoms-entry-into-the-family/

Spicher's attorney told NBC Dateline that he would be "surprised" if Terri was not arrested in the case.

NBC Dateline was set to air a special edition about the case 10 p.m. Monday.

Spicher's attorney Chad Stavley told NBC Dateline Monday that Spicher had been, and planned to keep, cooperating with investigators.
"I would be, frankly, surprised if Terri Horman did not eventually face charges in this case," Stavley said. "I'd be surprised if the indictment didn't come down."

That's what I can't figure out. It can't be homicide because LE is still talking about Kyron being alive. They could arrest but IMO they couldn't charge because the defense attorney will play videos at the charging hearing of LE saying they're proceeding on the premise that Kyron is alive and the judge will let her walk. #1 requirement for a homicide charge is that the person is dead. DA can't say the person is dead if LE is saying they're alive. I base this on knowledge gained through Gabe Johnson's case.

Can't be kidnapping I don't think unless they can prove Kyron crossed state lines.

The only thing I can figure as I've said before is custodial interference, and that's a lightweight charge. It's certainly enough to hold her while they try to get probable cause on a more severe charge though.

ETA: But note he says... eventually...

It could be homicide if Dede tells them it is homicide.

Also we don't know what evidence they have from various computers and phones and from inside the white truck, or home.

Their fall-back is maybe murder for hire, but they wont want to do that, because they are (to me) obviously going for the Death Penalty. That's why it is so slow and methodical. IMO.

Then where's the body? Or the proof that Kyron is dead? Because they can't try a case of homicide unless there is strong evidence that the person was murdered, by the person accused.

Could be. We'll see if LE keeps saying they're proceeding on premise Kyron is alive, or if they stop. There's the presser tomorrow. It will be something to note.

Also, over here we wonder if TH will be called to the Grand Jury tomorrow.

LE has declared it a criminal investigation. Could be that they have some leads showing that she sold Kyron and he was taken to another state or country. That's criminal.
And with Kaine's and Desiree's strong belief that Kyron is alive, then maybe LE has been developing leads and have found some indication that she handed him off to someone, and that could be where this $350,000 came from. Although I didn't know kids brought that much money.

They can proceed without the body if another person testifies under oath that she has knowledge of Kyron being killed, how and by whom, for example. Especially if her statement includes details that can be backed up. she may not know where he is exactly but she may know other things.

True enough. This case has many things most cases lack; witnesses - multiple.

No. She would be testifying in her own defense, and that is not allowed. Not even a defense attorney is allowed to be in the room.
This is handled by the prosecutors.
If she were to decide to plead guilty, then that would be done in a court procedure after she is arrested and indicted.

Hmmm. She's *not a suspect* and she is a witness (last one to see him, all that).
She would either answer or not answer the prosecutor.
Are you sure she will not be called or is that your opinion?

She could be called, I think. She has not been named a suspect and she is the last person known to have been in charge of him. Technically are they investigating Terri or the disappearance of Kyron?
