Both closing arguments were passionate but not particularly persuasive. I doubt that this Judge will sentence Ethan to LWOP, but I hope that he imposes a stiff sentence of 40-50 years. JMO

I agree, the judge will likely give EC life with parole. I doubt it will be 20 years, the minimum sentence, and think that the judge will go with the maximum sentence (which I think is 30 years in Michigan) before parole review.

I think the defense lawyer did a good job in her closing argument, especially in her citing of case law in relation to Miller hearing precedents.

The issue of whether EC had mental health issues or mental illness was not really resolved by either side, IMO. And it ultimately may not matter. The prosecution agreed that he had mental health issues, but their argument ultimately focused on the issue of proportionality of mitigating factors versus the crime itself as the judge makes his decision regarding the sentence.

The defense seemed to adhere more strictly to the criteria established for a Miller hearing. I don't remember all of them, but the issue of family environment, possibiity for rehabilitation, and mental health issues seem to be several of them. The defense and prosecution agreed on environment growing up (family) and possibility for rehabilitation. So I think that will weigh in EC's favor as the judge reviews all the information presented, and weighs the mitigating factors against the issues of punishment for such a heinous crime perpetuated against his victims and society.

I agree with you. I cannot imagine imposing a LWOP sentence on a 17 year old!
I really liked the passionate closing argument of the Prosecutor--- IMO she was really talking from her heart.

Pontiac — Prosecutor Karen McDonald said she will never forget having to show Madisyn Baldwin’s mother the video of how she died at Oxford High School.

The 16-year-old’s instinct when faced with Ethan Crumbley holding a gun and shooting her classmates was to crouch to the ground in a fetal position and put her hands over her head. He shot her at point blank range.

Madisyn was the seventh person the then-15-year-old shot in the hallways at Oxford High School in November 2021. He shot four more after her.

Now, it'll be up to an Oakland County Circuit Judge to determine if Crumbley spends the rest of his life in prison or a certain number of years in jail. After an emotional hearing wrapped Friday, Judge Kwame Rowe is expected to release a decision September 29 and the teen will be sentenced Dec. 8...

It's the Miller hearing. His defense attorneys are correct on what they say should be allowed during this hearing.

If he gets sentenced as an adult, I can see it being overturned because the prosecutor's grandstanding and the judge allowing it, just like the Ross Harris case.

Obviously, the prosecutors won't decline to re-litigate like they did in the Harris case, but doing it this way increases the possibility that the families have to go through all of it again which is vile.

I've loathed this prosecutor from the start and I still do.
I respectfully disagree about the prosecutor or the judge for that matter. With respect to the Harris trial, there was lots of stuff that was let in that should not have been admitted to the trial-- so the verdict was overturned. I see the prosecutor in this case as passionate and not grandstanding.

They referred to it later as a spit hood. ETA: According to a quick Google search, it allows the person to breath, but does not allow them to spit at or bite people.

I'm glad I'm not the one making this decision. The prosecutor kind of threw a wrench into it, as well. They're charging the parents because they were aware of Ethan's mental health, yet bought him a gun. On the other hand, she is arguing that he has no mental illness and deserves LWOP.

As a native Michigander, I think it's safe to say that LWOP in Michigan means LWOP.

I hate to think that anyone so young is beyond hope. But he deserves long punishment with hopefully some treatment involved. I think life with the possibility of parole after 40 years? 50? could be an appropriate sentence.

But again, I'm glad I'm not making the decision.
I believe someone his age could be beyond hope, that said, I don't believe this judge, or maybe any judge will give this 17 year old defendant life without parole. I think the judicial system prefers to believe that someone that young can be rehabilitated.

Oxford ― A detailed independent report on the 2021 shooting at Oxford High School is expected on or before Oct. 30.

The report ― to be issued by Guidepost Solutions, an investigations, regulatory compliance, monitoring and security consulting firm ― is an examination of the events before, during and after the deadly shooting on Nov. 30, 2021 in which four students were killed. Seven others, including a teacher, were injured at the Oakland County school.

On Wednesday, Guidepost officials confirmed the update on the report's expected release. No date had been set previously...

Parents and families in the Oxford Community Schools District have been frustrated by the lack of information from the school board in the wake of the 2021 mass shooting, in which four students were murdered and seven people were injured. Parents have criticized the district for offering few details, and for taking a while to coordinate a report.

The school board had declined several offers made by the Michigan attorney general to conduct a third-party investigation after the mass shooting occurred. Eventually, the board was pressured to hire an outside firm to conduct an investigation -- but it has taken almost two years for the report to come out...

Decision coming Friday in Oxford shooter’s Miller hearing regarding sentence

"At 9 a.m. on Friday, Sept. 29, Oakland County Judge Kwamé Rowe is scheduled to share his decision in the Miller hearing. Essentially, the judge is deciding how the Oxford shooter will be sentenced and whether or not parole will be an option, though the Friday hearing is not an official sentencing hearing."

On November 30, 2021, the then 15-year-old Oxford High School shooter entered the school, shot and killed four students and injured seven others.

The teen was arrested and, despite not yet being old enough to drive a car, vote, or sign a contract, charged as an adult for the crimes of murder, assault with intent to murder and terrorism in connection with the shooting. He pleaded guilty to all charges on October 24, 2022. The Oxford High School shooting and the tragic loss of these young lives sparked horror and grief for the families of the victims and the larger community of Oxford, Michigan.

Tomorrow, a judge is scheduled to decide whether Crumbley can be sentenced to life in prison without the possibility of parole, essentially condemned to die in prison. As neuroscientists and psychologists who study adolescent brain development and decision-making, the scientific evidence demonstrates that life without parole is an unjustifiable sentence for any person so young. Assigning adult status to an adolescent and condemning them to death behind bars would be ignoring substantial evidence that teenagers are different from adults. Youth have a unique capacity for positive transformation, and we should not ignore the possibility of such transformation in sentencing...

I wonder if they also asked for an interview with the defense attorney and if she declined. Otherwise, it doesn't seem like good journalism to represent just one side of the story on a case of this magnitude.

The now 17-year-old is facing mandatory sentences of life in prison without parole in connection with the November 2021 massacre, but his sentencing must be handled differently because he is a minor, even though he was convicted as an adult.

The decision will be made Friday, Sept. 29. The judge has two choices -- life without parole or a term of years (likely 40-60 years behind bars). If he gets the minimum sentence, he’d be eligible for parole in his 50s...

At the end of the interview (posted above), Karen Drew mentions that the defense attorney was asked for comment but declined to be interviewed. "When reached for comment, the defense attorney said they did not want to say anything on the case ahead of Friday’s decision."

I'll reiterate: I'm glad I'm not this judge.

I think he's done a very good job and I have faith he will make a good decision. I don't know that that decision should be, I bow to his expertise.

The parents' case has been sent to the Michigan Supreme Court for review. They want the case thrown out and have been denied twice by lower courts. No details on whether or not MSC will hear the case.

The Oxford High School school shooter will find out Friday if he could spend the rest of his life in prison or if he will be serving a term of years to be determined at a later point.

Oakland County Circuit Court Judge Kwame Rowe has spent the past month looking over evidence presented during a four-day hearing to decide if it is proportional and fair to sentence shooter Ethan Crumbley, who was 15 when he killed four students and injured six others and a teacher at the high school, to life in prison as prosecutors have requested.

The teen faces either life without parole or a term of years, which must be a minimum of 25 to 40 years and a maximum of 60 years. He pleaded guilty to killing Tate Myre, 16; Madisyn Baldwin, 17; Hana St. Juliana, 14; and Justin Shilling, 17.

Rowe will give his decision on the matter at 9 a.m. Friday over Zoom. The teen's sentencing is set for Dec. 8...

So it looks like on December 8th, Ethan Crumbley will be sentenced to life without parole. The judge provided the background evidence that he took into consideration in making his decision.

Now, I am sure, the defense will appeal and EC will be held in jail until such time as the appeal is decided. And then transfer to prison, if Judge Kwame Rowe's verdict stands.

The jaihouse will have to beef up its security, as EC will now have to deal with this probable sentence on December 8.
