Well, here's the Cumberland County Courts docket for Mr. Holbert on July 15, 2015. Again, District Court is not where a criminal trial is conducted in NC. Maybe scheduling or a hearing of some sort.

Frustrating. What's the big deal on this thing?

I checked/searched the Fayetteville Observer site, and this is the most recent article -- it's from January, 2015. Sigh.

The mother of Fort Bragg soldier Pvt. Kelli Bordeaux is angry with Fayetteville police after a private investigator said he recovered additional remains Sunday from the site where the 23-year-old's skeletal remains were found last May.

Got a sinking feeling that the Court is set to exclude evidence which might lead to dismissal of the charges and is giving the prosecution time to find evidence free of the tainted evidence that would support the charges. Real concerns about how the state and the Court is allowing this continue as is. You cannot hold a person in prison indefinitely and yet not even be indicted.

How was the investigation screwed up?

The way I understood it is that LE could only question/interrogate NH so much or risk him "lawyering up." Correct? And that LE doesn't usually befriend and buddy-up to POI or suspects. So the cops basically waited...who knows for what. But they didn't do much of anything after some point.

So a PI stepped in (on his own? with permission from LE?) and buddied up to NH, and eventually got NH to not only admit to killing Kelli, but showing that PI dude where he actually put Kelli's body and then the PI informed LE.

Do I have the sequence of events correct?

And then LE or the medical examiners dept recovered most of, but not all of, Kelli's remains and some additional bones were later found in/around the same area and those were eventually collected.

How exactly does this screw up the investigation? What happens in cases where someone other than LE talks to the suspect and finds out where a body is and then reports it to LE? Is that automatically excluded? Did LE forget to get a search warrant? Did they not read the killer his Miranda rights? I'm trying to determine what the screwup is that would so compromise the case.

If a civilian is working on behalf of LE then they are considered an agent, constitutional rights come into play then

So the PI was working with the knowledge and permission of LE and he didn't mirandize NH before getting NH to talk to him? And thus everything NH said and admitted to would be excluded as a result?

Wait... I recall many cases in which a civilian was used by LE to get a suspected perp to confess or at least obtain enough information, by wearing a wire. Search warrant or subpoena issued in those situations? Some other legal permission granted before said civilian did whatever s/he did to get the perp to talk?

That's a big win in that they get him convicted, he gets LWOP, and no trial had to occur where 'issues' alluded to would have been on display.

Was he being threatened with a possible DP sentence? That would provide the motivation to take a guilty of 1st degree murder plea and LWOP.

All's well that ends well, as far as case resolution. Of course the sadness at the loss of KB, especially in such a brutal and heinous manner, will continue for all who knew her and all who hoped she would be found safe.

I'm pleased that he's taking the plea. The family of the victim doesn't need to have to sit through a trial. RIP Kelly.

I am a little confused, it says here she made a derogatory comment about him being a sex offender, I wonder how she found that out? She must have found out at the bar, because why would she go with him when he picked her up if she knew. Also it says she was knocked out right as she was being dropped off, I had heard previously in the media that she was knocked out just outside the bar and never even made it to anywhere near the complex. Either way, glad he is going to jail once and for all, he is an awful person.

If you believe that statement about sex offender, probably came from only nick as an excuse for making him mad.

Well we know he's a liar as well as her killer, and those comments could have only come from him, so that can be discounted.

I've always believed he thought somehow they were on a date and she rebuffed him and that's what got him angry enough to kill her. All accounts suggest they were not fighting inside the bar.

(BTW, where are all NH's defenders...the ones who were certain he couldn't have done this deed and that it had to be KB's husband in FL, so certain in fact, that they made up evidence that didn't exist and scenarios that never occurred? Aren't they lining up to put $$$ in NH's commissary account in prison??)

Also said he was doing cocaine and drinking the day before he showed where the body was, well nick was with PI all day that Tuesday May 13th
