As clearly as Judge Hippler could tell the attorneys that the trial is going to begin as scheduled, without actually telling them that the trial is going to begin as scheduled, he told them that the trial is going to begin as scheduled. HIs written opinion will be forthcoming' JMO

Good point! He does put out lengthy, well thought-out opinions. He did say, though, that he will get an opinion out "in short order", so I guess we will get it when we get it. I am looking very forward to reading it, as I am sure, we all are!

Maybe I'm reading too much into this, but I think this poor woman looked right into his eyes and he probably creeped her out even then. Why do I say this?

If she only saw a car that she subsequently realized was a match-- I don't think she'd be that terrified in retrospect. So ok, she saw the car, so what? That wouldn't even necessarily mean it was BK unless she noted the license plate or something. And I doubt she did unless she got a good view of his face because she would more than likely already have to be a little suspicious to notice something like that. Now, okay, what about if she saw both car and silhouette? That's still going to be a fatal blow to BK, who already has another witness saying she saw someone that looks like him with the crimes underway. But I doubt it's going to be just the silhouette because in the video that I'm watching, she seems to be saying "I saw Bryan there." There's nothing "maybe" in that, nothing conditional. And then I get the "parked right next to him," too, so my guess is she looked right into his face, and yeah, she is going to be the star witness, and yeah, jmo the D may try to rip her to pieces on the stand with any dirt they can dig up on her. This will probably boomerang against the D, though, as the woman seems sympathetic, and I can picture jurors thinking to themselves, you know, why are you bothering to put this woman through the wringer for this clearly guilty murderer?

So it's not going to help BK. And more time's not going to help BK. All it looks like now is D stalling for every single extra day they can wring out for BK to walk the earth, because it's increasingly glaringly obvious that nothing's going to help BK.

This guy is so done, jmo. AT's going to have her work cut out for her to avoid DP.

That seems like a lot to ask for, at that time of night. Did she carry a flashlight or turn on her phone flashlight? I’m wondering if she was parked in the house’s lot and BK was parked behind, near the apartments-hence “next” to each other.

Part of Websleuths culture, so I hope on-topic, but I want to thank @StarryStarryNight and others who have wished my family well—-many members of my family, those from 20 years old through 92, and including me, are facing serious medical issues right now. Just a bunch of evil illnesses that have landed on us all at once.

Only mentioning it because I’m grateful, and still with parents in Florida, but when I’m back in NY tomorrow I will catch up somewhat. (Or likely will have time at the always delayed airport).

I hate falling so far behind, but of course life must intervene.

I miss when I can’t get to distribute likes and loves to so many wondrous and informative posts, so this must suffice.

In the last week, it's sounding like BK is going to trial in August as scheduled, and there is an actual eye witness who will testify they saw him there at 1122 King Rd around the time of the murders of Kaylee, Maddie, Xana and Ethan!!

Perhaps the DD driver saw a PA tag, which would be of notice to her as an ID resident, especially if she was paying closer attention to her surroundings because of passing, parking near and just because of the time of night.

It would certainly appear as if the DD driver will be called.
Welcome Back, I believe the immediate Kohberger family may all be witnesses (some in more details than others) during the Guilt Phase because the D had a Motion to allow the family to sit through the entire trial even though they were being called. Judge Hippler did allow it.

Pretty sure they'll all be called during the Penalty Phase (Mitigating Factors) as well.

"It's time for this trial to happen", said by Bill Thompson in the State's rebuttal to Continuance. I believe he got his wish yesterday.

August here we come...

I do wonder, though, how the judge will handle the request for a special investigator to investigate the leaks that were visible on the latest Dateline episode. The judge invited the defense and prosecution to make the request if they felt it was necessary and now the request has been made. If the trial goes forward as planned in early August, will the special investigator do his/her work during the trial? And what would be the consequences if the leaks were identified and came from the prosecution side or defense side? These issues have to be addressed by the judge, as the appointment of a special investigator is now likely to move forward, and how Hippler handles this matter will likely be a significant issue on appeal in this death penalty case.

At one time, I thought that perhaps the DD delivery was made to the back slider, based on a supposition from Gray Hughes, using gps coordinates from DD, which contained a number that could not be discerned, with one of the guessed digits placing the delivery at the back. However, that was never a given, but only a thought, and after seeing the traffic stop video, where the woman told the officer that she takes hydrocodone for extreme pain from Fibromyalgia and arthritis, I am now of the opinion that it nay have been very difficult for her to negotiate the hill on the back side, especially in the dark, and so I believe that she very likely delivered to the front door, and was perhaps parked in the driveway area, or the street in front of the house. JMO

I'm curious as well where the DD delivery was actually made, and have seen some discussion of it that makes sense to me that she would probably have been asked to deliver to the front door right where she was parked, and would not make her way around the side of the house and up the incline to drop off by the slider (unless that was a common delivery practice for Xana and the DD driver that was in place).

If the DD delivery was indeed made to the front door, with Xana coming down one set of stairs from her bedroom to the front/ground floor front door to get it, I've always wondered whether BF who lived on that floor would have heard them (or she was asleep then), and if awake and heard them could confirm that she heard Xana and the DD driver making the hand off at the front door and Xana going back upstairs with her food.

And if so, if that helped LE verify when & where the DD delivery occurred & proof of life for Xana at that moment.

Also, IIRC, there were statements in MSM in the first few days (that may have been removed or just been unverified rumours) from people who said they walked by the front of the house after sunrise later that morning, and maybe also the people who came later in the morning and discovered the crimes, that the front door was wide open.

I've always wondered about that aspect of the front door being left open, because it was pretty cold that night and doesn't seem like it would have been intentional by people living in the house or Xana/the DD driver in terms of heat loss & security when it was the middle of the night in November and everyone in their beds and sleeping or close to sleeping.

So it makes me wonder if BK purposely opened it after the DD driver left and Xana went back upstairs with her food, before he went around to break & enter through the slider and commit the murders.

Or if he knocked or banged on the door and BF was awake & opened it thinking it was someone who they knew and was locked out (and didn't see anyone).

Or if Xana went back down to answer and saw him and was not sure who he was or if he was friend or foe, and then that is when one of them said "There's someone here".

Or if it could have been one of the housemates thinking Kaylee's ex bf Jack was there (after she & Maddie supposedly called in the hour before & may have wanted him to come over to the house) and needed to be let in? and then that is when one of them said "There's someone here".

What if BK did try to interact with any of the housemates he could rouse at the front door just after the DD driver left and he pulled back in just checking the situation, or to gain entry to the house, and when one of them opened the door they left it open for a visitor they thought might be coming around to the doors (and would check the slider next) and he was the one who went around to the slider next?

I'm not sure if it's of much significance or whether it will come out at trial, but have always wondered if he:
  • First tried entering through the front door, and if it was left unlocked (for someone the housemate's thought might be coming to see one of them), just threw it open to create a distraction while he went around to the slider, or
  • Knocked on the front door & he heard someone coming to answer & that was too much attention with one or more housemates still being awake & answering the door, so he stepped away before they opened it, and then went around to the slider.
JMM (just my musings), it's always been a niggling thought for me about what may have happened at the front door, right in front of where the DD driver parked and said they saw him parked there when they arrived, and why it was left standing open in the cold in the middle of the night if that is accurate from early on in MSM that people said they walked by and saw it was open.

I doubt the DD driver actually saw BK "in the flesh" and I don't think she literally means that she did when she says she "saw" him in that DUI interview.

If she was an eyewitness who had seen BK that night eg. in his car; exiting his car etc I think this would have been reported well before now and would likely have appeared in Court documents, including the PCA.

What seems more likely to me is that she saw BK's white Elantra park/parked near where she delivered the meal for XK. The white Elantra would have meant absolutely nothing to her on that night but later took on huge significance once she learned what had happened and was contacted by LE to tell them what she saw or heard while she was at/en route to/from the address.

Her "shorthand" expression that she "saw" BK more than likely means she saw BK's car that night parked near the address and later came to discover it was BK's car.

Imagine if she had only had a dash cam recording when she made that delivery...
Sorry if this has already been discussed. I’m catching up.

But don’t dash cams automatically turn on when the DD driver hits arrived? Or something like that? Don’t they all have dash cams?

We know from court docs linked somewhere upthread in the past very few days, that the initials of the DD driver who delivered to King Rd that morning are MM. The woman in this video, claiming to be the DD driver that morning, is a MM. DD certainly knows if she was the driver that morning, as do LE and attorneys for both sides of this case. I see no reason to believe that she was lying about being the DD driver that was there that morning. JMO

The new information conforms to the movements of the Elantra between 3:56 and 4:04 before parking around 4:08/09.

Just clarifying that it's doubtful that the DD driver saw BK as he parked the final time.

IMO she interrupted him when he parked after the third loop. We may learn why he needed a second and third pass too, but this all dovetails with the DDD arriving just ahead of that 3:59 delivery of her order. He couldn't have parked before 3:56 (the Elantra was moving) and she was likely gone when he decided he was clear to park but all of his movements from 4:37 sync with what she describes. His headlights. The front view. The turns. The deviating loop.

There's no reason to think she was still there when he parked again (why would he if she's what made him drive away in the first place) and might have only been there a long two minutes. Long enough to be aware of Bryan. We don't know how or whether she altered her actions because of his presence, but IMO we ABSOLUTELY know that he altered his, because of hers.

And that makes it pure evidence IMO. 1:1.

And it's not just her word because her story is corroborated by cctv, timestamps, DD and by BK himself. His Elantra told on him. A lot.

Placing Bryan and/or his Elantra at 1122 King Road at 3:58 am on 11/13 blows everything AT has said out of the water. Leaving her not enough water to float her toothpicks.

More time won't give her more insight, more alibry, more SOBDDI (some other bushy dude did it), more sweeping explanations for BK's poor choices, it'd just age the carpet in the courtroom.

I haven’t been following this case as closely as i did before BK’s arrest other than watching some of the YouTube and tv airings on the actual crime itself. (Haven’t been following the legal battles.)

So what’s AT trying to accomplish here. I’m asking in all seriousness. WHY does she want the delay? Is she REALLY just not prepared?!?! Hasn’t been doing her job? I mean come on! It’s awfully embarrassing that she says that out loud 🤦🏻‍♀️🤦🏻‍♀️🤦🏻‍♀️

sounds like a 7th grader who didn’t turn in her homework on time giving excuses as to why. The dog ate it….

Wouldn’t BK want this trial to start on the date planned? If i was as a defendant in jail, I’d want to get it started right away. Especially if innocent (i don’t think he is), but even if not innocent, seems like any defendant would want to get started. To know what their future life will or won’t be like. No?

I expect a great deal of great testimony will come from this witness, but that one little disruption -- her parking by Bryan, him driving away and then returning, presumably to see if she'd left -- resulted in the front view of his plateless Elantra making it a standout amid 22 octi-thousand other Elantras in Idaho. She inadvertently launched that sequence and for that alone -- and probably more -- she's a HERO, critical in identifying BK as the assailant.

I’m guessing whichever family member he called very very early in the morning shortly after the murders and spoke with for a looong time. And I’m assuming the dad for sure (whether he was the one on the phone or not) since they had that long drive together back home right b4 BK was arrested. JMO

We have heard almost every excuse from AT about why they need a continuance, EXCEPT that the dog ate the 68 terabytes of discovery. She still has a few weeks to use that one though. She is holding onto it, like I hold onto a Mulligan when playing golf, in the event I need it on the second or third hole. JMO
