JS wasn't off the bench. That video was shot while they were in 'secret sidebar', and the camera swung over to the DT table.

Maria looked directly into the camera at least twice and made no effort to change her face angle.

Why on earth does there need to be another ruling from the bench to make sure that no one can video JA @ the defense table because her BFF keeps talking on camera? Um . . . . this is a non-issue IMO! If Miss Maria doesn't want to be filmed talking . . . . she doesn't have to be . . . she can just stop talking!!!!

Is Nurmi going to ask that every camera in the whole world be restricted from talking any pics or video of anyone who was ever connected to the DT in this trial? Why not give them their own planet to live? (no offense to the Mormons)

It's exactly what they wanted. They wanted to be seen chit chatting, they wanted it to cause a stir, and they wanted to set up Nurmi's argument for today. It's just antagonistic.

There's one like her in every trial. I haven't seen anyone as ostentatious as Maria though.

Me either. If it was me, I'd try to keep the 'relationship' strictly professional. If I had nothing to do to keep Jodi from thinking I was available to chitchat, I'd pretend I was doing research in a law book, taking notes, looking busy. Surely Maria can do her job without looking like she really IS Jodi's bff.

Here's the rule Nurmi cited. It says nothing about a mitigation specialist, it specifies attorney or judge. So why does JSS send out the PIO for this?

(k) Prohibitions. A person is not permitted to photograph, record, or broadcast a proceeding in the following circumstances:

(1) No use of recording devices while the judge is off the bench: A person may use a recording device in a courtroom only when the judge is on the bench, and use of a recording device must terminate when the judge leaves the bench, except as provided in paragraph (i).

(2) No jurors: Cameras must be placed to avoid showing jurors in any manner. Audio recordings or broadcasts of jurors' statements or conversations are also prohibited, except that a juror may expressly consent to an interview after the jury has been discharged.

(3) No attorney conferences: Audio recordings or broadcasts of bench conferences between a judge and counsel, or off-the-record conferences between attorneys and their clients, or between attorneys, anywhere in the courthouse are prohibited.

(4) No readable documents: A person may not use a camera to take readable images of the contents of documents or other materials, whether in electronic or other form, that are located at counsel tables, the judge's bench, the work area of judicial staff, or the jury box.

(5) No juvenile proceedings: Photographing, recording, or broadcasting of juvenile court proceedings is only as allowed by Arizona law, or as provided in paragraph (i).

I hope Nurmi does include this in his request about the video. Maybe it will backfire and the Appeal Judges indicate that any and all filming is allowed since trials are supposed to be public.

They knew the camera man would be filming Jodi while lawyers not around. Jodi has been filmed many times chatting with MDLR during sidebars. He's just trying to bolster the appeal he's currently busy with.
