2011.01.06 Baez Slapped with Formal Sanction

I'm sure that during the long traffic hold-up Mr Slabaugh could have phoned in to JB to express his concerns about getting there on time ( although he was 5 hrs later than he thought) and JB or CM could have picked up the phone to call HHJP- from what we have seen HHJP has made himself available by cellphone and email, and a message could have got to him to ask for a one day extension.
None of this happened. You have to wonder why...
HHJP has already addressed his lack of compliance, so why do they think he is going to be willing to re-visit the topic?

HHJP specifically asked Baez when he was one hour past the deadline did it occur to him to pick up the phone and ask for an extension and
Baez said he didn't think it would be an issue. So, IMO, I don't think it matters at this point if the 'courier' left at 8am that day and was in a terrible accident where he lost his arm and they included the arm on this motion as an attachment. IMO, Baez showed his contempt for the court when he stated he didn't think it mattered to obey a court order, and that's why he got slapped with sanctions.

Yes ... This tactic seems more like an attempt at distraction to not deliver what HHJP ordered.

It would take a lot for a Judge to do that. But I do think JB and company are doing a bang up job of really Peeving His Honor off. I bet he's oscillating in his chair at home :)

attorney Cheney Mason has filed a lengthy motion asking the court to reconsider the sanction imposed against fellow defense attorney Jose Baez last week for failing to turn over discovery information to the prosecution.

The 12-page motion also provides additional details about what defense expert witnesses will testify about during depositions and, presumably, at trial.

"The defense has, because of the intervening actions, provided the above information in an effort to, not only fulfill the requirements of the court, but also show a good faith effort in complying with this court's directions," Mason wrote.

They are now "attempting" to comply with the expired order. I don't think Judge Perry will fall for that ole slight of hand.

There's no need for an apology lg, it's JB and company that are so misguided it's almost comical. How on earth do they think that Dr. G meant Caylee's little body was placed upright in the woods? This is proof that they either have not read 1/10th of the discovery or that it just simply does not compute:crazy:

IMO, this is a perfect example of why the State wants the Defense to turn over their expert list along with what their opinions are and where they got them. There is no way the State can anticipate every possible bs move such as this one the defense plans to pull. Now, at least on this blatant misrepresentation of the facts, the State can go in prepared to rebutt this without turning it into a he said/she said kind of situation for the jury.

I think ME opens the skull to get the brain out in one piece. In this case it would not be necessary. Makes you wonder how much was taken out of context of what defense was actually told by the experts. jmo

Well, she doesn't watch TV. I'm sure Baez hopes she doesn't read the Sentinel, either.

Ignorance is bliss, so maybe she's working behind the scenes?

I just read Baez's motion fighting the sanctions and all I have to say is "ARE YOU KIDDING ME?" :furious:

So does Baez think his "description" of each "expert" qualifies as a "written report"? And seriously....is there a BIG difference in "substance" and "subject matter"?

OMG OMG...Just got to the end. Wanted to THANK everyone for reading the motion. I just cannot subject myself to either reading nor watching the "duh" fense AT ALL. I have not laughed so much in months! Bless you all, and I tried to "thank" everyone, but left a few out...

So did she or Cheney (assistant to the undersigned counsel) do it???? lol

And where is Smith vs Smith as cited on page 11??
